Although it appears that the Planning Commission approval resolves the issue as far as the number of units, there does remain the issue of the sewage system on the property. Therefore, I believe that either you or Mr. Frank should be in contact with Mr. Kalar at your earliest convenience to discuss how that issue can be resolved. You mentioned that it was Mr. Frank’s goal to file an application with the Office of Land & Resource Management to re-locate four camping units into the third or fourth tier of the property. I now understand that there is a Planning Commission meeting where Mr. Frank is to appear on May 28, 2003, to address the issue. I will look forward to hearing what the Planning Commission decides. However, I also note that Mr. Frank would still have an issue with the septic system on his property because there are too many units under the system. Please let me know if Mr. Frank would like to resolve that issue negating the'need for a trial in this case. As you know, the Court Trial is now set for June 10, 2003. There is no question that only 22 camping units are allowed on this property according to his Conditional Use Permit issued on August 16, 1977. Although the State of Minnesota may allow for an additional four units under state licensure, such state rules are completely irrelevant and in no way supercede the Otter Tail County Shoreland Management Ordinance and its requirements. Therefore, Mr. Frank can have no more than 22 camping units on his property at any time. As far as statistical information on properties that were inspected on Saturday, June 29,2002, we do not believe that George Hausske from the Land & Resource Management Office was on the property of Mr. Frank or any other property on June 29. The Office of Land & Resource Management Inspectors do not conduct any inspections on the weekends. The complaint does allege a violation from July 25, 2000 through June 26, 2002. June 26, 2002, was the last date that the property was inspected by Mr. Hausske. The property was originally inspected back in July of 2000 under the Star Lake Abatement. Since that time, abatement inspectors do routinely re-inspect properties abated to ensure compliance. Should your client wish to resolve this matter prior to a trial in this case, he would need to remove the excess camping units on the property or request expansion of the number of units allowed on his property under the Conditional Use Permit process. On July 9, 1990, the Otter Tail County Department of Public Health inspected the property of defendant and found that 24 recreational camping units were on-site, and that the defendant was only licensed for 22 based upon the septic system in place. On July 5, 2000, George Hausske of complainant's department inspected the property and found 25 recreational camping units on-site. On July 10, 2000, Hausske spoke with defendant and explained that his property was in excess of the 22 recreational camping units as allowed with the septic system. Defendant stated, "You send me an abatement notice and I'll wipe my ass with it, you bunch of assholes." On July 25,2000, Hausske sent defendant a septic system abatement notice and advised that the property must be brought into compliance within a period of 30 days. On June 11, 2001, Hausske sent a letter to defendant indicating that the property was still not in compliance, and that the defendant must bring it into compliance by August of 2001 or the matter would be referred to the Otter Tail County Attorney's Office for legal action. On August 16, 2001, a letter was sent from the Otter Tail County Attorney's Office to defendant indicating that he must bring the property into compliance by September 1, 2001, or a formal criminal complaint would be brought against him.
