Detroit Lakes, MN 56501 RE: Lakes Five and Six Recreational Development Dear Mr. Kahdahl: It appears that the proposed Lakes Five and Six Recreational Development meets the Environmental Quality Board's (EQB) Rule 6 MCAR 3.024 Bid, which requires the preparation of an Environmental Assessment Worksheet (EAW). We understand that your complex contains thirty-six cottages, a dining hall, recreational hall, central lodge, golf course, swimming pools and tennis courts. Under 6 MCAR 3.024 Bid, any construction of a commercial or industrial development (any part of which is within a shore!and area) covering 20,000 or more square feet of ground space, not including access roads, and located in a parcel of land having 1,500 feet or more of shoreline frontage requires the preparation of the EAW. The EAW is the preliminary environmental document in the Environmental Review process. It is prepared by the Responsible Agency, in this case Otter Tail County. Copies of the completed EAW on the above project should be distributed in accordance with the enclosed list. An affadavit of mailing should be attached to the copy of the EAW that is sent to Mary Sullivan, EQB Administrator. Upon receipt of the EAW and affadavit of mailing by Ms. Sullivan, the conclusions of the Responsible Agency, that is a Negative Declaration or Environmental Impact Statement (EIS) preparation notice, will be published in the EQB Monitor. This usually takes 1-1-1/2 weeks. Following publication, there is a 30-day review period of the decision. If no objections to the decision are made, the decision stands. If objections are filed, the EQB will review the matter and determine whether or not an EIS is required. Under Minn. Rule MCAR 3.024 B1, the Responsible Agency must prepare the EAW; however, the project proposer may submit a draft EAW to the Responsible Agency. The agency has 30 days to review it, adding or changing any infor­ mation needed to make the document its own, and determine an EIS is needed.
