I do not dispute your review of the current lots as being substandard size based on the current ordinance; but 1 believe section III general requirements item 13 exemptions B. 1. exempts us from the requirement to combine the two lots. I would like to point out that both these lots currently have structures on them and should be considered improved. It is not like our current residence that was built next to and undeveloped lot. I would also like to point out that we are not trying to obtain permission to erect a structure, but to install a sewer system. In section II, Definitions No. 62 Structure. In order for something to be considered a structure it needs to be at least vision obstructing. What we are doing is below grade even item 62 exempts sewer lines. I noticed even item 66, in the definitions considers a screen house or boat house as an improvement. In my discussions with the sewer system installer 1 ascertained from him that the drain field needed to be 50 feet from the deep well, 20 feet from the dwelling, and 150 from the lake. We are able to meet two out of three of these requirements. The only requirement we aren’t able to meet is the 150 feet from the lake. It would end up being about 100 feet from the lake. I would like to point out we are on a knoll. A high sandy soil type of knoll. About a 40 to 50 foot cliff above the water line. 1 know the soil is sandy because I dug the original septic system in. I ended up over excavating because the sandy soil kept caving in. I strongly suspect the soil would be rated quite high on a perk test. 1 have also enclosed a copy of the topo of the lake. Part of the reason the lake is in such a restricted category is because a vast majority of the lake is shallow. With the exception of the portion of the lake where our property is located. Notice the lake is kind of clover leaf in shape. The portion we are located in is the deepest part. I would venture to say a reasonable person could view this lake as three separate lakes, and the portion of the lake our property is on would be categorized quite differently. I really believe a best location scenario for the sewer system will pose no long term environmental threats and respectfully request one. Don L. Lots 4 through 8 of Borup’s Maple Beach are contiguous, substandard (each of the lots has less than the required 200 ft. of water frontage and is less than the required 80,000 ft^ in size), and are under the same ownership (Mary Hohnestein). The Complainant states that the following facts establish PROBABLE CAUSE: Complainant. William Kalar. is a duly acting and appointed Director for the Department of Land and Resource Management. County of Otter Tail. Minnesota, who received information regarding the below-described offense. On June 24, 1997, Pat Eckert and George Hausske, Inspectors with complainant's department, conducted an abatement survey of Dead Lake in Otter Tail County. Specifically, they inspected the property of MARY HOHENSTEIN. hereinafter referred to as the defendant, located at 38186 Hwy 35. Dent. Otter Tail County, Minnesota, located within the shoreland management area of Dead Lake in Section 8 of Dead Lake Township, and more particularly described as Borup's Maple Beach, Lots 4 and 5. The Inspectors observed a number of problems w ith the property, including sewage system issues with the dwelling and four cabins. Specifically with the dwelling, the Inspectors observed that the tank was less than 50 feet from a well, less than ten feet from the dwelling and was a prohibited unsealed tank. On July 28. 1997. Hausske sent an abatement notice to defendant advising that the systems must be brought into compliance. On August 4, 1997. Eckert spoke with defendant, who said that she would get a plan to Eckert w ithin 30 days. On January 15. 1998. Eckert sent a letter to Dan Barrv' Excavating, advising that Eckert was told that defendant had contacted them to upgrade their sewage system. On May 10, 1998, Eckert spoke with Dan Barry of Dan Barry Excavating and learned that the defendant planned to install the new system this spring. On June 5, 1998. Hausske sent a letter to defendant indicating that there had been no action taken, and that she must upgrade the system by July 1. 1998. On June 5. 1998. Hausske received a letter from defendant's son. Don Hohenstein. that the system would be upgraded by July 1, 1998. On July 10. 1998. Barrv's E.xcavating took out sewer permit #12022 for updating the sewage system in the cluster development. Specifically permit #12022A and #12022B for the cabins, and #12022 for the dwelling. On .August 6. 1998. Hausske inspected the property and found that the systems pursuant to permits for the cabins were installed and approved. However, the sewer according to permit #12022 for the dwelling, had not been installed. On August 9. 2002, Hausske sent another letter to defendant advising that sewer pennit #12022 had never been installed, and that the dwelling still remained under abatement. Hausske advised that the system must be in place by August 16. 2002. On .August 13. 2002. Mike Douglas and Hausske inspected the property and found that there I, were four standing pipes sticking out of the ground area. Hausske observed that the pipes were not connected to anything, and that there only purpose was to deceive and make it look like a legal system had been installed. Hausske also observed that someone had installed an overflow pipe on the abated cespool, and that it was discharging onto the surface. On June 4, 2003, Hausske returned to the property' and found that no action had been taken on the septic system to the dwelling. Hausske advised defendant that she must bring the system into compliance by July 1, 2003, or the matter would be referred to the County Attorney's Office. On September 26, 2003, the Otter Tail County' Attorney's Office sent a letter to defendant advising that her property' located on Dead Lake must be brought into compliance by November 1,2003. As of November 14, 2003, the defendant has failed to install a new septic system for the dw'elling. There is so much for me to say it is difficult for me to know where to begin. My father died in December of 2002 and I have become involved paper work wise in my mother's affairs since then. Lets start with the complaint as worded in the court summons sent to my mother. Though it is filled with many inaccuracies it gives me somewhat of a rudimentary chronology of the county's involvement. I bring this up because I think it brings up a negative and therefore a prejudicial view towards my parents. As you can see by the previous paragraph my father died near the end of 2002. My father is a very private person and his personal dealings he would handle himself. The paper work end of things anyway. Lets start with my supposed knowledge of and letter to George Hausske dated June 09, 1998 indicating first of all I had even written such a letter and secondly that I had given a date for completion of a septic system. I thought to myself did I write such a letter and if I had why do I not remember it. I looked through mom's files of things I have been helping her with to find a copy. Hell, it was written back in 1998 that is a while ago maybe I just forgot. I couldn't find a copy. We finished work early on Friday (13 Feb 04) so I stopped in at Land Resources Office to get a copy of this letter. I thought they would have a copy, but one was not produced. Then I thought wait a minute dad was still alive back then he would have handled this not had me do it. Mr. Hausske also indicated an installation of an overflow pipe on an existing system. The wording in the complaint gives the impression that this is a later addition to an existing (formerly complying) system. This pipe he is referring to is the access pipe for pumping out the system. Which probably has to be done more often under the an old system then the new with an addition of drain fields etc.. I would ask Mr. Hausske if a new system ever has to be pumped out. I would think he would acknowledge they do. The new systems have the same access pipe as the old I would conclude. I do not know what Mr. Hausske calls the access pipe used for pumping out a septic in a new system, but I hope it is not called an overflow. The environmental prejudices that would lead a court to think would not be to positive I would think; not to mention the light it reflects on my parents and there attitude toward the environment. The other four pipes sticking out of the ground Mr. Hausske refers to is an older drain field (probably previous complying). I was at my parents place a short time after Mr. Hausske's visit, but I did not view any excavation done on near or around any of these pipes or he would have seen evidence of a drain field. I can only '•X«guess Mr. Hausske tugged on one of these pipes and removed it from its connection to the drain field pipe below. Since these are what I call digester pipes that aid in the bacterial break down of effluent to the drain field and this part of the system is not pressurized the connections may not needed to be glued. How Mr. Hausske came to the conclusion they are not connected to anything I can only guess. I am troubled by his comments in the complaint and how they are conveyed to a court and the accuracy of this picture. In addition to this the topography of the region shows my parents place on top of a large sandy gravel loam hill. I know this because I was there when the basement was excavated for the house. It had to be over excavated because of the caving in. This as any septic installer would tell you Is an ideal condition for a septic system. We are not dealing with a clay knob and no permeability. We are probably 60 to 70 feet above the lake water line. I know the well is nearly 100 feet deep. I find it interesting that regulations seem to have only one set of guide lines for all conditions when common sense would tell you there should be other mitigating factors. Now to address what I have been trying to accomplish since my father's death. I look first at what I call basic tenements for human survival. Food, clothing, and shelter. We know my mother is on social security so I help her prioritize her money for her needs. Lets look at the big picture my mother is 73. She has been on social security since she was 65 that is 8 years ago. That would be about 1996. These requirements for improvements to the septic systems have come about since she has been in this fixed income status. She has lived on this piece of property since 1956-7 I believe. My father built this house in question around 1964-5. He has reroofed it two to three times since he has lived here. In addition to that the house has been repainted a couple of times. I know mom can probably pay her heating bill and buy groceries and do a few improvements to the home if she prioritizes with here money. Within the last few years the furnace has died. Check with the plumber from Vergus he put in a new furnace for $1200. The well has failed to provide water. This was another $300 to repair. The roof began to leak and my siblings and I have reroofed the house, but the garage still needs to be done. I have also repaired a half a dozen windows some had fallen apart and would no longer keep out the weather. Leaking and or damaged faucets and toilets have been repaired or replaced. My siblings and I have been making repairs and improvements to my mother's home as I have been able to afford them. In the past when Mr. Hausske had called I would reiterate the what I had been working on and tell him of my mother's financial scenario. I also told him I had not forgot about him. I came away with the impression he understood. I see now I only antagonized him hence the court summons for my mother. I reasoned winter is coming the house needs windows to keep the cold out so it can be heated so I built new windows. Yes I know the septic needs to be fixed, but I don't see it as high a priority. The roof has leaked and some mildew has developed. We repaired the roof and removed damaged drywall and mildew. New drywall still needs to be installed I'm working on it give me some time. Yes I know the septic need to be fixed, but with my mother's allergies I needed to address the mildew problem so the air is safe to breath. This house isn't like Ma an Pa Kettle's house, but after 40 years it is need of some health, energy and safety improvements. Our:f;amily has prided ourselves in taking care of our own problems and not burderiing?6thers with them. We are a resourceful family to an extent, but we need timeias an ally. > In addition to this my father had two other septic systems to install besides this one. He was on social security and was still working toward your goals. He had been making the effort. I only wish Mr. Hausske made as much mention of this as what he believes to be a flagrant violation. A friend told me about a neighbor who was able to obtain some low interest and/or grant money for improvement to there property. In addition to making improvements to my mom’s place after work and on some week ends for me I started looking into this possibility for my mother. I talked to a Helen Kloos from rural development a single family housing specialist. She came out to my mother's place and I gave her a walk through. She informed me my mom may be a candidate but she would review it. She said I would need to get two estimates for improvements needed. The first thing I solicited for was the septic system and I sent them off to her write away. I had wished it could be that simple. Ms. Kloos wants a total package for all improvements. I was hoping I could do it incrementally because of the difficulty of attracting licensed contractors in a rural area for a .project of this scope. It is not difficult to find people to do the various aspects of the work because many people are trained in assorted trades, but not licensed for the total package. There are no drawings or specifications for the project so I have been putting together a descriptive list to pass out as guide for estimating the work to be done and as a reference for Ms. Kloos in approving funding for tasks listed. I am not totally clear on what I will be able to receive help so I figured this list would help. I have enclosed a copy of these tasks. The septic system is not on this list because I have already sent her copies of that estimate. Mr. Calor (my apologies if I spelled your name incorrectly) asked me to write a letter explaining the situation. He asked me about a time line on the septic suggesting September 2004. I don't have control of any of the players in this picture. The approval from Ms. Kloos; my mother's financial situation and what she can afford; and the scheduling of a licensed septic installer. On June 24, 1997. Pat Eckert and George Hausske. Inspectors with complainant's department, conducted an abatement survey of Dead Lake in Otter Tail County. Specifically, they inspected the property of MARY HOHENSTEIN. hereinafter referred to as the defendant, located at 38186 Hwy 35. Dent, Otter Tail County, Minnesota, located within the shoreland management area of Dead Lake in Section 8 of Dead Lake Township, and more particularly de.scribed as Borup's Maple Beach, Lots 4 and 5. The Inspectors observed a number of problems with the property, including sewage system issues with the dwelling and four cabins. Specifically with the dwelling, the Inspectors observed that the tank was less than 50 feet from a well, less than ten feet from the dwelling and was a prohibited unsealed tank. On July 28. 1997, Hausske sent an abatement notice to defendant adv ising that the systems must be brought into compliance. On August 4, 1997. Eckert spoke with defendant, who said that she would get a plan to Eckert within 30 days. On January 15. 1998. Eckert sent a letter to Dan Bany Excavating, advising that Eckert was told that defendant had contacted them to upgrade their sewage system. On May 10. 1998. Eckert spoke with Dan Barry of Dan Barry E.xcavating and learned that the defendant planned to install the new system this spring. On June 5, 1998. Flausske sent a letter to defendant indicating that there had been no action taken, and that she must upgrade the system by July 1, 1998. On June 5, 1998. Bariy's Excavating took out sewer permit 12022 for updating the sewage system in the cluster development. Specifically permit #12022A and #120228 for the cabins, and #12022 for the dwelling. On .August 6. 1998. Hau.sske inspected the property and found that the systems pursuant to permits for the cabins were installed and approved. However, the sewer according to permit #12022 for the dwelling, had not been installed. On .August 9. 2002, Hausske sent another letter to defendant adv ising that sewer permit #12022 had never been installed, and that the dwelling still remained under abatement. Hausske advised that the system must be in place by .August 16, 2002. On .August 13, 2002. Mike Douglas and Hausske inspected the propertv and found that there were four standing pipes sticking out of the ground area. Hausske observed that the pipes were not connected to anything, and that there only purpose was to deceive and make it look like a legal system had been installed. Hausske also observed that someone had installed an overflow pipe on the abated cespool, and that it was discharging onto the surface. On June 4, 2003, Hausske returned to the property- and found that no action had been taken on the septic system to the dwelling. Hausske advised defendant that she must bring the system into compliance by July 1, 2003, or the matter would be referred to the County Attorney's Office. On September 26, 2003, the Otter Tail County' Attorney's Office sent a letter to defendant advising that her property located on Dead Lake must be brought into compliance by November 1, 2003. As of November 14, 2003, the defendant has failed to install a new septic system for the dwelling. Note: this property is a cluster development that has 3 dwellings on it requiring 3 systems accordingly, the 3 systems are designated 12022A, 12022B, and 12022 N.B. August 6,1998 ' I wrote Mary a letter informing her that Sewer Permit Number 12022 was never installed and that her house remains under Abatement. I also stated that her house must be updated by August 16,2002. August 9, 2002 Mike Douglas and myself visit this property to check the status of the septic system serving Mary’s house. What we found was very disturbing: August 13, 2002 *4 stand pipes (such as those required at the end of trench runs) were sticking out of the ground in the area where Dan Barry showed as the end of runs on his sewer design. These pipes are bogus. They were not connected to anything. Their only purpose was to deceive, to make it look like a legal system had been installed. We also found that someone had installed an overflow pipe on the abated cesspool, this was discharging to the surface. Mary was onsite, she is very old and clearly does hot understand what is going on. Her daughter-in-law was with her, I told her daughter-in-law to have her 2 sons (who also live on this property) to help Mary with the septic problem. Upon returning for the summer, I foimd that no action had been taken on this matter. I called Mary and told her the system must go in by July 1,2003 or legal action will be taken. She said one of her sons would call. Jime 4, 2003 I called her son Don and explained the problem, I also told him to take out a permit as soon as possible.
