Replacement of the structure on Site 15 of Hovey’s on Star resort. The present size of this site is 35 ft wide x 95 ft long north to south. As highlighted in yellow on the attached drawing. The structure on site # 15 was a 12 ft x 50 ft mobile home. That mobile home was remove from the resort this last season. The new structure on site #15 will possibly be a park model pull behind as described in web site parkmodels.com. Not to exceed the dimension of the previous mobile home. Depending on a new clients requirements. This structure wilt also be north and south. The distance from the lake to this structure will not change. Continue to be 90 ft. A park model RV (PMRV) is a unique trailer-type RV that is designed to provide temporary accommodation for recreation, camping or seasonal use. PMRVs (also sometimes referred to as recreational park trailers) are built on a single chassis, mounted on wheels and have a gross trailer area not exceeding 400 square feet in the set -up mode. They are certified by their manufacturers as complying with the ANSI A119.5 standard for recreational park trailers.I I I flHBI BIIIID It. 4 -ciI1 PMRVs are most often used in recreational vehicle campgrounds. They may be owned by the campground and rented to guests or they may be brought In and used exclusively by their owners on a site rented or leased from the campground. They can also be placed by their owners on private property. These units are designed and built to be used for recreational/camping purposes only. They are not meant to be affixed to the property In any way, they do not improve property values in any way, and they are neither designed nor intended by their manufacturers to be used as permanent residences. Park model RVs are titled as motor vehicles by the various states just like other RV types. I 4■1 What makes PMRVs unique is that they are up to 12 feet in width and 36 feet long with a peaked and shingled or metal roof Some offer gabled windows, and siding choices of cedar, aluminum, vinyl, masonite or even split logs for a rustic look, while others are made of full solid logs. They are often designed with built-in porches, decks and/or storage areas. Many look like tiny summer cottages. Others look more like traditional but slightly longer RV travel trailers. iI Most park model RV owners (67%) locate their unit within several hours of drive time from their primary residences and use them for weekend camping get-aways. Some owners may place their PMRV in a warm climate location and use them as a seasonal/temporary get-away to escape the cold gray winter weather, while others place their PMRVs in cooler climate locations to escape the summer heat and humidity back home. The Recreation Vehicle Industry Association (RVIA) operates a safety standards and inspection program that requires member manufacturers of all recreation vehicles, including park model RVs, to affix a RVIA standards program seal to every unit they build In their factories. This seal indicates the manufacturer's certification that the unit complies with the requirements of the applicable standards. A park model RV can always be identified by the blue and gold RVIA ANSI A119.5 certification seal (or its predecessor green RPTIA seal) affixed to the right of main door of the unit. : What a Park Mode! RV is Not Although the distinctive appearance of park model RVs may sometimes lead people to think they look like small manufactured homes, appearances can be deceiving. PMRVs are actually titled and registered Just like any other RV. Due to their design, small size and use as recreation, vacation and seasonal units, PMRVs are explicitly excluded from being considered or used as a manufactured home under the codes and regulations of the U.S. Department of Housing and Urban Development (HUD) specifically because they are a type of recreation vehicle (Title 24 § 3282.8(g)). i s, Park model RVs are built in accordance with the national safety standards set forth under a nationally recognized standard, the American National Standards Institute (ANSI) A119.5 Standard, not the HUD requirements that manufactured homes are mandated to comply with. The key distinction is that manufactured homes are single­ family dwellings that are designed and built for permanent residency under standards set by the Department of Housing and Urban Development. Park models RVs, as noted, are designed and built to be used by families as a recreational, camping, or seasonal accommodation. PMRVs are not intended for, nor should they be used for, anything other than recreational camping or seasonal use. They are not permanent residences and should never be used as such. Ij I;;; I :Like RV motor homes, travel trailers and fifth-wheel trailers, park model RVs are built to ensure safety but are not required to meet the building codes or installation codes that stick-built or manufactured homes are required to meet. They are designed to remain on their axles and wheels, ready for movement and are not connected to the ground by footers, foundations, or columns (some local units of government do require them to be anchored to the ground due to excessive local winds, but even then they can easily be detached in minutes with only hand tools). :PMRVs are not housing. There Is no practical difference in the use of PMRVs than travel trailers or fifth-wheel trailers. They are not 'improvements'to campgrounds any more than a travel trailer placed and used in a campground is. At that time, I indicated that our Office has no objection to your plan of replacing an existing 10’ x 50’ manufactured home (MH) with an 8’ x 38’ park model recreational camping unit (RCU). As we discussed, the reason(s) for this approval include a reduced footprint (even with the 2 slide-outs) and the fact that: 10’ x 50’ MHs are no longer made. As we also discussed, this approval is contingent upon approval from the' MN Department of Health (license), meeting all setback requirements (including 10’ between structures), and your acknowledgement that you are giving up a MH site and replacing it with an RCU site. The front 4 feet is rotten due to water/ice damage and the shingles are over 35 years old. Dimensions of repairs would be of same size and pitch and would consist of durable roofing material. The shed had been damaged over the past weekend by storms and high winds (roof and one side). Mr. Davison was told by the resort owners to come and discuss what would be required to repair the roof. 1 pulled the resort files and found a scaled layout of the property. 1 made a copy of it and asked him to show me where his mobile home unit was located and the location of the shed (see attached). I asked him what type of repairs would need to be made. He explained that the shed was old and the roof has been slowly rotting as well as one side of the structure. He wants to completely replace the roof and at least one wall and change the angle of the roof to slope it away from the mobile home. When asked he stated that the size of the shed was maybe 4’ x 8’. 1 told him that it sounded as though this would be a replacement shed rather than a repair of the old one. I explained that 1 thought a Site Permit would be required, and that it would have to be obtained by the resort owners, however I needed to confirm this with Administrator, Bill Kalar. I obtained Mr. Davison’s phone number and told him 1 would call later in the day as Mr. Kalar was out of the office at the time. E ; After Mr. Davison left the office 1 found a document in the file dated 01/17/03 prepared by Mark Ronning. The document dealt with the mobile home sites at this resort and had his documentation of what existed at each site. 1 found his notes on the Davison site (Unit #13). According to Mark’s records the shed on the site is an 8’ X 10’ - not a 4’ x 8’. I i Upon his return to the office I discussed the situation with Bill Kalar. Bill confirmed that a Site Permit would be required and that the Hovey’s would have to make application. He stated further that before any permit is issued he wants Mark Ronning to obtain photographic documentation of the existing shed - but not until the application materials had been received by our office. We also discussed that the Hovey’s will need to provide a scaled drawing of the resort as well as showing the location of the shed at Unit #13. They will also need to provide a current calculation of the Impervious Cover in order for our office to process a Site Permit. : ■;!I contact Mr. Davison and explained the determination. He will inform the Hovey’s about the application process. 1 told him they could contact our office and request the application materials or they could come in person to apply. 1 went on to tell him that the existing shed would have to remain as it is for now until our inspector had been on site and taken photographic documentation prior to issuing a Site Permit. Effective February 1, 1991, prior to the Shoreland Management Office issuing the required permit, you will need to provide them with a complete plan review form from the Health Department. (Copy Enclosed). The addition of permanent rooms and screened porches to recreational vehicles is not consistent with the Otter Tail County Recreational Campground Ordinance, however this construction has been permitted by the Shoreland Management Office. This policy interpretation error has resulted in recreational camping vehicles being altered to the extent that they no longer meet the definition of a recreational camping vehicle. (Copies Enclosed). The existing construction will be allowed to remain as is and will be evaluated by the County Health Department on an individual basis during routine inspections. This Department will work with the campground owners in an effort to bring these structures into compliance with current regulations. Previous Order No. 13095 has been revoked. Page 2 Hwy 33 Rules and Regulations for Utilities on Trunk Highways under Chapter 500 Laws of 1959 Utility shall take all necessary and reasonable safety measures to protect the traveling public and shall cooperate fully with the State Highway Patrol to that end. The Utility in such an event will request a Work Permit from the office of the Assistant Dis­ trict Engineer, Maintenance, not later than the sec­ ond working day thereafter when a Work Permit would ordinarily have been required but for the emergency. (a) Purpose. The purpose of Minn. Reg. Hwy. 33 is to carry out the mandate of the legislature and to effectuate that mandate as set forth in the Laws of Minnesota 1959, Chapter 500, Article II, Section 45 with reference to the placing, constructing, recon­ structing and maintaining of utilities across, along, upon or under the right of way of trunk highways.(10) If at any time the State of Minnesota, acting through its Commissioner of Highways, shall deem it necessary to make any improvements or changes on all or any part of the right of way of the trunk highway which affect a utility located on trunk highway right of way, then and in such event, the owner of the utility shall within 15 days after written notice from the Commissioner of Highways or his authorized agent, proceed to alter, change, vacate or remove said utility from the trunk highway right of way so as to conform to said trunk high­ way changes and as directed by the Commissioner of Highways. Such work shall be done without any cost whatsoever to the State of Minnesota except as other­ wise provided by law or agreement and shall be completed within the date specified in said written notice, which date shall be reasonable under the cir­ cumstances. The Utility shall assume all liability and save the State of Minnesota harmless from any and all claims of damage of any nature whatsoever oc­ casioned by reason of not having removed said utility within the time specified in said notice. Notwith­ standing the provisions of this Section, the State may reimburse a municipality for the cost of the first re­ location of a municipally owned utility located within the limits of a municipal street at the time that the street was taken over by the State as a trunk high­ way, when such relocation is required by construc­ tion or reconstruction of the trunk highway. (b) Scope. The scope of Minn. Reg. Hwy. 33 is confined within the framework of and consistent with the Laws of Minnesota 1959, Chapter 500, Article II, Section 45. (c) Definitions (1) Utility. Under this order “utility” shall mean and include all privately, publicly or co-operatively owned communication lines and facilities, any sys­ tems, lines and facilities for the distribution and transmission of electrical energy, oil, gas, water, sewer, steam and other pipe lines, railways, ditches, flumes or other structures which under the laws of this State or the ordinance of any village or city may be constructed, placed or maintained across, along or on trunk highway right of way. Dependent upon the meaning intended in the context, “Utility” shall also mean the utility company, inclusive of any wholly owned subsidiary. (2) Interstate highways. Under this order “inter­ state highways” shall mean all trunk highways which are a part of the Interstate System. (3) Non-interstate highways. Under this order “non-interstate highways” shall mean all trunk high­ ways which are not a part of the Interstate System. (4) Trunk highways. Under this order “trunk highways” shall mean all trunk highways including those which are a part of the Interstate System. (II) Except for the negligent acts of the State, its agents and employees, the Utility shall assume all liability for, and save the State, its agents and employees, harmless from, any and all claims for damages, actions or causes of action arising out of the work to be done herein and the continuing uses by the Utility, including but not limited to the plac­ ing, constructing, reconstructing, maintaining and using of said utility under this application and Per­ mit for construction. (d) General (1) Except as otherwise permitted, utility con­ struction and relocation on trunk highway right of way shall not be commenced until an application for a Permit for construction has been made and such Permit granted. The Permit for construction sketch shall show the location of the proposed utility with reference to pertinent features such as the right of way lines, curb lines, trunk highway center line, etc. A copy of the sketch shall be provided for each copy of such Permit. Prints of trunk highway right of way maps are available upon request from the Utili­ ties Engineer of Right of Way Operations, Depart­ ment of Highways, at the State Highway Building, St. Paul, Minnesota 55101. (12) The Commissioner of Highways may re­ quire the Utility, or its contractor, to furnish a deposit in the form of a certified check, a surety bond or corporate undertaking, in favor of the State of Minnesota, Commissioner of Highways, for any expense incurred by the State in the repairing of damage to any portion of the trunk highway right of way caused by work performed under a Work Permit of a Permit for construction, including any out of the ordinary engineering supervision and in­ spection expense provided by the State. In those instances wherein a deposit is required, the amount of the deposit shall be specified in the Special Provi­ sions of the Permit. If a check is furnished, any monies rerriaining over and above such expense shall be returned to the applicant. (2) Burning or disking operations and/or the :.*se of chemicals to control or kill trees, brush and other vegetation is prohibited without prior approval from the Assistant District Engineer, Maintenance. (3) All waterways and lines of drainage shall re­ main operative. (4) Wherever topsoil and sod are disturbed they shall be replaced and maintained satisfactorily until the turf is established.(13) The Work Permit or Permit for construc­ tion as issued does not in any way imply an ease­ ment on private property.(5) The utility facility and installation shall not interfere with any existing utility facilities on the trunk highway right of way.(14) The installations shall be made in conform­ ity with all applicable laws, regulations and codes covering said installations. All installations shall be made in conformity with regulations of governmental agencies for the protection of the public. (6) When necessary, barricades, warning de­ vices and flagmen shall be provided by the Utility during all phases of their construction and mainte­ nance operations on the trunk highway right of way. (15) Upon completion of an installation, the Utility shall restore the trunk highway right of way to its original condition. The Utility shall then notify the office of the Assistant District Engineer, Mainte­ nance, or Project Engineer of the completion of the work so that inspection can be made to determine its acceptability. (7) Utilities along the interstate highways shall be located outside the control of access lines except as outlined below. Where the control of access lines coincide with the right of way lines, the utilities shall generally be located on private property. Where the control of access lines and right of way lines do not coincide, utilities may in general be located in the area between them. All utilities shall be serviced and maintained without access from the ramps, loops and Page 3through traffic roadbeds. Utilities may be serviced from frontage roads and roads other than another in­ terstate highway which cross either over or under the interstate highway.-At aerial crossings of an inter­ state highway, supporting poles may be located on interstate highway right of way if they are a mini­ mum of thirty .feet beyond the shoulders of all through traffic roadbeds; however, in no event shall they be located in a median unless its width is eighty feet or more. Manholes and other points of access to-underground crossings may be permitted on the interstate highway right of way only when located outside the shoulders of the through traffic roadbeds, loops or ramps. The restrictions of this paragraph shall not apply to utility lines which serv­ ice facilities required for operating the interstate highway. There'may be extreme cases'where, under strictly controlled conditions, a utility may be permitted in­ side the control of access lines along an interstate . highway. In each case there must be a showing that any other utility location is extremely difficult and unreasonably-costjy to the utility consumer, that the iristallatibn on-the right of wayof the interstate^high- way will not adversely affect the design, construction, . stability, traffic-.^safety or operation -of the interstate highway and that the utility can be serviced without access from through traffic roadbeds, loops or ramps. (8) At the time of construction of the utility and at the times of .subsequent maintenance, prior approval shall be obtained from the District Engi­ neer or his authorized representative for the cutting and trimming of trees within the trunk highway right of way. Wherever trees are cut the resulting stumps h- shall be removed unless otherwise provided in the ^ Special Provisions of the Permit for construction. «/» Any holes caused by stump removal shall be back­ filled, the area leveled and all materials associated ^ therewith disposed of outside the trunk highway right ^ of way. The utility shall advise the District Engineer or his authorized representative at least 48 hours in Z advance of its intent to start clearing and grubbing ^ operations so that proper supervision can be pro­ vided. (e) Aerial (1) There shall be only a single pole line on the trunk highway right of way on either side of the center line thereof, unless otherwise authorized in the Special Provisions of the Permit for construction: (2) Longitudinal installations on non-interstate trunk highways shall normally be located in the outer 'ffive feet‘df the right of way. At crossings of the non- interstate trunk highway, poles shall be placed at a - minimum of thirty feet from the shoulder lines of the through -roadbeds unless-right of way widths are prohibitive to such location. (3) Unless clearly indicated on the Permit for construction sketch, the location of all brace poles, anchors, and ,anchor poles within the limits of the trunk highway right of way shall be approved by the District- Engineer or his authorized representative prior to actual installation. (4) In those instances in- which a Utility is is­ sued a. Permit or Permits for construction on both sides of the trunk highway right of way in a given area, such Permit is conditioned upon the Utility subsequently providing joint use to other Utilities upon reasonable terms mutually agreeable to the Utilities. ! (f) Underground (1) All crossings of the roadbeds of the trunk highways shall be made by boring inside a casing or carrier pipe, or by jacking, unless this procedure is modified in the Special Provisions of the Permit, for construction. The auger shall not lead the casing or carrier pipe hy more than one inch. Open trenching shall be restricted to the area from 5 feet beyond the shoulder to the right of way line except as modi­ fied in the Special Provisions of the Permit for con­ struction. ' X .lU (2) When pipes with bells or flanges are in­ stalled, the crossings of the roadbeds of trunk high­ way shall be made by boring inside a conduit as provided in Minn. Reg. Hwy. 33(f)(1) of this section or jacking a conduit of sufficient diameter to per­ mit threading the carrier pipe through it. (3) All voids caused by jacking-or boring shall be filled by pressure grouting. The grout material shall consist of a sand-cement slurry of at least two sacks of cement per cubic yard and a minimum of water to assure satisfactory placement. (4) The underground utilities shall be so in­ stalled as virtually to preclude any necessity for disturbing the roadbeds to perforrn maintenance operations. (5) Underground installations shall be accom­ plished without damaging or destroying the principal root structure of specimen trees. (9) The Utility shall obtain a Work Permit from the office of the Assistant District Engineer, Mainte­ nance, prior to performing service and maintenance operations on the interstate highways and shall also obtain a Work Permit prior to performing service and maintenance operations on the non-interstate highways when such operations require opening and disturbing the surface of the right of way thereof. In all other instances the Utility shall notify the office of the Assistant District Engineer, Maintenance, prior to performing service and maintenance operations on the non-interstafe highways which interfere with the normal flow of traffic thereon. However, the Com­ pany may perform service and maintenance opera­ tions on the trunk highways including opening and disturbing the surface of the right of way without a Work Permit in those instances where an emergency exists that is dangerous to the life or safety of the public and which requires immediate repair. The Utility upon knowledge of such an emergency shall immediately notify the State Highway Patrol. The (g) Order No. 31424 is effective on August 1, 1961.
