After consideration, motion was made Craig Anderson, seconded by Robert Schwartz and unanimously carried, to approve a variance from the required ordinary high water level setback of 150’ for the installation of three sewer systems less than 150’ from the ordinary high water level. V John Kimple - Denied John Kimple, Dent, MN, requested a variance of 160’ from the required ordinary high water level setback of 200’ and a variance of 60’ from the required shore impact zone setback of 100’ for the addition of a deck to an existing cabin 40’ form the ordinary high water level. The deck will be 40’ from the lake. The property is described as a 7.8-acre tract in Government Lot 4, Section 8 of Dead Lake Township by Dead Lake. Ralph Harthun represented the applicant at the public hearing. The audience was not polled, as there was no one in attendance at the time of the public hearing. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. Vincent Hohenstein - Tabled Vincent Hohenstein, Dent, MN, requested a variance to subdivide a 3.23-acre parcel into two lots. The property is described as a 3.23-acre parcel in Government Lots 2 and 3, Section 34 of Star Lake Township by Dead Lake. Prior to the scheduled public hearing the applicant had submitted a letter requesting that consideration of his application be tabled until he has had an opportunity to meet with township officials. After consideration, motion was made by John Everts, seconded by Randall Mann and unanimously carried, to table the applicant’s request until the October 9, 1997 meeting. Additional Discussion: William and Marion Krueger and Stanley and Joyce Koenig - Wally Senyk, County Attorney, discussed with the board that portion of a previously approved motion that required a township to apply for a variance to place a septic tank within the road right-of-way. It was the general consent of the Board of Adjustment that the submission of a variance application would be sufficient and no formal hearing process would be necessary. David and Judy Pederson - A variance for the placement of a 28’ by 60’ dwelling approximately 63’ from the ordinary high water level had been previously approved on September 5, 1996. The applicants are now requesting a dwelling with a different overall size. After discussion and consideration, motion was made by Randall Mann, seconded by John Everts and unanimously carried to allow a change in the size of the proposed dwelling with the condition that all other requirements of the previously approved variance must be followed.
