Approval of Agenda Motion by Lee, seconded Stone, and unanimously carried to approve the agenda of October 15, 1996 as presented. Approval of Minutes Motion by Windels , seconded Lee, and unanimously carried to approve the minutes of October 8, 1996 as submitted. Liquor License Motion by Lee, seconded Stone, and unanimously carried to approve the following application for license: On-Sale Liquor and Wine LicensePantry N’ Pub Weetown, MN TIP Discussion Auditor, Wayne Stein, discussed Tax Increment Financing Districts with the County Board. Recycling Center Activities Marie Tysdal, Public Education Officer, provided an informational handout of solid waste recycling activities during the months of September and October. Ms. Tysdal reviewed the HHW collections, the new HHW program, and educational efforts during Waste Reduction Week. Planning Commission Recommendations Land & Resource Director, Bill Kalar, presented a Conditional Use Application request for Robert D. Olson which was tabled at the last County Board meeting. Commissioner Windels reported his observation of the property. Mr. Kalar reported that the ice ridge is very old and has been there a number of years. Accessibility to the dock area is limited, however, a stairway or boardwalk would be a possibility. Conditional Use Applications: Motion by Lee, seconded Lindquist, and unanimously carried to deny the following CUP per the recommendation of the Planning Commission. Robert D. Olson, (Sec. 2, Twp. 135, R. 40) Marian Lake Motion by Windels, seconded Lee, and unanimously carried to deny the following CUP per the recommendation of the Planning Commission. OCTA Duane Rose, representing the Otter Country Trails Association, requested permission to use the Central Trail railbed again this winter for snowmobiling. Motion by Lindquist, seconded Lee, and unanimously carried to approve the use of this railbed by OCTA for snowmobiling subject to conditions as stated in the previous 1996 Trail Assistance Agreement. Aerial View of Pomme-de-Terre and Chippewa River Watersheds Bill Kalar, Land & Resource Administrator, provided a memo from Ag Inspector, Tiny Holm. After aerial flight of specific areas of the Pomme-de-Terre and Chippewa River Watersheds, no contaminating source of pollution flowing out of Otter Tail County was observed. Board members directed Kalar to forward this memo to the Minnesota River Basin Committee. Planning Commission Recommendations The Land & Resource Administrator presented the Planning Commission recommendations. Chair Portmann opened discussion to individuals present. Virgil Munson representing “Head Lake Camp" explained that “Head Lake Camp" cannot pass the criteria to add RV sites and cannot purchase additional contiguous land because the DNR owns the surrounding land. General consensus of the board is to uphold denial of this CUP request per the recommendation of the Planning Commission: Robert Olson appeared relative to his CUP which was denied by the Planning Commission. Mr. Olson explained that he wanted to open the lot for approach to the lake in order to sell the property. Commissioner Windels will view the property. No action taken. Deforrest Malstrom thanked the board for reconsideration of a CUP for Bradley Malstrom. Allan Kunkel representing “Leisure Lane Resort” questioned the possibility of a grandfather clause relative to the four campsites that were initially requested. The County Attorney explained that without a record of a permit issued for these campsites, the county SMO does not allow the campsites. Further, after review of the SMO this winter, Mr. Kunkel may be able to reapply. Deb Zachman representing “Xanadu” explained that there is more than enough lakeshore but insufficient acreage to obtain a CUP. Commissioner Lindquist stated that the sewej; syetem setback requirement is the issue. Lengthy discussion took place regarding vertical separation being the critical factor for sewage treatment and the setback requirements of Chapter 7080. If a variance for the septic system is required, it would be obtained through the Board of Adjustment. Otter Tail County Planning Commission County Court House Fergus Falls, Minnesota 56537 Hilary Barry/Virgil Munson "Head Lake Camp" Box 66 Richville, MN 56576 October 3, 1996 To Whom It Hay Concern: Enclosed you will find a copy of the October 2, 1996 minutes indicating the action that was taken in regards to your request. The County Board of Commissioners will consider this recommendation at their October 8, 1996 meeting at 11:00 A.M. However, if the Planning Commission tabled your request, the minutes do indicate what they are requesting from you in order to act on your request. You will receive notification as to the date and time your Application will be considered prior to the meeting. If you have any questions please contact our office. Acting Secretary Planning Commission October 2, 1996 Page 5 H. Barry a V- MuTigonZ-Head Lake Camp" - Denied: i A Conditional Ose Application to ask for 21 additional RV campsites and sewer system to service them. We have a license for 10 mobile homes, 1 cottage and 16 campsites at the present time. We have approximately 3400' of lakeshore on 16.9 acres with 400-f acres of DNR land back of our point on Head lake. We are also asking for a variance of setback from the OHWL (to be 40' from the OHWL) and buffer zone requirements (to be 40' at the closest). The triangular shape of the parcel make it impossible to meet these requirements. The property is described as Pt of Government Lot 1 of Section 20 and Pt of Government Lota 4 & 3 of Section 21, Rush Lake Township; Head Lake (56-213), NE. Jerry Greenwood indicated thatVirgil Munson represented the Application, he does not see a need to expand the resort and expressed concerns with setting a precedent; Bob Wagner expressed concerns for fish spawning area and an increase in fish harvest; Cheryl Harris spoke in favor and indicated that there are variables (not all renters fish daily, (weather) and resorts aren't always full). A motion by Lachowitzer, second by Bergerud to deny as requested as they already exceed the Ordinance requirements. Voting; All members in favor. Allan Runkel/"Leisure Lane Resort - Partial Approval; A Conditional Use Application to build an addition/garage to existing house; maintenance on bank-stairs, minnow tank and washout; addition of 4 camp sites; and permission to do business in home - secretarial service, property is described as Lots 3, 4, 5, 6 & 7, Subrosa Beach of Section 11, Pelican Township; Prairie lake (56-915), RO. The Joel Jacobs expressed thatAllan & Jane Kunkel represented the Application, his only concern was with the additional campsites and the density of the property; Lloyd Mackey indicated he had no objection to this request and what's being requested would help the whole community; Carol Jacobs indicated that the bathhouse was a cabin at one time and that the door faces her lot. A motion by Harker, second by Bergerud to approve with the exception of the 4 campsites since there is insufficient acreage and water frontage for additional dwelling units. Voting; All members in favor. Minnesota Pollution Control Agency Received 2 0 2996 U\D&H£SOLiRCE September 19, 1996 Mr. Bill Kalar Otter Tail County Zoning Office Otter Tail County Courthouse Fergus Falls, Minnesota 56537 Dear Bill: I had a chance to look through the packet of applications for the October 2, 1996, Planning Commission Meeting and I would like to offer some comments on several of the applications. I know our Agency has not been very good about commenting so don’t take these comments necessarily as meaning these particular applications are bad. The first application 1 have comments on is Allen Peterson. This Conditional Use Application for fill activities does not fall under the mandatory category for stormwater permit for construction activities. Even so we would strongly recommend that Mr. Peterson have erosion control practices in place as soon as possible after the fill activity is completed. Our similar concerns exist with the application of Robert Olson for reworking the bank along Marion Lake. If the work is to be completed this fall it is especially important to have erosion control practices in place. We would also like to be assured that the proposed project of Hillary Barry and Virgil Munson called “Head Lake Camp” is constmcted with a compliant sewage treatment system. We would hope that your office will review this request with the wastewater treatment considerations taken care of. The only other application we would like to comment on is the Marvin and Sandra Heisler application. I do not know if this area is on an individual sewage treatment system or sewered into Vergas? If this site is served with an ISTS, then there are special requirements that apply to these types of facilities. I have attached a factsheet explaining these. I think you probably already have these. If you have any questions on this please give me a call at 218/847-1519.
