Sunrise Properties - Variance application approved with a condition. (8:45 p.m.)
April 9, 2015 Meeting - After consideration and discussion, Ward Uggerud made a motion, second by Paul Larson
and carried with Rick Wilson voting no, to approve the variance as requested in the application dated October 21, 2014
and as depicted on the supporting documentation provided with the application with the condition that the applicant
cannot exceed what would be permit when applying the State wide density calculation standards for commercial/resort
use. The approval of the requested variance was considered a good trade as it removes an older structure from the
waterfront area, which would be a good improvement and relocates/places four RV units/sites in the second tier. These
sites would mostly likely be rented as seasonal sites. The applicant’s proposal places development back away from the
lake. The applicant’s request was viewed as a reasonable request and is not an unreasonable use of the applicant’s
existing property. It was also noted that request is a minor alteration in the density of the existing resort.

Steve and Colleen Brakke - Variance application approved as modifled. (8:23 p.m.)
Steve and Colleen Brakke, part of Government Lot 5, Section 27 of Lida Township by Lake Lida, requested
the following;
Option 1 - Would like to put on a new roof on existing garage and extend garage 6’ in length towards lake.
Requesting variance of approximately 43 ’ from lake.
If addition went on roadside I would not meet setback requirement from road easement.
Option 2 - Variance of 3’ from easement for addition to roadside.
The audience was polled with no one speaking for or against the variance as requested. After consideration
and discussion, Steve Schierer made a motion, second by Rick Wilson and unanimously carried, to approve
the 6’ garage enlargement project by placing the proposed addition on the north side of the existing garage
being no closer to the ordinary high water level or the road easement then what would be allowed when
extending the east and west walls 6’ in a northerly direction. It was noted that there is adequate room to
expand the garage to the north. The variances as approved do not directly or indirectly grant any other
variances for the proposed development.
John M. Frank - Variance application approved as requested. (8:40 p.m.)
John M. Frank, Lot 18 Block 1 of Brightwood Shoreline, Dead Lake in Star Lake Township, requested the
following; We are proposing to construct a new dwelling with an attached garage and deck, being 73 feet
from the ordinary high water level. The required setback is 200 feet so we are requesting a variance of 127
feet. We are also requesting a 20 foot variance from the road right-of-way. The proposed attached garage
will be zero feet to the road right-of-way. Please note that the proposed new dwelling, deck and attached
garage are in line with neighboring structures. We are proposing to begin construction in the near future,
but are also requesting a variance to place a camper on-site being no closer than 73 feet to the ordinary high
water level. The camper will be removed prior to any construction of new structures. The audience was
polled with no one speaking for or against the variance as requested. After consideration and discussion.
Ward Uggerud made a motion, second by Rick Wilson and unanimously carried, to approve the variances as
requested in the revised application packet submitted to the Land and Resource Office on April 8, 2015 and
as presented to the Board of Adjustment at the public hearing on Thursday, April 9, 2015. The variances as
granted will provide the applicant with a reasonable use of the property. The variances as approved do not
directly or indirectly grant any other variances for the proposed development.

a home 60’ fi-om the lake. In the case that this variance is granted I would be turning in a request to the
Planning Commission asking for a permit for a cluster development allowing me to construct the home
without the removal of the existing cabin. October 9, 2014 Meeting - The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion and with the
applicant’s verbal consent, Thomas Lee made a motion, second by Steve Schierer and unanimously carried,
to table this hearing until a future meeting date to allow the applicant an opportunity to consider other
alternatives, for example - platting. November 13, 2014 Meeting - No action taken by the Board of
Adjustment as prior to the November 13, 2014 meeting Mr. Kohler had submitted a letter, dated October 21,
2014 requesting that his application continue to he tabled imtil Spring of 2015. December 12,2014
Meeting - Application remains tabled until a future meeting date. April 9, 2015 Meeting - Prior to the
public hearing the applicant submitted a letter requesting the continuation of the previously tabled action.

After discussion and consideration, Thomas Lee made a motion, second by Michael Harris and unanimously carried
to approve the variance as requested in the variance application dated November 15, 2014 and as depicted on the
drawing submitted with the application with the condition that a registered surveyor’s drawing must be provided at the
time of conveyance. It was noted that both properties currentiy have more than 25% impervious surface coverage
and after this proposed subdivision both properties will still have more than 25% impervious surface coverage.
Mark and Tammy Jossart - Variance application approved as requested. (6:52 p.m.)
Mark and Tammy Jossart, Lots 61,62, 63 and 64 Sater-Humphrey Ranch Camp, Ten Mile Lake in Tumuli Township,
requested a variance from the public road right-of-way setback requirement to build a 24’ by 24’ addition to the north
end of an existing garage to increase garage size. Proposing to place a 24’ by 24’ addition to existing detached
garage proposing to be 8” from road right-of-way. Requesting a 19’ 4” variance from the required 20’ setback. Keith
Sellner appeared with Mark Jossart at the public hearing. The audience was polled with Keith Sellner speaking in
favor of the applicant’s proposed location. After discussion and consideration. Ward Uggerud made a motion, second
by Thomas Lee and carried with Mike Harris voting no, to approve a variance of 19’ 4” from the required road right-of-
way setback of 20’ for the placement of a 24’ by 24’ garage addition 8” from the road right-of-way. The member
voting no had suggested a possible alternative site.
Charles and Elaine Blixt - Variance appiication approved as requested. (6:57 p.m.)
Charles and Elaine Blixt, part of Government Lot 5 and part of the Southeast Quarter of the Northwest Quarter,
Section 4 of Friberg Township by Tonseth Lake, requested the following: Build up on existing footprint previously
subject to setback variance to increase roof pitch and add loft area. Current structure 65’ from lake. No change in
current setback. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Paul Larson made a motion, second by Ward Uggerud and unanimously carried, to
approve a variance of 135’ from the required ordinary high water level setback 200’ for the placement of the proposed
development as described in the variance application dated November 15, 2014 65’ from the ordinary high water
level. It was noted that the proposed development will be no closer to the ordinary high water level than the existing
development.

Hi Wayne:
I met with the Planning Commission and I was asked to waive my right to a 60 decision. They have asked me
to meet with them this winter to work on a new county rule for RCU density.
Since a new density rule for RCUs would greatly impact my request for variance, I feel it would be better to
postpone my request for variance until this spring.
However, I would be able to attend in the December meeting if you feel that would be better.

After consideration and discussion, Paul Larson made a motion, second by Ward Uggerud and unanimously carried,
to approve a variance of 40’ from the required side lot line setback of 65' and to approve a variance of 18’ from the
required ordinary high water level setback of 20’ for the placement of an 8’ by 20’ deck 25’ from the side lot line and 2’
from the ordinary high water level. The hardship/practical difficulty is the terrain features of the applicant’s property
and safety concerns for the property users. The variance as approved will provide the applicant with a reasonable
use of the property. It was also noted that if the applicant had constructed a platform it would have been a legal
structure not requiring a variance; however the addition of the handrails created the need for the variance. The
handrails are needed for safety.
Sunrise Properties - Tabled per applicant’s request. (6:58 p.m.)
Sunrise Properties, Lots Six and Seven, Block B Hursh’s First Addition to Linden Park and part of Government Lots 1
and 2, Section 26 of Girard Township by East Battle Lake, requested the following: Relocating structures from tier 1
to tier 2. Increasing the total number of units from 26 to 29. The maximum allowable density is 8. The audience was
polled with no one speaking for or against the variance as requested. After consideration and discussion and with the
applicant’s written consent (email dated November 12, 2014), Thomas Lee made a motion, second by Michael Harris
and unanimously carried, to accept the applicant’s request to table this hearing until a future meeting date to allow the
applicant an opportunity to attend the public hearing.
Wayne Kolle — Approved the ordinary high water levei setback variance as requested and denied the variance as requested for the septic system. (7:00 p.m.)
Wayne Kolle, part of Government Lot 1, Section 9 of Tumuli Township by Mud Lake, requested a variance of 50’ from
the required ordinary high water level setback of 200’ for the location of a building site 150' from the ordinary high
water level and a variance of 50’ from the required ordinary high water level setback of 150’ for the location of the
primary septic system 100’ from the ordinary high water level. Glenn Howe, Surveyor represented the applicant at the
public hearing. A letter from the Richard West, Otter Tail County Highway Engineer stating that if the variance is
granted the easement would be released was read for the record. The audience was polled with no one speaking for
or against the variance as requested.: After consideration and discussion, Steve Schierer made a motion, second by
Rick Wilson and unanimously carried, to approve a variance of 50’ from the required ordinary high water level setback
of 200’ for the location of a future building site 150’ from the ordinary high water level and to deny the variance as
requested for the primary septic system. The hardship/practical difficulty is the unique shape of this approximately 8
acre parcel. The variance as approved and the release of the highway easement will provide a reasonable use of this
property.
Sam and Gwen Humann - Approved the variance application as requested. (7:22 p.m.)
Sam and Gwen Humann, part of Government Lots 6 and 8, Section 25 of Dead Lake Township by Dead and Alice
Lakes, requested the following: Replace existing dwelling and detached garage with new dwelling with attached
garage at 75’ from the ordinary high water level. Required setback is 200’ requesting a variance of 125’. The
audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve a variance of
125’ from the required ordinary high water level setback of 200’ for the placement of a new dwelling and attached
garage 75’ from the ordinary high water level as depicted on the drawing submitted with the variance application. The
hardship/practical difficulty is the location of a lake on two side of the property which makes it impossible for the
applicants to meet the required 200’ setback.
Faye Engkjer - Approved the variance application as requested. (7:27 p.m.)
Faye Engkjer, Lot 10 Bowery Beach, Pelican Lake in Dunn Township, requested the following: Proposing to replace
the existing septic system with pressure bed. The septic system being 3’ from property line and 12’ from the dwelling,
required setback is 10’ from property line and 20’ from dwelling. Patricia Stock, A-1 Septic appeared with the
applicant at the public hearing. The audience was polled with no one speaking for or against the variance as
requested: After consideration and discussion, Rick Wilson made a motion, second by Thomas Lee and unanimously
carried, to approve a variance of 7’ from the required lot line setback of 10’ and to approve a variance of 8’ from the
required 20’ setback from a dwelling for the placement of a septic system 3’ from the lot line and 12’ from the dwelling.
The variance as approved will provide the applicant with a reasonable use of her property. It was also noted that the
proposed location is the best, if not the only location for the proposed system as stated by a licensed system
designer/installer.

Meeting of the Otter Tail County Planning Commission was held on November 12, 2014 at 6:30
P.M. in the Commissioner's Room, Government Services Center, Fergus Falls, Minnesota.
Roll Call:
Members Present; Loren Bailey, Rod Boyer, Brent E. Frazier, Richard Gabe, Bert Olson, Robert
Schwartz, David Trites, David Wass and Rick Wilson.
Members Absent: Marion Gill.
David Hauser represented the County Attorney's Office and Bill Kalar represented the Land &
Resource Management Office.
Minutes of October 8. 2014: A motion by Wilson, second by Frazier to approve the October 8,
2014 Minutes as mailed. Voting: All members in favor.
Linden Park Resort & Campground / Sunrise Properties OT LLC - Approved With
Conditions:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Rearranging
structures on resort properties. Removing lakeside cabin and two RCUS (Recreational Camping
Units), for the below totals.

Ron Grams represented the Application.
Jim Thompson expressed concerns regarding density (i.e. Shoreland Management Ordinance
requirements), an existing easement, the potential for pollution (run-off & sewage), the negative
impact on property values, vandalism and requested denial.
Motion: A motion by Wilson, second by Wass to approve the removal of the lakeside cabin and
the 2 RCUs as proposed, with the relocation of these 3 units to any of the 6 proposed sites,
allowing a maximum of 26 units. Voting: All Members in favor.
Shoreland Management Ordinance Discussion: Bill Kalar indicated that the County Board
has expressed interest in addressing the Shoreland Management language this coming winter.
He indicated that topics for discussion should be forwarded to him or Marsha.
Adjourn: At 7:50 P.M., Chairman Olson set the Meeting. Providing Applicants waive the 60-
Day Rule, the Chairman will evaluate the weather conditions and determine the next meeting
date.
