This permit is not assignable except with the written consent of the Commissioner of Natural Resources. The Area Hydrologist shall be notifted at least five days in advance of the commencement of the work authorized hereunder and shall be notified of its completion within five days thereafter. The Notice of Permit issued by the Commissioner shall be kept securely posted in a conspicuous place at the site of operations. No change shall be made, without written permission previously obtained from the Commissioner of Natural Resources, in the dimensions, capacity, or location of any items of work authorized hereunder. The Permittee shall grant access to the site at all reasonable times during and after construction to authorized representatives of the Commissioner of Natural Resources for inspection of the work authorized hereunder. This Permit may be terminated by the Commissioner of Natural Resources at any time he/she deems it necessary for the conservation of water resources of the state, or in the interest of public health and welfare, or for violation of any of the provisions of this permit, unless otherwise provided in the Special Provisions. Construction work authorized under this permit shall be completed on or before the date specified above. Upon written request to the Commissioner by the Permittee, stating the reason therefore, an extension of time may be obtained. The excavation of soil authorized herein shall not be construed to include the removal of organic matter (as indicated above) unless the area from which such organic matter is removed, is impervious, or is sealed by the application of bentonite after excavation. In all cases where the doing by the Permittee of anything authorized by this permit shall involve the taking, using, or damaging of any property rights or interests of any other person or persons, or of any publicly owned lands or improvements thereon or interests therein, the Permittee, before proceeding therewith, shall obtain the written consent of all persons, agencies, or authorities concerned, and shall acquire all property, rights, and interests necessary therefore. This permit is permissive only. No liability shall be imposed by the State of Minnesota or any of its officers, agents, or employees, officially or personally, on account of the granting hereof, or on account of any damage to any person or property resulting from any act or omission of the Permittee or any of its agents, employees, or contractors relating to any matter hereunder. (over please) any damage or injury resulting from any such act or omission, or as estopping or limiting any legal claim or right of action of the state against the Permittee, its agents, employees, or contractors for violation of or failure to comply with the permit or applicable provisions of law. No material excavated by authority of this permit nor material from any other source, except as specified herein, shall be placed on any portion of the bed of said waters which lies below (as indicated above). Any extension of the surface of said waters resulting from work authorized by this permit shall become protected waters and left open and unobstructed for use by the public. This permit does not obviate any requirement for federal assent from the U.S. Army Corps of Engineers, 1421 U.S. Post Office and Custom House, St. Paul, Minnesota 55101-9808. 11. 12. 13. ADDITIONAL SPECIAL PROVISIONS FOR RIPRAP The permittee shall comply with all rules, regulations, requirements, or standards of the Minnesota Pollution Control Agency and other applicable federal, state, or local agencies. Permittee shall ensure that the contractor has received and thoroughly understands all conditions of this permit. Notify LGU if work is above OHW. The permittee shall contact the responsible local government unit official if any grading or filling is to be done above (landward) the ordinary high water mark. End sections. At each end of the stabilized shoreline, the finished slope of the riprap shall be varied in a fashion to produce a smooth transition with the natural shoreline. Erosion control. Erosion control measures shall be adequately designed for site characteristics. All exposed soil shall be restored by seeding and mulching or sodding and staking within 72 hours of completion of project. Any sediment control fence next to the water body shall parallel to the contours. In the event the site can not be stabilized with vegetation before September 15, all exposed soil shall be adequately mulched at a rate of not less than 3500 Ibs/acre leaving no more than 20 percent visible soil surface and maintained until seeding/sodding can be achieved. WCA. Where the work authorized by this permit involves the draining, filling, or burning of wetlands not subject to DNR jurisdiction, the permittee shall not initiate any work under this permit until the permittee has obtained official approval from the responsible governmental units as required by the Minnesota Wetlands Conservation Act of 1991. State agencies must comply with the provisions of Executive Order 91-3. Maintenance. Future maintenance of this project shall not exceed the dimensions herein authorized and can only be completed one time. Prior to commencing any maintenance work, permittee shall advise the Department of Natural Resources of the type of materials, equipment, and procedures to be used. Maintenance work shall not be commenced until permittee's receipt of the Department's approval. Sediment control during construction. If granular material is used as a filter blanket, an inwater sediment barrier shall be installed around the area of excavation/sand placement during the project to Umit turbidity to the affected area. This barrier may involve use of a floatation sediment curtain or a filter fabric material attached to stakes or a snow fence anchored to the lake bed. The barrier shall be removed upon completion of the work after sediment is settled. Spoil disposal on upland. All material excavated shall be spread on upland (non-wetland) areas and above the Ordinary High Water Mark and seeded or sodded to protect from erosion. The Commissioner of Natural Resources may order removal of the rock for non-compliance or if it constitutes a navigational hazard. After a wet, cold morning the siin came out and it turned out to be a beautiful afternoon, with eveiyone enjoying it. The members had a short business meeting at Roy Baiers about 2:30 PM. We discussed at that time things that have to be done. As most of you know, Fred Elain our president, passed away in May. I was appointed to take his place, as president. Fred probably had more to do with my sobriety than anyone else. He always had time when someone was having trouble. He also devotod many hours on this project. I am going to need the help of each of you to try and fill his shoes and get the job done and we will get it done. VJo have our Federal Tax number now. All donations from private Individuals, corp­ orations, foundations etc., will be tax deductible for them. We id.ll be sending letters -to the people that have shown an interest and have asked for our tax number, -f you should need a copy of the tax number or letter, let me know and I will send i.t to you, '.i have only ^6,500 left to pay on our mortgage and we have about $15,000 worth of ,1 aix-ho-^e. Let us try and get one or more new members each of us, so that we-.conA.:.'nuidate this mortgage- If you have someone that may want to put in $10.00 - .$20-00 • or m.aybe $50,00 at a time, you might encourage them to add to this as, in no time at all they would have invested $100,00 and then receive a certificate , ________ Wo also extend an invitation to our A.A. members to feel free to use thses grounds for camping or picnics. Some are doing this now and enjoying it very much. I hope next year we can have an electrical hook up and a light on the grounds. Ve have been faced with the crises of raising money since the beginning of the project, however# more people have taken an Interest and the load is gating lighter.
