As you will see from the enclosed copies of their meeting minutes, both groups indicated that the County’s Shoreland Ordinance requirements should be followed. Since this is the case, my current calculations and the land you have dedicated for your resort and campground must remain in effect. No Formal Action: Bill Kalar discussed with the Commission a letter that is addressed to the Secretary, Planning Commission. The letter was from Jennie’s Nature Preserve, Inc. which opposed the granting of Gene Ernst & David McFarland a permit to widen an existing roadbed. Mr. Kalar indicated that he is not aware of any Application being filed for this request. No formal action was taken. Frank’s Lodge - Denied Modified Calculation: Bill Kalar indicated that Frank’s Lodge, Star Lake (56-385), has requested the Planning Commission allow the 13 existing units in the first tier be included in the calculations rather than the 6 allowed by the Ordinance. Motion: A motion by Bergerud, second by Lachowitzer to deny the modified calculation & follow with the language in the Shoreland Management Ordinance. Voting: All Members in favor. Exempt Permit Motion by Lee, second by Mosher, and unanimously carried to approve, with no waiting period, the LG220 Application for Exempt Permit as submitted by the Pelican River Pheasants Forever for an event scheduled for September 20, 2003, at the Blue Water Restaurant and Sports Bar. Housing & Redevelopment Authority HRA Executive Director, Jeff Gaffaney, provided a handout requesting the County to levy approximately $200,000 for operational and program needs for the Otter Tail County HRA beginning CY2004. A list of county and city HRA’s that are currently levying for housing purposes was included. Housing Specialist, Dennis Christenson, briefed the Board on HRA’s programs and problems with some MHFA eligibility requirements. Further research regarding anticipated tax rates for 2004 is needed to determine the impact of this request. Highway Contracts Motion by Lee, second by Mosher, and unanimously carried to authorize the Chair’s signature to execute a contract between the County of Otter Tail and Robert R. Schroeder Construction, Inc. for S.P. 56-696-02 & S.A.P. 56-696-03, Bridge No. 91932 in the City of Pelican Rapids. This motion is subject to the approval of the County Attorney. Motion by Froemming, second by Block, and unanimously carried to authorize the Chair’s signature to execute a contract between the County of Otter Tail and All Building Corporation for Phelps Mill Roofing work. The resort consists of a home dwelling, six cabins (one also used as summer office), and four campsites adjacent to the cabins in the first tier, six campsites south of the town road in the second tier, and sixteen campsites north of the road in the second and third tiers. There is currently a dispute with Otter Tail County about the licensure of the four campsites adjacent to the lake. Although applicants have had seasonal dwellings on those sites every year since prior to the enactment of the county shoreland ordinance, the coimty takes the position that those campsites are not and must be licensed, citing a 1977 conditional use permit with total licensure for 22 units, not 26 units, in which the application materials did not mention those 4 existing campsites. Applicant proposes to remove those four campsites near the lake in the first tier. Applicant seeks current licensure for the following: Dwelling and six cabins currently in the first tier which will remain. Fifteen campsites (six existing south of road plus nine existing north of road) which will remain in the second tier. Seven existing plus nine additional campsites in the third tier. Eleven additional campsites in the fourth tier. A total of 49 units. Applicants property consists of approximately 92 acres with 450 feet of shoreline in Section 9 of Star Lake Township on the West Arm of Star Lake.
