Conditional Use Permit-Ted Bellmore/Last Resort:
Motion by Lee, second by Mosher, to approve a Conditional Use Permit to re-open the bar
(including the 1995 Conditional Use Permit #5425 for the beer garden) at the Last Resort on Long
Lake (Sec. 11, Twp 134, R. 43, Elizabeth Township, Lake No. 56-784) with conditions as
recommended by the Planning Commission. Motion carried.
Conditional Use Permit - Robert W. Johnson:
Motion by Lee, second by Nelson, to approve a Conditional Use Permit to construct a driveway
near Rush and Lizzie Lakes (Sec. 4 & 5, Twp. 136, R. 42, Lida Township, Lake No. 56-760A) with
conditions as recommended by the Planning Commission. Motion carried.
Conditional Use Permit-Amor Township:
Motion by Froemming, second by Lee, to approve a Conditional Use Permit to remove and replace
an existing 12" corrugated metal pipe near Otter Tail Lake (Sec. 22, Twp. 134N, R. 40W, Amor
Township, Lake No. 56-242) as presented. Motion carried.
Conditional Use Permit - Chris Mickman:
Motion by Mosher, second by Lee, to approve a Conditional Use Permit for a cluster development
consisting of two dwellings and possibly a 3^'^ dwelling long-term on Long Lake (Sec. 2, Twp. 131,
R. 41, St. Olaf Township, Lake No. 56-390) with conditions as recommended by the Planning
Commission as well as the following clarifications: 1) The Applicant must follow the Shoreland
Management Ordinance regarding parking, and 2) Condition 4 of the Planning Commission
minutes dated June 21, 2000, should read “Any construction under this Conditional Use Permit
must be completed within 5 years. Motion carried.

A Conditional Use Permit Application to reopen the bar as a 3:2 & set-up establishment,
no change in seating. The property is described as E 540’ of GL 2 & NW% NE% S of Co
Rd 27, Section 11 of Elizabeth Township: Long Lake (56-784), RD.
Ted & Lenore Bellmore represented the Application.
Motion:

A Conditional Use Permit Application to construct a driveway - strip top soil, cut & fill
onsite subsoils as necessary to construct 16’ top width driveway, est. 8000 cu yds
material moving, replace topsoil on surfaces not receiving class 5 gravel, seed fertilize &
mulch all disturbed soils, erosion control measures utilized as needed. The property is
described as Lot 1 ex tr & Lot 2, 54.22 Ac in Section 5 and Lots 4 & 5 ex trs & Lots 6 & 7,
123.56 Ac in Section 4, Lida Township; Rush-Lizzie (56-760A), NE.
Mike Hough (contractor) represented the Application.
Motion: A motion by Estes, second by Bergerud to approve the construction of the
driveway provided it is no closer than 200’ to the OHWL, provided: 1. The Applicant
works with Land & Resource regarding the project and the wetland. 2. The Applicant
provides Land & Resource a stabilization plan for their approval. 3. The existing
easement (trail from Johnson’s farm to the Applicant’s lot) is not disturbed.
Voting: All members in favor.
Amor Township - Approved As Presented:
A Conditional Use Permit Application to remove and replace an existing 12” corrugated
metal pipe. The new pipe will be installed at the recorded (1991) elevations of the
existing pipe. The new pipe will be installed along a new alignment. Portions of the
existing pipe will be abandoned in place due to their proximity to large trees and existing
buildings. The work also includes placing granular bedding and metal aprons at the ends
of culverts beneath two approaches. Detailed plans are on file at Land & Resource
Management. The property is described as Eldorado Beach Road, Shirley Beach Pt Lot
18 & Lot 19 & Pt Lot B, Section 22 of Amor Township: Otter Tail Lake (56-242), GD.
Mike Holstrom (Township Chairman) and Pat Reisnour (engineer) represented the
Application.
Wallace Mielde spoke in favor of the Application.
Norman C. Nelson indicated that this problem needs addressing.

Resource Recovery Facility in Perham equal to their percentage of waste delivery. Lengthy discussion took
place. Mr. Hanan presented a draft letter to Land O’Lakes explaining that this is a critical time for the
Perham project and the county needs a definite decision regarding a commitment to purchase steam by the
end of June. Motion by Mosher, second by Nelson, to send the draft letter as presented by the Solid Waste
Director to Land O’ Lakes. Motion carried.
Solid Waste Hauler’s Application
Motion by Nelson, second by Lee, to approve the following solid waste hauler’s license application;

Last Resort Temporary CUP Request
Mr. Kalar reported that the County Attorney did some research regarding last week’s request from Last
Resort Owner, Ted Bellmore, to operate a bar and cabins on a temporary permit. At this point, Mr. Bellmore
has not applied for a Conditional Use Permit and the establishment has been closed for over one year. The
County Attorney researched the issue and found that under state statute, there is language that would
indicate that a temporary permit could be granted; however, Otter Tail County’s Shoreland Ordinance does
not allow a permit that has not been proposed to the Planning Commission. Motion by Lee, second by
Mosher, to deny a temporary Conditional Use Permit for the Last Resort because county ordinance
language does not allow for a temporary permit. Motion carried.

At 2:10 p.m., Vice-Chair Froemming declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 9:30 a.m. on Tuesday, June 6, 2000.

Motion by Lee, second by Mosher, to transfer $10,000 from the Highway Capital Improvement
Fund to the Highway Operating Fund for partial payment of the cold storage building. Motion
carried.
Approval of Agreement - Tank Removals
Motion by Lee, second by Froemming, to authorize the Chair’s signature to execute an agreement
between the Otter Tail County Highway Department and Widseth Smith Molting (WSN) for
engineering services related to the removal of six above-ground storage tanks at Vining, Perham,
Battle Lake, and Pelican Rapids at an estimated cost of $5,661 to $6,516. Motion carried.
Approval to Pay Bills
Motion by Nelson, second by Mosher, to approve payment of bills per Attachment A of these
minutes which include the following lodging payments:

Patrol Sergeants, Ross Gullickson & Steve Brandner
Detention Facility Team Leaders, Janice Aaberg,

Approval of Contract - Otter Trail Riders Trail Association
Motion by Nelson, second by Froemming, to authorize the Chair’s signature to execute a contract
between the County of Otter Tail and Otter Trail Riders Trail Association for maintenance of
snowmobile trails. The funding is from the state of Minnesota with Otter Tail County acting as the
fiscal agent. Motion carried.
Motion by Mosher, second by Froemming, to support Otter Trail Riders Trail Association in the
choice of funding they choose through the state of Minnesota relative to snowmobile trail
maintenance, whether performance based or stay with the current funding program. Motion
carried.
Underage Liquor Sales Fine
Motion by Lee, second by Nelson, to concur with the recommendation of the following fines
established by the County Attorney for underage sale of liquor:
first offense - $200
Motion carried.
second offense - $300 and education component
Request for Temporary Conditional Use Permit
Ted Bellmore, Last Resort Owner, requested a temporary Conditional Use Permit to operate a 3.2
and set-up establishment and rent three cabins for the summer season. Mr. Bellmore stated that
he was not aware that the previous owner had not renewed his Conditional Use Permit and the
earliest he could be scheduled with the Planning Commission was June 21®*. Lengthy discussion
followed. The County Attorney will research the ordinance language and County Board’s statutory
authority relative to this issue and report back to the board at the next scheduled meeting.
