The property is described as Lot 11, Sanda’s Beach First Addition, East Battle Lake in Girard Township. The audience was polled with no one speaking for or against the request. A letter ,v, from Dennis Schill in favor of the applicant’s request was read for the record. After discussion Si . and consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried to approve the variance as requested. Hardship is a substandard lot of record. It was noted that the soil condition of the applicant’s property provides for a very slow prec test and that the neighbor has the same type of situation. The applicant’s request was consider a reasonable request. . i Norm W. Umland - Approved Norm W. Umland, Henning, MN, requested a variance of 6’ from the required lot line setback of 10’for the location of a holding tank 4’from the lot line. The property is described as part of Reserve Block A and Lot 2, Block 2, Leaf Lake Pleasure Grounds, West Leaf Lake in Leaf Lake Township. The audience was polled with no one speaking for or against the request. , After . discussion and consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of 6’ from the required lot line setback of ’l0’ for the location of a holding tank 4’.from the lot line. Hardship is a substandard lot of record. It was noted that the placement of the holding tank in this location is a suitable site on this lot and the placement of the holding tank in this location meets the setback requirement from all three affected wells. V John Kimple - Tabled John Kimple, Dent, MN, requested a variance of 160’ from the required ordinary high; water level setback of 200’ and a variance of 60’ from the required shore impact zone setback of 100’ for ■ the addition of a deck to an existing cabin 40’ from the ordinary high water level. The deck will be 40’ frbm-the lake. The property is described as a 7.8-acre tract in Government Lot 4, Section 8 of Dead Lake Township by Dead Lake. The audience was polled with no one speaking for or against the request. The applicant was not in attendance at the public hearing. After discussion and consideration, motion was madCby Randall Mann, seconded by Cecil Femling and unanimously carried, to table the applicant’s request until the October 2, 1997 meeting.' It was noted that a discussion on-site seemed to indicate a desire on behalf of the applicant to withdraw his application. As of the date of the scheduled hearing.no formal communication to withdraw had been received by the office. The variance request was tabled to allow the office an opportunity to contact the applicant and to determine the status of this application: Jerry Enderson - Denied Jerry Enderson, Fergus Falls, MN, requested the following: “The livestock holding pens were constructed in the same place as the one taken out. The chute was constructed within 10’ of the old one. I was told this falls within the set back adjacent to the County right of way. I am^ asking ,for a variance in order to load and unload our livestock.” Per the applicant’s map the loading dock is 9.5’ from the road right-of-way. The closest one would be 66’ from the lake. The property is described as Lots 4 through 8, Borup’s Maple Beach, Dead Lake in Dead Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made Craig Anderson, seconded by Robert Schwartz and unanimously carried, to approve a variance from the required ordinary high water level setback of 150’ for the installation of three sewer systems less than 150’ from the ordinary high water level. Hardship is the unique terrain features of the applicant’s property. John Kimple - Denied John Kimple, Dent, MN, requested a variance of 160’ from the required ordinary high water level setback of 200’ and a variance of 60’ from the required shore impact zone setback of 100’ for the addition of a deck to an existing cabin 40’ form the ordinary high water level. The deck will be 40’ from the lake. The property is described as a 7.8-acre tract in Government Lot 4, Section 8 of Dead Lake Township by Dead Lake. Ralph Harthun represented the applicant at the public hearing. The audience was not polled, as there was no one in attendance at the time of the public hearing. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. Vincent Hohenstein - Tabled Vincent Hohenstein, Dent, MN, requested a variance to subdivide a 3.23-acre parcel into two lots. The property is described as a 3.23-acre parcel in Government Lots 2 and 3, Section 34 of Star Lake Township by Dead Lake. Prior to the scheduled public hearing the applicant had submitted a letter requesting that consideration of his application be tabled until he has had an opportunity to meet with township officials. After consideration, motion was made by John Everts, seconded by Randall Mann and unanimously carried, to table the applicant’s request until the October 9, 1997 meeting. Additional Discussion: William and Marion Krueger and Stanley and Joyce Koenig - Wally Senyk, County Attorney, discussed with the board that portion of a previously approved motion that required a township to apply for a variance to place a septic tank within the road right-of-way. It was the general consent of the Board of Adjustment that the submission of a variance application would be sufficient and no formal hearing process would be necessary. David and Judy Pederson - A variance for the placement of a 28’ by 60’ dwelling approximately 63’ from the ordinary high water level had been previously approved on September 5, 1996. The applicants are now requesting a dwelling with a different overall size. After discussion and consideration, motion was made by Randall Mann, seconded by John Everts and unanimously carried to allow a change in the size of the proposed dwelling with the condition that all other requirements of the previously approved variance must be followed.
