Planning Commission Recommendations
Conditional Use Permit - Randal L & Ina R. Gowin:
Land & Resource Director Bill Kalar stated that this is an after-the-fact Conditional Use Permit request for
earth moving. Motion by Froemming, second by Johnson, and unanimously carried to approve a
Conditional Use Permit for the revised plan dated July 8, 2015 as presented. The proposal is located in R
GL 8 & Lot 13 BIk 2 of Pleasure Park, Section 4 of Otter Tail Township: Otter Tail Lake (56-242), GD.
Conditional Use Permit - Julie & Stephen Weiand:
Motion by Johnson, second by Huebsch, and unanimously carried to deny the after-the-fact Conditional
Use Permit request of Julie & Stephen Weiand as recommended by the Planning Commission. The
motion includes the requirement for the Weiands to work with the Land & Resource Management office
regarding a restoration plan for the disturbed area. The project is located on Lot 2 BIk 1 Peterson Point,
Section 26 of Dunn Township; Franklin Lake (56-759), RD.
Linden Park Resort and Campground:
Mr. Kalar provided background information regarding a request for 6 new sites for Linden Park Resort and
Campgrounds subject to removal of a cabin on the lake frontage and 2 Recreational Camping Units. The
Planning Commission had previously recommended denial of the 6 new RCU sites recommending only 3
due to exceeding the current allowable density under the County’s Shoreland Management Ordinance
(SMO). The Board of Adjustment approved a variance for 6 new RCUs citing the Commercial Statewide
Standards for density as the rationale. Motion by Huebsch, second by Johnson, and unanimously carried
to approve a Conditional Use Permit for 6 new RCU sites as presented. The proposal is located in Hurch’s
First Addition to Linden Park Lots 6 & 7 BIk B & vac alley adj and pt of GL 1 & pt of GL 2, Section 26 of
Girard Township; East Battle (56-138), RD.
Aquatic Invasive Species fAIS) Funding
Motion by Huebsch, second by Rogness, and unanimously carried to authorize release of $30,000 from
the AIS Funds to the Otter Tail County Coalition of Lake Associations (COLA) for use in the prevention of
the spread of AIS in County lakes. The motion included the requirement for the COLA to document use of
the funds.
Standards Regarding Docks
Mr. Kalar submitted the Minnesota Department of Natural Resources (MNDNR) News Release dated
July 13, 2015. The news release identifies rules to keep in mind when installing lifts and docks.
Recess & Reconvene
At 11:51 a.m.. Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
for lunch break. The meeting was reconvened at 1:02 p.m.
Soil & Water Conservation Districts Program Updates
WOTSWCD Manager, Brad Mergens and EOTSWCD Manager, Darren Newville presented a document
titled “Buffer Legislation at a Glance” dated June, 2015. They briefed the Board regarding exemptions,
buffer protection maps, public waters covered by the legislation, compliance, administrative penalties, and
timelines. Discussion took place regarding the State timelines and Otter Tail County buffer initiative
timelines which are not the same. Mr. Newville reported that 22 projects have been completed through the
Shoreland Restoration program with several more scheduled this fall. Funding has been provided through
the Clean Water Grants and DNR for a new ag weather website, www.aqweathernetwork.com with eleven
radio stations currently participating. The Otter Tail River Watershed analysis is scheduled to begin in
CY2016.

Planning Commission Recommendations
Conditional Use Permit - Linden Park Resort & Campground/Sunrise Properties OT LLC:
Bill Kalar, Land & Resource Director, reviewed the recommendation of the Planning Commission to deny
an expansion of Linden Park Resort and Campground because the resort currently exceeds the maximum
density under the County’s Shoreland Management Ordinance. Ron Grams, Applicant, addressed the
Board and talked about the improvements that he has made to the resort, total acreage, wetland area that
is not counted in the density figures. State density figures, and the economics for small resorts. Discussion
followed regarding the Board’s intent to review the SMO this winter for changes as it relates to resorts.
Motion by Huebsch, second by Froemming, and unanimously carried to table the Conditional Use Permit
request of Linden Park Resort & Campground until June 2015. The Applicant waived the 60 day rule. The
proposal is located in Hurch’s First Addition to Linden Park Lots 6 & 7 BIk B & vac alley adj and pt of GL 1
& pt of GL 2, Section 26 of Girard Township; East Battle (56-138), RD.
Planning Commission Reappointment
Motion by Froemming, second by Rogness, and unanimously carried to reappoint David Trites to the Otter
Tail County Planning Commission representing District IV effective January 1, 2015 for a three year term.
County Recorder Software
Brian Armstrong, Land Services Director, submitted a handout with rationale to purchase windows based
software for the Recorder’s office from Fidlar Technologies. Mr. Armstrong reported that the software
would be compatible with software currently used in the Assessor and Auditor’s offices. He indicated that
he would like the software ready January 1, 2015 so the new Recorder would learn one system and be a
part of the process. Fidlar Technologies provides a credit card payment option so customers can purchase
a document electronically. Various fee schedules are provided by the vendor. Commissioners indicated
that they had received letters from various businesses concerned about increased fees they would be
paying for access to this new service which could be significantly higher than the current fees to access the
Landshark system. Tim Brand, IT Director, stated that the TriMin system currently used could be a
windows based system. Dave Mckay from TriMin confirmed that the current system could be windows
based and stated that thirty-five counties in Minnesota are using the system Otter Tail County is currently
using. Mr. Armstrong will meet with the Land Services Committee along with the new Recorder for further
discussion. After that meeting, Mr. Armstrong will put together a Committee of interested parties to discuss
the fee schedule and implementation process.
Recess & Reconvene
At 11:50 a.m.. Chairman Johnson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 11:59 a.m.
County Drainage Systems
County Ditch #44:
Kevin Fellbaum, Ditch Inspector, reported about the waters on Round Lake which are backing up into
cabins. County Ditch #44 is the outlet for Round Lake; however, the ditch is not functioning properly and
has not been maintained. Ditch #44 was established April 18, 1911, has $15.10 in the Maintenance Fund,
and some portions were cleaned out by property owners in 1982. Motion by Huebsch, second by
Lindquist, and unanimously carried to schedule a public meeting on Monday, January 26, 2015 at 7:00
p.m. at the Otter Tail Operations Center in Ottertail City. The motion included authority for the Ditch
Inspector to obtain estimates to clean out the ditch so this information is available for the public meeting.

Shoreland Management Ordinance Discussion: Bill Kalar indicated that the County Board
has expressed interest in addressing the Shoreland Management language this coming winter.
He indicated that topics for discussion should be forwarded to him or Marsha.

or bluff impact zones;
(b) remedial measures to correct erosion
sites and improve vegetative cover and screening of buildings
and other facilities as viewed from the water; and
(c) if existing dwelling units are located
in shore or bluff impact zones, conditions are attached to
approvals of conversions that preclude exterior expansions in
any dimension or substantial alterations,
also provide for future relocation of dwelling units, where
feasible, to other locations, meeting all setback and elevation
requirements when they are rebuilt or replaced.
(4) Existing dwelling unit or dwelling site
densities that exceed standards in this part may be allowed to
continue but must not be allowed to be increased, either at the
time of conversion or in the future,
during the conversion to limit impacts of high densities by
requiring seasonal use, improving vegetative screening,
centralizing shore recreation facilities, installing new sewage
treatment systems, or other means.

A. Density evaluation steps:
(1) Determine the average inside living area size
of dwelling units or sites within each tier, including both
existing and proposed units and sites. Computation of inside
living area sizes need not include decks, patios, stoops, steps,
garages, or porches and basements, unless they are habitable
space.
(2) Select the appropriate floor area ratio from

(3) Multiply the useable area within each tier by
the floor area ratio to yield total floor area for each tier
allowed to be used for dwelling units or sites.
(4) Divide the area computed in subitem (3) by
the average determined in subitem (1). This yields a base
number of dwelling units and sites for each tier.
(5) Determine whether the project is eligible for
any additional density increases. To be eligible, projects must
meet all of the design standards in item B, and exceed one or
more of them. The local unit of government may decide how much,
if any, increase in density to allow for each tier, but must not
exceed the maximum allowable density increases listed in the
following table;

(6) Allowable densities may be transferred from
any tier to any other tier further from the shoreland lake or
i^iver, but must not be transferred to any other tier closer.
B. The design criteria are:
(1) Open space. Commercial planned unit
developments must contain open space meeting all of the
following criteria:

(a) At least 50 percent of the total project
area must be preserved as open space.
(b) Dwelling units or sites, road
rights-of-way, or land covered by road surfaces, or parking
areas, except water-oriented accessory structures or facilities,
are developed areas and should not be included in the
computation of open space.
(c) Open space must include areas with
physical characteristics unsuitable for development in their
natural state, and areas containing significant historic sites
or unplatted cemeteries.
(d) All shore impact zones within comrriercial
planned unit developments must be included as open space, and at
least 50 percent of these areas must be preserved in their
natural or existing state.
(e) Open space may include outdoor
recreation facilities for use by guests staying in dwelling
units or sites, or the public.
(f) Open space may include subsurface sewage
treatment systems if use of the space is restricted to avoid
adverse impacts on the systems.
(2) Design of structures and facilities must be
done according to the following standards;
(a) Commercial planned unit developments
must be connected to publicly owned water supply and sewer
systems, if available. On-site water supply and sewage
treatment systems must be designed and installed to meet or
exceed applicable rules of the Minnesota Department of Health
and the Minnesota Pollution Control Agency. On-site sewage
treatment systems must be located on the most suitable areas of
the development, and sufficient lawn area free of limiting
factors must be provided for a replacement soil treatment system
for each sewage system.

Re: Sunrise Properties proposal to place additional units on their property
Dear Members of the Planning Commission:
Our cabin address on East Battle Lake is 23626 Castle Trail, Henning MN,
56551. Tve placed the 150 feet of lake shore property in a trust for my children.
I thought that the government owned the land behind our cabin and our
neighbors, and that the land was not for sale. Obviously, I was wrong. Recently
the Planning Commission made me aware that Sunrise Properties is requesting
permission to place additional mobile homes and campers on the property they
acquired between Castle Trail and the gravel road to the west.
I am concerned about the impact additional units proposed by Sunrise
Properties will have on the environment. The woods provide a wonderful
habitat for trees, wildlife and birds. It is beautiful the way it is. Please consider
this when you vote on Sunrise Properties proposed development. If they are
allowed to move forward with their proposal, I am confident that the Planning
Commission will make certain that they adhere to the setbacks and other rules
established by the Commission. Thank you.
