Dear Mr. Richards,
On 21 September 2006, I conducted a complaint investigation alleging that sewage from
the mentioned RCU sites was being spilled on the ground. The pictures I took indicate
some spillage of sewage has taken place under a couple of the RCU’s. I also noted and
took pictures of garden hoses being used to attach RCU’s to the resort water system.
The policy of this department is to require a septic system connection to any dwelling
(including RCU’s) when an unlimited supply of water is available.
We would like this situation to be rectified by removing the water connections to the
RCU’s. Those units are also supposed to be emptied at an approved dump site/station. It
has been our experience that use of “portable sewage caddies” is often subject to
improper use/spillage and creates unsanitary conditions and health hazards.

The Complainant being duly sworn, makes complaint to the above-named Court and
states that here is probable cause to believe that the above-named Defendant committed the
offense described below. The Complainant states that the following facts establish PROBABLE
CAUSE:
Complainant, Wayne Roisum, is a duly acting and appointed Inspector with the Otter Tail County
Land and Resource Management Office, who investigated and received information regarding the
below-described offense. On July 29, 1997, the Land and Resource Management Office received
a report that a 16 foot by 80 foot mobile home was being placed at the Wind and Park Resort and
Campground located on East Battle Lake, an area within a shoreland area. On July 30, 1997,
complainant viewed the property and did observe a mobile home 16 feet by 80 feet in size placed
on the property. Complainant spoke with JANET JUDD, hereinafter referred to as the defendant,
who indicated that the mobile home which was 16 feet by 80 feet in size was replacing a mobile
home smaller in size. A check of records at the Land and Resource Management indicated that a
site permit had not been obtained for placement of this mobile home on the property.

Preliminary Plat and Conditional Use Permit - "Long Lake Shores Second Addition”.
Du Wayne Sonnenberg:
Motion by Lee, second by Lindquist, and unanimously carried to approve the Preliminary Plat of
“Long Lake Shores Second Addition” consisting of 6 residential lots and a Conditional Use Permit
to construct a road to service the plat on Long Lake (Section 28, Twp. 137, R. 40, Hobart
Township, 56-388). The approval is subject to conditions as recommended by the Planning
Commission. Further, a clarification in the Planning Commission motion was requested to read as
follows: “the dedicated right-of-way will not go to the westerly property line”.
Conditional Use Permit - Lawrence E. Kemnitz:
Motion by Lindquist, second by Portmann, and unanimously carried to approve a Conditional Use
Permit to construct a driveway from a township road to a dwelling on Silver Lake (Section 21, Twp.
133, R. 40, Everts Township, 56-302) with conditions as recommended by the Planning
Commission.
Conditional Use Permit - Otter Tail County Highway Department:
Motion by Lindquist, second by Stone, and unanimously carried to approve a Conditional Use
Permit for S.A.P. 56-680-03, reconstruction of CSAH No. 80 on the Otter Tail River (Section 14,
23, & 24, Twp. 136N, R. 39W, Perham Township, 56-OTR) as presented.
Conditional Use Permit - Big McDonald Resort. Gerald Lowe:
Motion by Stone, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit to convert an existing 1 bedroom cabin into a 3 bedroom cabin on Big McDonald Lake
(Section 18, Twp. 136, R. 40, Edna Township, 56-386) as presented.
Conditional Use Permit - “Linden Park Resort", Janet Judd:
Motion by Stone, second by Lindquist, and unanimously carried to approve an after-the-fact

Position Authorization Amended
Land & Resource Director, Bill Kalar, requested authorization to hire a temporary inspector instead
of technician based on changing situations with staff in the office.
Motion by Portmann, second by Lindquist, and unanimously carried to amend the motion of April 7,
1998 to authorize a temporary inspector position rather than the former authorized temporary
technician position.

Board of Commissioners adopts the following resolution:

RE:Violation #1285, Janet Judd, DBA Linden Park Resort & Campground, East
Battle Lake (56-138).
July 29. 1997 -
that they had pulled in another "Big" mobile home one week ago.
Received Complaint of a 16’ x 80' mobile home onsite and also
July 30. 1997 -
I found one (1) new mobile home. I spoke with the owner of the mobile home and
she stated that previous mobile home was smaller in size. The new mobile home is
16' X 80’ in size.
I was onsite to investigate the Complaint received by our office.
August 4, 1997 - I issued Violation #1285 (copy enclosed).
August 5, 1997 - I spoke with Janet Judd on the telephone. I told her she would
be receiving a Violation within a few days. I told her to make a scaled sketch of
the resort and everything on it as a start towards a solution for this violation. I told
her she would need an After-The-Fact Site Permit for the mobile home and an
After-The-Fact Conditional Use Permit for replacing the smaller mobile home with a
larger mobile home. She is to contact our office upon the receipt of Violation
#1285.
August 13, 1997 -1 talked with Janet Judd today. I advised her of the need for a
permit for any new structures and the need for a Conditional Use Permit if the
structure to be replaced is smaller than the new structure. I also suggested that
she make an appointment with Bill Kalar to discuss the provisions of our Shoreland
Management Ordinance pertaining to cluster developments (resorts). She said she
would call August 18, 1997 to schedule this meeting.
» August 25, 1997 - Janet and Steve Judd met Bill and I in our office regarding
' Violation #1285. After discussing this matter, the following options, any of which
could resolve this matter {no particular order), were given to Mr & Ms. Judd:
1) Remove the manufactured home (MH) from the property.
2) Apply for and receive an After-The-Fact Conditional Use Permit (CUP)
and an After-The-Fact Site Permit ($500.00).
3) Do nothing. If this alternative is selected, this matter would be
referred to the County Attorney's Office for legal action.
They will inform our office as to which alternative they would like on or before
September 2, 1997.
Janet Judd called regarding Violation #1285 (newSeptember 5, 1997 -
dwelling unit at her resort without permits). She has decided to "take her chances
in Court" rather than apply for the After-The-Fact Permits.

Dear Mr. Magnuson:
It has been brought to our attention that a mobile home and two
camping units have been brought onto the Lindenwood Resort property.
On May 7, 1981 our office inspected your property and found that these
units had been brought in.
,\lthough no site permit is required if the units are on the lot for
a period of time not to exceed 1.5 days no sewer or electrical connect
ions can be allowed to these units.
ince the mobile home had electrical connections as did the camping units
