Re: Golden Eagle Campground Dear Mr. Balega; When we met, along with Mr. Mike Cummings, on January 13*^ you requested that the MPCA consider the data provided by Golden Eagle Campground on flow measurements. You provide additional data at that meeting, we have reviewed both previous submissions and that provided on the 13*^. Based on the information provided, we have determined that Golden Eagle Campground will not be required to obtain a State Disposal System (SDS) permit and may continue to operate under County authority. We have copied this letter to the County so they are aware of this decision. Please be aware that any changes to the campground that would affect the amount of flow to the septic system would require a re-evaluation of flow and could trigger the need for an SDS Permit. In the meeting on the 13*'’ you also requested that communications regarding Golden Eagle Campground be exclusively through you. Because of that request, we will not be copying this to Mr. Cummings. This letter and attached worksheet are provided to you to determine if the sewage treatment and disposal system serving your campground or resort may require a state disposal system (SDS) permit issued by the Minnesota Pollution Control Agency (MPCA). History Minnesota Rules Chapter 7081 requires that all commercial facilities obtain a State Disposal System permit from the MPCA if ^ of the following are true: • The establishment generates a peak sewage flow of greater than 10,000 gallons per day • The establishment utilizes a subsurface sewage treatment system or systems • That multiple soil systems (drainfields or mounds), that receive the 10,000 gallon per day or more of sewage, are within one-half mile of each other • The systems are under one owner (business) If all of the preceding factors are not true, the subsurface sewage treatment system is regulated under the jurisdiction of a local SSTS program (county, township or city). Before the new law, the 10,000 gallon per day threshold was determined by the greater of estimated or measured sewage flow volumes. Under the new law, the measured flow values can be used to determine if the permit thresholds have been exceeded. The law contains specific methods on how the sewage flow volumes are to be measured. What do I need to do? The first step is to complete the enclosed worksheet and send a copy to the address on the worksheet by February 18, 2016. We will inspect Mr. Cummings’ new work and certify it when it meets MPCA standards. Also, in accordance with our phone conversation this morning, you may take this letter as an “over-all” certificate of compliance for the septic systems that service this facility. We have no indication that any of the systems servicing this facility have failed to perform satisfactorily up to this time. I doubt that Mr. Cummings has flow meters installed on all of his wells. I would think that the total flow for this facility could very well be approaching 10,000 gallons/day. I am not sure if MPCA would consider this a requirement for Mr. Cummings to obtain SDS and NPDES permits unless it is proven that his facility exceeds 10,000 gallons/day. There is no accurate overall drawing in your folder that shows where the structures, support facilities, wells, water lines, septic tanks, lift stations, sewer lines, drain-fields and dump station have been placed on the property. It has become extremely difficult to figure out setbacks, especially in the initial septic system areas that were done without accurate advance plans. Please let me know if you have the above mentioned information already properly recorded. If not, when will you be able to provide it? Thank you for assisting with this matter. Verify that the pipe materials to be used for the sanitary system will comply with the following; 8.: a. Materials used for building sewers must comply with Minnesota Rules, part 4715.0530. b. Materials used for drain, waste, and vent systems must comply with Minnesota Rules, part 4715.0570 through part 4715.0600. 9. The water piping system shall be disinfected in accordance with Minnesota Rules, part 4715.2250. 10. The plumbing system shall be tested in accordance with Minnesota Rules, part 4715.2820. NOTE(S): 1. The scope of this project consists of the addition to an existing building. The plumbing installation includes water closets, a urinal, lavatories, showers, a clothes washer, and a laundry tub. 2. This addition will be served by an existing private well and a new individual sewage treatment system. The sewage treatment system is to be reviewed by the Otter Tail County Department of Land and Resource Management. Authorization for construction in accordance with the approved plans may be withdrawn if construction is not undertaken within a period of two years. It is the responsibility of the contractor/installer to notify the Minnesota Department of Health when an installation for a state contract job, licensed facility, or project in an area where there is no local administrative authority is ready for an inspection and test. On March 29, 2009, our Office was visited by an individual with questions regarding a proposed 5.15 acre homestead parcel, which appears to be part of the above mentioned parcels. The County Recorders records show that in June of 1986, a 3.21 acre parcel was split from Golden Eagle Campground. The Assessor’s records currently indicate that this 3.21 acre parcel not only contains a dwelling (homesteaded), but also a duplex and a campsite. These records also show that this parcel is being used for commercial purposes. Our records show that both of the above parcels were included in October of 1986 and May of 1991 when Applications (Conditional Use Permit & Variance) were filed regarding Golden Eagle Campground. Therefore, this Office must consider these parcels as one (1) for purposes of your campground. Please be aware that any alteration would require a Conditional Use Permit from Otter Tail County. On March 29, 2009, our Office was visited by an individual with questions regarding a proposed 5.15 acre homestead parcel, which appears to be part of the above mentioned parcels. The County Recorders records show that in June of 1986, a 3.21 acre parcel was split from Golden Eagle Campground. The Assessor’s records currently indicate that this 3.21 acre parcel not only contains a dwelling (homesteaded), but also a duplex and a campsite. These records also show that this parcel is being used for commercial purposes. Our records show that both of the above parcels were included in October of 1986 and May of 1991 when Applications (Conditional Use Permit & Variance) were filed regarding Golden Eagle Campground. Therefore, this Office must consider these parcels as one (1) for purposes of your campground. Please be aware that any alteration would require a Conditional Use Permit from Otter Tail County. No permit had been sought for for this structure. In speaking with Mr. Cummings, owner, about this matter, we find he is building this structure as a "prefab” moveable resort unit, for sale. Possibly a conditional use permit should be"*sought for a change of use of the property, or a site permit for the structure. Mr. Cummings is apparently receiving pressure to rent this unit on site, which would require a site permit, and more than one such rental building would require a conditional use permit for a resort license. I reviewed the file in this matter and have assembled a chronological resume of the file: 1/9/81 - Application for 26 campsites based on a 5/21/79 survey map showing eventually 130 sites on 1320 feet of beach was submitted. 1. 2/4/81 - Application was approved as presented by Planning Commission. 2. t 3/10/81 - Application was approved by County Board of Commissioners. 3. 7/2/82 - Application for 25 to. 30 additional site on the campground. 4. 8/4/82 - Application was approved with a minimum of 40 feet wide by 2,000 square feet per site by the Planning Commission. 5. 8/24/82 - Application approved by the County Board of Commissioners. 6. The May of 1981 revision of the Shore land Management Ordinance upped the requirement for lake frontage to 25 feet/campsite. The 1981 requirement of 25 feet/campsite would limit Mr. Cummings to 53 sites. He was approved for up to 56 sites in 1982. he has developed 53 sites at present. The campground has 3.9 times as much area per campsite as required. - Further granting of additional campsites towards the original planned 130 is at the Planning Commission's discretion. - Granting of Conditional Use Permit(s) for construction and sale of resort dwellings, or rental of more than 1 non-camper dwelling unit (a resort) is at the Planning Commission's discretion. - Land & Resource Management should possibly require a site permit on the prefab unit in any instance.
