Arthur Ackerson, Dalton, MN, requested permission to take three
parcels of three acres total, and create two equal sized parcels
meeting an RD lake requirement, in Lot 1, Section 28, Lot 1, Section
29 and Lot 4, Section 20, Tumuli Township on Ten Mile Lake. Appearing
was Omer Germundson. After consideration, motion was made by David
Trites, seconded by Craig Anderson and unanimously carried, to deny,
no adequate hardship shown for allowing a complex metes and bounds
description, prefering the platting procedures be followed to be
consistent with past procedures.
Robert S. & Margaret A. Turner, Fargo, ND, requested permission to
replace an existing 12' x 55' mobile home with a 14' x 60' mobile
home at same location on Lot 1, Block 2, Sunset Beach Add'n, Dunn
Township on Lake Lizzie. After consideration, motion was made by
Craig Anderson, seconded by David Trites and unanimously carried, to
approve, no closer to lake than existing location, hardship being
a substandard lot of record.

William C. Roubik, West Saint Paul, MN, requested permission to
construct addition to side of existing building, 35' from water line
on Pt. of G.L. 2, Section 26, Tumuli Township on Clear Lake. After
consideration motion was made by Dan Oehler, seconded by John Everts
and unanimously carried, to approve at no closer to lake than existing
building, hardship being the terrain of the lot.
Herbert Johnson, Pelican Rapids, MN, requested a 13' (plus) variance
per unit, allowing a total of 42 units on existing Johnson Resort in G.L. 6, Section 28, Dunn Township, on Lake Lizzie. After con
sideration, motion was made by David Trites, seconded by Craig Ander
son and unanimously carried, to approve variance, old building to be
moved back or removed, hardship being a reasonable plan, adequate
land area, with a shortage of water frontage.
Grace Edlund, Moorhead, MN, represented by Elois R. Vikander, requested permission to allow a shed to remain as located on Wij Lot 8,
Segar Beach, Everts Township on Otter Tail Lake. Merle Severson
appeared and spoke on behalf of the applicant. After consideration,
motion was made by Craig Anderson, seconded by Carl Johnson and car
ried with John Everts abstaining, to grant the 8' variance requested,
hardship being a substandard lot, with said construction being an
upgrading of the property replacing building on same location.
Brian Johnson, Clarissa, MN, requested permission to build a 10' x 18'
beach house by the lake, into the bank about 50' from lake, on Lot
3 Sunset Beach, 1st Add'n, Girard Township, on West Battle Lake.
Motion was made by Craig Anderson to approve, hardship being unable
to observe his equipment because of the terrain. The motion was
seconded by Carl Johnson. Motion was made by Dave Trites to table
to allow members of the Board to view, and to have shoreland manage
ment measure distance from the highwater mark for compliance. The
motion was seconded by Dan Oehler and carried with John Everts voting
"no."

spoke. After consideration, motion was made by John Everts, seconded by Dan Oehler and unanimously carried, to table until Gruenberg can
appear.

Dear Mr. Walters:
HERB JOHNSON, LAKE LIZZIE SHORELAND MANAGEMENT
After review of the above permit application, it is apparent that
the two intermittent watercourses on Mr. Johnson's property do not
qualify under your shoreland management ordinance nor under
statewide regulations as public waters. The drainage area of these
two watercourses has been determined to be less than one-half square
mile, instead of the two square miles required. This means these
two small drainages should not be used to calculate water frontage
for Mr. Johnston's proposal.
Based on this finding, this office must recommend a maximum of 31
units to comply with the intent of your ordinance and the statewide
regulations. This number (31) must be recommended instead of the 35
living units (30 campsites, 1 house and 4 rental cabins) since it is
my understanding he will tear the cabins down. As you know,
grandfather rights are nonexistent when structures are destroyed.
