Owner provided a 1992 certificate of compliance with the plan. The certificate of compliance was expired and hence unacceptable. I brought this issue to the attention of the person in charge (Robbie Richards). Mr. Richards stated a new compliance inspection of the existing septic system would occur, but not until the spring. Plan approval will be given on the condition that a current certificate of compliance will be provided to the inspecting sanitarian, Mr. Rick Toms, during the opening inspection. 1. Every building structure or enclosure shall be kept in good repair and maintained to promote health, comfort, safety and well-being of persons accommodated, shall be kept clean and free of litter or rubbish (Minnesota Rule, part 4625.0400). 2. Floors shall be smooth, easily cleaned, shall be kept clean and in good repair. Abrasive strips for safety purposes may be used to prevent accidents (Minnesota Rule, part 4625.0500). 3. Walls and ceilings shall be kept clean and in good repair. Studs, joists, or rafters shall not be left exposed unless suitably finished and kept clean (Minnesota Rule, part 4625.0600). i Linden Park Resort January 23, 2008 Page 2 Lodging Plan No. 080590 4. Every room occupied for sleeping purposes by one person shall contain at least 70 square feet of usable floor space, and every room occupied for sleeping purposes for more than one person shall contain not less than 60 square feet of sable floor space for each occupant thereof. Under no circumstances shall there be less than 400 cubic feet of air space per occupant. Usable floor space excludes closets and bathroom areas. Beds placed side by side must be separated by a minimum of three feet (Minnesota Rule, part 4625.0900, section A) Cabin #3 • Two (2) bedrooms • Proposed occupancy of each bedroom is two (2). • Proposed square footage for each bedroom is 120 sq. ft. • Preliminary approval has been granted. Cabin #4 • One (1) bedroom • Proposed occupancy is two (2). • Proposed square footage is 120 sq. ft. • Preliminary approval has been granted. Final approval on the above requirement for all rooms will be made by the inspecting sanitarian, Mr. Rick Toms, during the opening inspection. 5. When flies, mosquitoes, and other insects are prevalent all outside doors, windows and other openings shall be screened (Minnesota Rule, part 4625.0700). 6. All equipment, fixtures, furniture and furnishings, including windows, draperies, curtains, carpets, electrical appurtenances, decorative or utility items shall be kept clean and maintained in good order and repair (Mirmesota Rule, part 4625.1100). 7. Toilets and bathrooms shall be kept clean and in good repair and shall be well lighted and ventilated (Minnesota Rule, part 4625.4625.1200). 8. All lavatories for public use or furnished in guest rooms shall be supplied with hot and cold miming water and soap. Approved sanitary towels or warm air devices shall be provided for hand drying (Minnesota Rule, part 4625.1400). 9. Provide a certificate of compliance for all septic systems or sewage treatment facilities operated in conjunction with the licensed facility (Minnesota Rule, Chapter 7080). The temperature of hot water which is provided in any public area or guest room, including but not limited to lavatories, bathtubs or showers, shall not exceed 130° F (approximately 55° C) (Minnesota Rule, part 4625.1300). 11. Comply with the Minnesota Clean Indoor Air Act (MCIAA) (Minnesota Rule, part 4626.1820). 12. A separate on-site inspection will be conducted by the State plumbing inspector to determine compliance with the Minnesota Plumbing Code (Minnesota Rule, part 4715.3130). Contact Mr. Gary Topp at 218-739-7206 ext 3, for the above inspection. Obtain an electrical inspection from the Minnesota Electrical Licensing and Inspections. All electrical systems must comply with the currently adopted edition of the National Electrical Code (Minnesota Statute, part 326.244). A separate on-site inspection will be conducted by the State Fire Marshall to determine compliance with Minnesota Fire Code requirements. Contact them directly for submission of plans. 16. Office) to Daniel banning (1-952-888-1967) regarding him receiving a letter from the resort giving him until November 1, 2002 to remove his motorhome from the resort. In this letter the resort owner stated that he was doing this because he was having trouble with the County. I informed him that there were not any notes in the file indicating that our Office was requiring removal of any campers (I also had checked with the Adm. & some inspectors and they were unaware of any problems). In my discussion with Mr. banning, it appeared that; 1. His motorhome has been onsite for 2 summers. 2. His brother had a camper onsite for 1 summer (he also received a letter from the resort). 3. There could be possibly a total of 7 campsites (near the lake) that may be required to leave. I explained to Mr. banning that it sounded like these campers were placed onsite prior to the Resort receiving a CUP for additional campers - and that they just withdrew a request for 24 additional campers at last nights Planning Commission Meeting. I informed him that at the August 14, 2002 Planning Commission Meeting, the Commission passed a motion to table their request to October 9, 2002 to allow the Applicants to prepare a plan showing that the proposed units meet the lake and lotline setbacks of the Ordinance. Mr. banning stated that he now understands the situation and it appears that it is the resort owners fault for letting them onsite without approval from the County. A structure may be erected on a lot of less than the established minimum area and vidth, provided the lot existed by virtue of a recorded plat or deed before October 15, 1971, or a lot existing by virtue of a recorded plat or deed before October 15, 1971 has been increased in area by a conveyance subsequent to October 15, 1971, provided a Site Permit for the structure is obtained, all sanitary requirements are complied with and the proposed use is permitted within the district. However, effective February 5, 1992, if in a group of two or more contiguous lots under the same ownership, any individual lot does not meet the established minimum area or width, the lot may not be considered a separate parcel of land for the purposes of conveyance or development. The lot must be combined with one or more contiguous lots so they equal one or more parcels of land and each parcel must meet, or more closely approach, the established minimum lot size requirements of this Ordinance. B. The following structures are exempt from the Site Permit requirements providing all setback requirements of this Ordinance are met: 1. Satellite Dishes. 2. Vision Obstructing Fences. 3. Decks. 4. Retaining Walls {retaining walls may need a Conditional 5. Use Permit). V. ADHIHISTRATIOH 1. Site Permits: A. A Site Permit shall be obtained prior to erecting or installing a new structure or altering any structure or part thereof. A Site Permit shall also be obtained prior to moving a structure. 2. Administrative Officer: A. Where structures exist on the adjoilning lots on both sides of a proposed building site, water and road setbacks may he altered without ("string test"), provided zone or in' a a variance to conform to the adjoining setbacks the proposed building site is not located in a shore impact bluff Impact zone. 3. Variances From Standards: A. No variance may be granted for a prohibited use. 4. Shoreland Management By Townships: Townships may adopt shoreland management controls under authority of Minnesota Statutes, Section 462 if the controls are not inconsistent with or less restrictive than the controls adopted by Otter Tail County. A. Shoreland management controls adopted by townships will only be considered to be consistent with County controls if they cover the same full range of shoreland management provisions covered by the County controls, contain dimensional standards at least as restrictive as those in/ the County controls, and do not allow land uses in particular areas that are not allowed under the County's official controls. B. The township must demonstrate to the County Board that their proposed Ordinance and administration is at least as restrictive as the County's prior to final adoption by the township. Townships must provide for administration and enforcement of shoreland management controls at least as effective as County implementation. Townships that adopt adequate shoreland controls must follow all of the notification procedures in Subpart 7. After adequate shoreland management controls are adopted by a township, property owners must only obtain necessary permits and approvals as required in the township shoreland management controls. Effective February 1, 1991, prior to the Shoreland Management Office issuing the required permit, you will need to provide them with a complete plan review form from the Health Department. (Copy Enclosed). The addition of permanent rooms and screened porches to recreational vehicles is not consistent with the Otter Tail County Recreational Campground Ordinance, however this construction has been permitted by the Shoreland Management Office. This policy Interpretation error has resulted in recreational camping vehicles being altered to the extent that they no longer meet the definition of a recreational camping vehicle. (Copies Enclosed). The existing construction will be allowed to remain as is and will be evaluated by the County Health Department on an individual basis during routine inspections. This Department will work with the campground owners in an effort to bring these structures into compliance with current regulations. Such structures may need to be reclassified as a cabin instead of a recreational vehicle. The construction of permanent accessory structures on recreational camping sites will no longer be permitted.
