It was noted that the heavy tree line and vegetation between the proposed structure and the lake serves both to screen from the lake the view of this structure and as a filter area for the bluff. Hardship is the unique location of the property with lakeshore on two sides. . Minnesota June 4, 1998 Page 4 Robert and Marilyn Burwell - Withdrawn Robert and Marilyn Bun/vell, Anoka, MN, requested a variance “to allow construction of a gazebo on an existing deck off a RV trailer. The gazebo could be my water - oriented accessory structure with a side ■ lot variance to allow the gazebo inside the 65’ side lot setback to approximately 20’ or variance could be to place gazebo approximately 12’ inside 100’ setback from lake. The property is described as a 3- acre tract in Government Lot 1, Section 5 of Girard Township by Ethel Lake. The audience was polled with no bneispeaking for or against the request. After consideration, motion was made by John Eyerts, seconded by Cecil Femling to approve a building setback no closer to the ordinary high water level than the setback granted in the site permit dated June 4, 1980. After additional discussion, the above : motion was withdrawn and a motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and adequate area does exist for the placement of the proposed structure in an area not requiring a variance. After additional discussion and consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to rescind the previously passed motion based on a . statement made to the applicants, by the office, that an ordinary high water level variance had been previously granted and to allow the applicants to withdraw their request based on this misunderstanding. It should be noted that an 80’ ordinary high water level setback had been granted as the best possible location in a building permit issue June 4, 1980, but no variance had been previously granted by the Board of Adjustment. Thomas Vertin - Approved Thomas Vertin, Breckenridge, MN, requested “a variance from the standard 75’ setback for the construction of an addition on to an existing cabin. Proposed addition would be built no closer to the lake than the existing structure. Due to site drainage, the location of the proposed addition is somewhat limited to the East Side of the cabin. Owner also request a variance to enclose an existing deck area currently located above an original boathouse structure with a screened porch.” From the^ drawing submitted it appears that the addition will be approximately 20’ by 30’ and the addition appears to be approximately 50’ from the ordinary high water level at its closest point. The existing deck area appears to be approximately 15’ from the ordinary high water level at its closest point. The property is described as the East 75’ of the West 344’ of the North 229’ of Government Lot 1, Section 4 of Everts Township by Otter Tail Lake. Anthony J. The property is described as a 20-acre tract in Government Lot 5, Section 17 of Leaf Mountain Township by Lake Spitzer. The audience was polled with no one speaking for or against the request. Gonyea, Minneapolis, MN, requested a variance of 41.5’ from the required ordinary high water level setback of 200’ for a 14’ by 38’ addition 158.5’ from the ordinary high water level. The property is described as Government Lots 3, 4, and 5 and the East of the Southwest %, Section 18 of Dead Lake Township by Dead Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by Linda Bergerud and unanimously carried, to approve an addition to the existing structure being no closer to the ordinary high water level than the existing structure. It was noted that the granting of the variance as requested would establish precedence. Mary Field - Approved Mary Field, Bai Harbour, FL, request approval of a proposed subdivision and a proposed water- oriented accessory structure described as follows: The property is currently composed of 20 substandard lots that the property owner would like to combine into 2 approximately equal buildable parcels. Each proposed lot would have in excess of 55,000 square feet of area (approximately 40,000 square feet oh the west side of the road and approximately 15,000 square feet on the east side of the road) and approximately 106’ of lake frontage. The, lake frontage is on Otter Tail Lake as none of the 20 substandard lots have lake access to Round Lake. The applicant’s property is located in an area between Otter Tail Lake and Round Lake. Round Lake is classified as a recreational development lake and Otter Tail Lake is classified as a general development lake. The property owner is requesting that the proposed subdivision be viewed in consideration of the lot size requirements that are applicable to a general development lake. The property owner is proposing a building site, for each proposed lot, on the 40,000 square feet, of each lot located on the west side of the county road and is proposing the location of a shared 200 square foot water - oriented accessory structure on the property located on the east side of the county road. The water - oriented accessory structure would be placed over the common lot line between the two proposed lots. The property is described as Lot J, Block 1, Lots J, K and L, Block 2, Lots J, K and L, Block 3, of the Rearrangement in Reserves 1-2-3 of Bonita Beach, part of Lot 1 and all of Lots 2, 3, 4, 5, 6, 14, 15, 16, and 17 Block 4, Bonita Beach, Lot 1, Round Lake Beach .and;a tract called Sand Beach Park, Otter Tail and Round Lakes of Everts Township. George M. Schuler and Jay Schuler represented the applicant at the public hearing. A letter from Gilbert and Pat Garza opposing the applicant’s request for a water - oriented accessory structure on the lakeside of the two proposed lots was read for the record. The audience was polled with Robert Berrey addressing concerns with that portion of the applicant’s request for a water - oriented accessory structure on the property located east of the county road as its development is restricted by covenants affecting a number of the properties east of the road in this area. Richard and Dorothy Ness speaking for . themselves, as well as, for Tom Lincoln also expressed the same concerns as shared by Robert Berrey. Kathryn Mueller, Boll Realty, stated that neither she nor the proposed purchasers were aware of these covenants, but that she would contact Mary Field’s attorney for clarification.
