I’m writing to you concerning the dwelling unit that needed to be relocated.
On December 11, 2002, I verified that the dwelling unit had been removed
from the basement and set on blocks on your driveway. Please notify our office
when the dwelling is relocated and when the basement walls and floor have been
removed.
The basement area will need to be filled in and the area stabilized.
If you have any questions on relocation or stabilization please contact our

COMPLAINT
The Complainant being duly sworn, makes complaint to the above-named Court and
states that here is probable cause to believe that the above-named Defendant committed the
offense described below. The Complainant states that the following facts establish PROBABLE
CAUSE;
Complainant, Kyle Westergard, is a duly acting and appointed Inspector for the Otter Tail County
Department of Land and Resource Management, who received information regarding the below-
described offense. On April 20, 1998, RICHARD WIELER, hereinafter referred to as the
defendant, applied for a Conditional Use Permit to construct a 24'x 28' dwelling within the
Shoreland Management Area of Pine Lake in Otter Tail County, and more particularly described
as Part of Government Lots 6 and 7, known as Lakeside Camp in Section 31 of Township 136,
Range 40, Otter Tail County, Minnesota. On May 20, 1998, the Otter Tail County Planning
Commission approved the request, and on July 21, 1998, a Site Permit #16027, was issued for the
24'x'28' sleeping quarters, which was to meet all natural environment setback requirements of the
Otter Tail County Shoreland Management Ordinance. On December 28, 1999, complainant
inspected the property and found that the distance of the structure from the lake was 141 feet for
the deck and 151 feet for the dwelling, in violation of the 200 foot setback from Pine Lake, a
natural environment lake. On December 29, 1999, Violation #1462 was sent to the defendant
advising him that the structure was built less than the 200 feet setback from the lake, and that he
needed to contact the Office of Land & Resource Management by January 6, 2000. On January
4, 2000, complainant received a call from the defendant. The defendant advised that he would
apply for a variance. On April 18, 2000, complainant reminded defendant that he needed to apply
for a variance, and defendant said that he was getting the packet ready. Complainant advised
defendant that he needed to submit the application by May 11, 2000. On May 17, 2000, the
defendant had failed to apply for a variance, and complainant referred the matter to the Otter Tail
County Attorney's Office. On May 22, 2000, the Otter Tail County Attorney's Office sent a letter
to defendant advising that he must bring his property into compliance by July 1, 2000, or a formal
criminal complaint would be filed. On June 29, 2000, complainant advised the County Attorney's
Office that the defendant had applied for a variance that would be heard on August 3 or 10, and to
hold off until the hearing date. On August 29, 2000, the County Attorney's Office was advised

that on August 3, 2000, the defendant's variance application was denied by the Otter Tail County
Board of Adjustment, and that defendant was given until October 31, 2000, to bring the structure
into compliance. On November 6, 2000, the Otter Tail County Attorney's Office was advised by
complainant that the defendant intended to apply for another variance. On December 14, 2000,
defendant applied for the variance, and on April 5, 2001, was heard and denied. He was given the
deadline of October 31, 2001, to comply. On October 30, 2001, defendant again applied for a
third time for a variance. On December 5, 2001, the defendant’s third variance application was
heard by the Board of Adjustment. The Board denied the request as follows: That there had been
no significant change since the prior request, that the Board would not have approved the request
had the request been made prior to the construction of the structure, that there were other possible
sites on the approximately 18 acre parcel meeting the required 200 foot setback, and that there
was no adequate hardship unique to the property to grant the variance. On January 10, 2001, the
County Attorney's Office again sent a letter to defendant advising that his property would now
need to be brought into compliance by February 15, 2002, or a formal criminal complaint would
be filed. As of March 13, 2002, complainant observed that defendant has failed to bring the
property into compliance.

On and between December 28, 1999 and March 13, 2002, within the County of Otter Tail, one
RICHARD WIELER, the defendant, erected or installed a structure in the Shoreland Area in a
location in violation of the 200 foot setback from the ordinary high water level mark of a natural
environment lake, specifically Pine Lake.
THEREFORE, Complainant requests that said Defendant, subject to bail or conditions of
release where applicable.
(1) be arrested or that other lawful steps be taken to obtain Defendants appearance in
court; or
(2) be detained, if already in custody, pending further proceedings; and that said
Defendant otherwise be dealt with according to law.

As you know, on May 22, 2000,1 sent a letter to you indicating that you must bring the
structures on your property into compliance by July 1, 2000. I was informed by Kyle Westergard
of the Office of Land & Resource Management on July 6, 2000, that you had applied for a
Variance, which was later denied on August 3, 2000, and the Board granted you until October
31, 2000, to bring the structures into compliance. I was also informed that on December 5, 2001,
the Otter Tail County Board of Adjustment again denied your Variance Application and was
advised by Mr. Westergard to proceed with a formal criminal complaint. Because this matter has
gone on for quite some time, please bring the property into compliance by February 15, 2002, or

The above-entitled matter has been referred to our office for consideration of criminal
prosecution for your failure to bring into compliance your deck and dwelling structures on your
property, located within the shoreland management area of Pine Lake in Otter Tail County. I
understand from Kyle Westergard of the Office of Land and Resource Management that he spoke
to you on January 4, 2000, concerning the two structures on your property and that they were in
violation of the 200 foot setback from the ordinary high water level mark. You indicated that
you would apply for a variance. I note that he again talked to you on March 16, 2000, and that
another variance application was sent. On April 18, 2000, he again spoke to you and you
indicated that you would be applying for a variance, and he instructed that you must submit the
variance application by May 11, 2000. Mr. Westergard has informed me that you have not
applied for a variance to date.
Therefore, unless you bring the structures on your property into compliance by July 1,2000, our

24’ X 28’ dwelling.
05-20-98 Planning Commission approved request of 04-20-98.
07-21-98 Site Permit #16027 issued for 24’ x 28’ sleeping quarters to meet all NE
setback requirements.
12-28-99 Expired Site Permit #16027 inspected and found distance to lake to be
only 141’for the deck-151’for the dwelling.

12-29-99 Sent Violation #1462 for structures (deck & dwelling) less than 200’ from
lake.
V,:01-04-00 Received call from Mr. Wieler regarding Violation #1462. Indicated he
would apply for Variance. Sent Variance Application form.
03-15-00 Visited lot again - re-measured, same results.
03-16-00 Received call from Mr. Wieler. Told him of my finding again. Sent another
Variance Application form.
04-18-00 Phoned Mr. Wieler to remind him about the need to apply for a Variance.
He indicated he was getting packet ready. I told him to have packet
submitted by the May 11, 2000 cutoff date.
05-17-00 To date he has not applied for a Variance.
