Concerning the conditional use request for Lake No. 56-383, Section 8/17, Twd. 135, Range 40 and the DNR's proposal to buy this section of Heart Beach resort to expand the public access to Dead Lake and convert it to a state access. We the owners of the adjacent property, Pocahontas Resort since 1968, oppose this request for the following reasons: Heart Beach resort is now only 200' feet wide, if they sell the 60' in question to the DNR, we understand they will not even have the area to build a home, much less operate a resort. 1. Currently the area is congested and Heart Beach does not have enough space to accomodate their vehicles and trailers, they are spilling over into public access space and onto Pocahontas Resort property. 2. Potential decrease in property value of neighboring real estate.3. There are no toilet facilities and people using the access are urinating behind our buildings and in our bushes by our house. 4. There have been incidences of damage to our tennis court fence, garage doors and our lawn caused by a lack of space to manuever vehicles and trailers. 5. Besides the problem of human waste there is no mechanism to deal with trash and fish waste, which is commonly strewn onto our property by access users. 6. The access is too steep for winter access and is often not prepared in time for spring fishing opener, here we have usually approved conditional use requests; however, in this case we feel that if the DNR expands this access and advertises it statewide the congestion and existing problems we presented will be compounded. 7.
