The Otter Tail County Board found that out Tuesday when it denied a variance request that would have allowed a 50-unit campsite expansion at Frank’s Lodge & Campground on Star Lake. The county board is charged with balancing the / interests of developers and the environment. The variance wasn’t denied because Star Lake property owners want to keep recreation on the lake all to themselves as some have alleged. In the case of Frank’s Lodge, John Frank’s plans to add 42 camping sites and eight tent sites, was not compatible with the surrounding area. The Star Lake Township road near the current resort and campground is not suitable for an increase in traffic, there would be increased dust when more vehicles used the road and there would be adverse environmental effects if the permit were allowed — including the funnelling of noise towards the lake. That’s why we have in place policies like the Shoreland Management Ordinance. The Frank’s Lodge project would not be good for Star Lake under its current proposal and the county board — and the Otter Tail County Planning Commission for that matter — made the tough decision in saying “no” to a longtime business in the interest of preserving the west arm of Star Lake. John Frank, owner of Frank’s Lodge & Campground, said Tuesday he’s likely to abandon plans for adding 42 camping sites and eight sites designated just for tents at his Star Lake Resort. Barring any successful appeal, which Frank said is doubtful, it’s likely he will remain with five cabins and 42 camping sites. The county planning com­ mission submitted a report to the county board outlining sev­ eral concerns about density and other issues it deemed would make the expansion inappro­ priate on the western arm of Star Lake. “This is mostly about densi­ ty issues,” said Commissioner Dennis Mosher who joined Robert Block, Everett Erickson and Roger Froemming in vot­ ing down the measure. Chris McCann of Interstate Engineering requested that the application be tabled and sent back to the Planning Commission to allow a dialogue to address the concerns. Mr. Frank stated that, at the Planning Commission meeting, there was discussion; however, when the vote took place, the issues were on other concerns than those that had been discussed. Neighbor, Bob Weatherly, expressed concern with this request because it creates too much density for this body of wafer. Jane Aschnewitz requested that the Board take a Section 2. Timinq and Amount of Reimbursement. Reimbursement allocation made under the provisions of this resolution shall be made within 18 months of the date hereof and shall not exceed ®in aggregate principal amount. The allocation shall be evidenced by an entry on the official books and records of the County maintained for that purpose. RECEIVED APR 2 2 2008 LAND & RtSOURCEApril 18, 2008 RE:Comments for CUP by Frank’s Lodge Star Lake, Minnesota CL 'dDear County Commissioner: Recently, I have submitted a Conditional Use Permit application for expansion of Frank’s Lodge on Star Lake. The existing facility has 49 units. The units include cabins, and spaces reserved for park model and recreational camping units (RVs). My application is to expand my facility to accommodate 42 more units, and 6 tent sites. As an observation, I have seen the Planning Commission invest a significant amount of time discussing applications with the applicants during the Planning Commission Meetings. If the Planning Commission sees a “non-conforming” point in the application, they identify it, and allow the applicant to correct the non-conforming attribute (either verbally or via a tabled application). To clarify, “non-conforming” attributes may include parts of the application that may follow the specifications of the ordinances, but do not fit with what the Planning Commissioners perceive from a qualitative basis as fitting with the 12 items that identify the general purpose of the ordinance (identified on Page 28 of the Otter Tail County Shoreland Management Ordinance). During review of the Frank’s Lodge application, the Planning Commission asked for comments from Bill Kalar. I was allowed to answer Mr. Kalar’s questions. Following my response, the Planning Commission motioned to deny my application. The denial was based on reasons that were not included in the discussion with Mr. Kalar. This does not seem consistent with normal protocol for permit review. This is the second time that I have tried to acquire approval of a CUP application from Otter Tail County for the same project. The first time, my application was rejected at the Planning Commission meeting because the County inaccurately interpreted Minnesota State EAW requirements. My first application had 42 RV units and 10 tents only campsites. The Minnesota EAW rules require a mandatory EAW if the number of “vehicle accessible” sites increases by 50 units or more. My application was compliant. Although I perceive this as an inadvertent error, it was unfortunate. This time, the application was denied because they did not want to go through an EAW process, but identified environmental impacts as a reason for the denial. The option of allowing Frank’s Lodge to prepare an EAW was not offered. This is a circumvention of the process. County Commissioners April 18,2008 Frank’s Lodge CUP on Star Lake Page 2 of2 I respectfully request a dialogue with you during your Commissioner’s meeting scheduled for Tuesday, April 22 at 11:00 a.m. The purpose of my visit is not for you to approve my CUP. I would like to persuade you to allow me to meet with the Planning Commission at the next available Planning Commission meeting so that I can review my application with the Planning Commission under the format that is usually followed (allowing me to discuss non-conforming issues and revise them through a dialogue with the Planning Commission). Our lodge is adjacent to property for which a recent RV park CUP application was recently denied (DuCharme’s application on Star Lake). Between the two applications, there was a significant amount of public comment opposing the applications. In light of this, Frank’s Lodge recognizes that the permitting process is a heavy issue for the County, particularly to the Planning Commissioners. We honor and respect the County’s right and responsibility to use its judgment in approving permits. I, as other property owners on the West Ann, appreciate the courtesy of notice when potential projects arise that may alter the sensitive nature on this part of Star Lake. As of late, we seem to be the focus of attention for attempts to either create or expand in the rirea of cluster developments. Tlie Ducharme application, thankfully, was denied by the Board. Yet in my last conversation with Land and Resource, I discovered that this matter may now go before a court of law. The proposed expansion of Frank’s to 97 units will have the same adverse effect on the We.st Arm that we seemingly avoided with the denial of the DuCharmc project. That being: 1) more condensed housing creating a large “footprint” on the land, 2) more boat traffic on our already busy small body of water, and the safety issues that go along wHth thi.s, 3) further invasion and disruption of the natural setting on the West Arm, The ctunulativc effects on the West Arm of Star Lake will be great if this Conditional Use Permit is approved. Now is the time to take a stand with regards to Cluster Developments in areas where a light footprint is needed to protect the sensitive nature of the environment. By now, you may be able to recite the points of public opposition as well as I can, but I will take the opportunity to voice my greatest concem.s again. First, let it be known that I am a supporter of family resorts in Minnesota. My family stayed at resorts nearly every summer for 16 years until we purchased our own lake cabin. And my family is a customer of Frank’s Lodge for gas, bait and ice cream and candy. I appreciate having a resort so convenient to my cabin. However, the issues raised in opposition of a similar request in recent months remain the same. The West Arm is a small, narrow and environmentally sensitive body of water that has experienced a significant increase in boat traffic over the last few years. This is causing increased shoreline erosion, water safety and noise issues on the lake. The West Arm cannot accommodate dozens of more boats, and no one can convince me that more RV sites will not result in more boats at Frank’s Lodge. Following the earlier expansion of RV sites at Frank’s Lodge, there i.s now hundreds of feet of shoreline covered with side-by-side boats, docks and lifts. Next, the earlier expansion of the RV Park at Frank’s Lodge, and addition of a cabin on the DuCharme’s property, has brought additional outdoor lighting to the lake. 1 understand the need for providing safety and security lighting for resort guests, but the amount of light is beyond reason and is not contained to the resort property. I cannot imagine the amount of additional lighting that would accompany the requested expansion. My request for addressing the lighting issue has been ignored. Finally, the view of nearly 100 RV’s from this small piece of water and the neighboring properties is something no one wants to see. Simply put, the addition of any RV sites on the West Arm is .simply too much. We are opposed to the permit for the same reasons expressed by many neighbors on the West Arm when the Franks next door neighbor and relatives approached you earlier this year with a similar proposal for their own property. After your consideration of the DuCharme proposal, the County Commissioners denied the CUP to add trailer houses on West Arm. We believe that the same conditions that caused the County Commissioners to deny the DuCharme proposal are present in the Franks proposal. Our objections include the fact that Franks already have nearly 50 trailers and cabins on their property. They want to increase that number to almost 100. The land and water area are both too small to support such a large increase in people. When the culvert was replaced with a bridge to the main part of Star Lake we saw an increase in traffic on the Arm. This was followed by a large increase in dwellings at Franks and by another small development on West Arm. Increased development will further stress the fragile environment of the Arm. The DNR offered evidence of the harm that would be caused by such a large development at the January 13, 2008 County Commissioners meeting. We feel the DNR’s input should be sought and considered before any kind of development is allowed on the West Arm. In addition to added boat traffic we will see an increase in road traffic on our gravel roads as well as more ATV traffic in the area. We often find ATV riders who stray onto our property even though we are several lots removed from Franks and our property is posted. This proposal, like that of John Franks’ sister and bother-in-law, has been brought forward in the very early spring before the majority of the affected residents are present. The idea of such a large addition would generate a great deal more feed back if people were aware of the project. As it is, many of us who have never written letters are doing so as well as taking time out of our work lives to travel many miles to offer our input. We do realize that such a wonderful area will become more developed over time. We believe this particular kind of development will not only damage the environment of West Arm but will also decrease the value of the remaining properties which could lead to the loss of revenue fi’om the area. Both the DuCharme and the Franks proposals are simply too much, too fast for any area to absorb. We urge you to consider the impact of this destructive proposal on a very small body of water and deny the CUP. Thank you. The potential cumulative density is too great given the sensitive characteristics of the West Arm as referenced by the calculations provided by Land and resource Management. 2. The increase in traffic (safety) on the water. 3. The General Development standard is inadequate to address this proposal. Note - This was also the case in 2003 when Franks Lodge had to prove they had room for 80 spaces before the approximately 17 RV unit addition was approved, which brought the number up to the present 49. 4. The West Arm is 305 acres, 148 of which is aquatic vegetation. 5. The present number of cabins and homes (based on GIS addressing) is 43. The number of present RV units is 49. A ratio of over 1 to 1. 6. Thousands of feet of shore land on the West Arm are still undeveloped and many lots exist that are not yet built on. When this happens it will, of course, put more pressure on the West Arm. 7. We believe the current number of boat slips and lifts exceeds the maximum allowed in the 2003 expansion. 8. We believe the current placement of an RV(s) on the beach is a violation of the 2003 expansion agreement where approximately 4 tier #1 campsites were to be removed. Due to the overall situation and the conditions present on the West Arm, we would strongly suggest that an Environmental Impact Study be required. Before any development of this type goes forward, at the very least an Environmental Assessment Worksheet should be completed. Terry Lejcher, DNR recently wrote a letter to the County Board dated January 11, 2008 motivated, we believe by this original application and another application which should be strongly considered before any further development of the West Arm takes place. It creates a density factor that threatens our wildlife, our property values, and the quality of life on the West Arm. The West Arm is simply too small to support this proposal. Franks' Lodge already has 42 units, plus cabins, a huge footprint on a very small body of water. The West Arm is one of the smallest self-contained bodies of water under your Jurisdiction. This part of the lake, is, as you know, very narrow, less than a quarter of a mile across. The lake is only about 300 acres of water, half of which is shallow marsh. The current density on the lake is already at a minimum of 3.1 water acres per unit. That's without considering any other potential development of lots on the lake. Or the environmental values of this area, which the DNR has testified to. This is why the County recently turned down a proposal for a 30 unit RV park next door, at Ducharmes. In 2002, the Frank's Lodge added 42 additional RV units. Since then another owner was granted a cluster development of 9 new lots. So, in. less than five years, the number of units on this tiny body of water has doubled. There isn't another lake in Ottertail County where this would be allowed, tolerated, or even conceivable. The Commission needs to take a firm stand and reject this proposal. The level of boat traffic now, much of which comes out of Frank's Lodge, is at the point where on peak weekends it is dangerous. Several of my neighbors told me at the last hearing that they simply no longer come down to their cabins in July and August because of the noise and fear of having their children run over. The lake is narrow, so boats that drive out from Frank's Lodge docks drive directly into the path of other boats going around the lake, endangering swimmers, jet skiers and fishing boats. My neighbors don't like to take their own children and grandchildren out tubing on weekends because the traffic is hazardous. Why should we be forced away from using our properties to accommodate a few owners who have commercial ambitions? I'm directly across from Frank's Lodge, so I'm well aware of the noise factor. The incessant sound of motorboats, jet skis circling in front of the Lodge, often drive me inside off the lake. Everybody has the right to enjoy themselves, the lake is small and there are hills on either side so it just gets to be too much. The lake is a public resource. The Franks have no right to monopolize it for their clients. Yet, this is what is happening. The shoreline ordinance asks the Board to consider these issues of density, traffic, and whether the proposed additions are suitable or compatible. Over-use of the lake by one party will have a cumulative impact on every owner, as well as the public who uses the lake through public access. And the wildlife, who require the resources of the lake for their very survival. I would like to see the Commission declare a moratorium of % rH.;. : development on the West Arm. To allow this permit would be a serious breach of the Commission's oversight responsibilities. Please help us protect our lake. Below is a brief background of the facility, and proposed changes to the facility. I. BACKGROUND In April 2003, Frank’s lodge applied for a CUP to expand their facility to 49 units. In August, 2003, the Planning Commission made a motion to approve the CUP, provided the following: 1. An engineer’s drawing is provided to verify that there is sufficient land area to allow for a maximum of 80 units. 2. Proposed Sites #6 and #12 are relocated to meet the 20’ road right of way set back. 3. 50’ lot setback requirement is met. 4. No additional boatlifts are allowed (may retain the existing 25). A copy of the current permitted 2003 facility map, and completed 2003 CUP application are provided in Attachment 1. A copy of a draft certificate of survey for Frank’s Lodge is provided in Attachment 2. II. PLANNING CONCEPTS Prior to preparing the proposed expansion details provided in the following section, Frank’s Lodge outlined provisions of the expansion with consideration of the effect on neighboring property owners; the general public that uses Star Lake; and the tenants of Frank’s Lodge. Frank’s Lodge recognizes that an expansion to their facility may ultimately increase the amount of recreational use on Star Lake. Frank’s Lodge sees increase in recreational activity as a benefit to the Otter Tail County. Belovi/ is some commentary regarding several reports and articles relating to recreational activities and boating activities. a. The “2004 Outdoor Recreation Participation Survey of Minnesotans” report prepared by the Minnesota Department of Natural Resources, 2005 (see http://files.dnr.state.mn.us/aboutdnr/reports/orsurvev2004 report.pdf for full report) indicates that the third largest deterrent to outdoor recreational participation is cost. Thirty-nine percent of Minnesotans interviewed indicated that cost was a deterrent. The first deterrent was time. The second deterrent was pests (mosquitos, etc.). Frank’s Lodge and the County cannot give prospective tourists more time, or remove the mosquitos. However, they can provide more affordable methods of recreation. Frank’s Lodge feels that their campground provides a cost effective alternative for Minnesotans who cannot afford to purchase lakeshore, and want to enjoy the outdoors in an area that provides lake access. b. The, “Boating in West Central Minnesota, Status in 2005 and Trends Since 1986” report prepared by the DNR, 2006 states that boating activity in our region has stayed the same, or slightly declined since 1986. The report indicates that approximately 90% of the boat and recreational users of the lakes in our area are satisfied or very satisfied with their experience. The number one problem identified by son for dissatisfaction was use of personal watercraft (jet skis). Seven percent of boaters believe that boating restriction and safety related requirements are inadequate. The number one preferred boating restriction was on jet skis. The report also indicated that the number of private and commercial accesses to lakes is dropping, and the number one complaint about access is that public accesses are inadequacies related to size. Frank’s Lodge believes that providing boat access and overnight mooring for their tenants reduces the strain on public accesses, and will not increase the number one problem with boat traffic Get skis). c. A newspaper article recently published in the Perham Enterprise (See Attachment 4) indicates that there is a shortage of campground facilities for recreational use of the lakes in this area. Frank’s Lodge believes thaE this article reiterates the aforementioned concept that recreational activity in the shoreland areas of Otter Tail County should be available to more people than just the private lakeshore property owners. PROPOSED EXPANSION In consideration of the planning concepts mentioned above, and the Otter Tail County Ordinances, Frank’s Lodge requests approval to add 48 units to its existing 49 unit facility. GENERAL LAYOUT 1. The proposed 48 units would include 28 Park Models, 14 RVs, and 6 primitive, tent only camp sites. A site map illustrating the proposed expansion is provided on Sheet No. 2 in Attachment 3. 2. The typical proposed dwelling unit size is approximately 40 feet by 50 feet. 3. Any units shown that are not 40 feet by 50 feet are in excess of 2,000 square feet in area. I 4. To accommodate other property owners on the lake, no additional lighting within Tiers 1-3 is proposed. The existing night lighting and any additional night lighting in Tiers 4 through 7 will have shields installed to minimize the visibility across Star Lake. 5. In consideration of neighboring land owners, and their own patrons, Frank’s Lodge has rules and guidelines included in their standard lease agreement. A copy of the lease agreement is provided in Attachment 5. It includes quiet hours, visiting hours, limitations on pets, and prohibits under age drinking. According to the standard lease, the season runs from May 1®*, to October 1®‘. 6. The proposed expansion will be located in an area that is currently wooded. It will be necessary to remove trees to provide space for the road, sanitary sewer and water lines, and the dwelling units. Frank’s Lodge will minimize the amount of trees removed. The remaining trees will provide screening to minimize the visibility of the expansion from Star Lake and neighboring property. 7. Based on correspondence with the Natural Resources Conservation Service (NRCS), lilac, nanking cherry, redosier dogwood, chokecherry, plum, green ash, sugar maple, silver maple, ponderosa pine and black hills spruce are specifically suitable for planting at Frank’s Lodge. Several large (10-15 feet in height) trees will be planted along the eastern border of the existing campground to provide additional vegetative barrier. 8. Primitive tent only campsites that are not vehicle accessible have been included to provide a more rounded camping experience. Flaving designated tent sites will allow families to occupy RV/Park Model camp sites, and allow their children to tent without violating the shoreland ordinances. 9. As an estimate for the quantity of excavation, there will be grading to construct the roads, and develop suitable pads on each dwelling for parking an RV, or Trailer. Based on the proposed grading provided in the attached drawings, approximately 9,000 cubic yards of excavation is proposed, more or less. REGULATORY COMPLIANCE I 1. A mandatory Environmental Assessment Worksheet (EAW) is required if the expansion includes 50 or more sites that are “accessible by vehicle.” The 6 primitive, tent only sites will not be accessible by automobile. Therefore, the proposed expansion includes 42 vehicle accessible units and is 8 units less than the mandatory EAW threshold. 2. The proposed expansion will add dwelling units in Tiers 4 through 7 of the facility. Most of the expansion will technically be outside of the Land and Resource Management District. No additional units are proposed for Tiers 1 through 3. 3. Because the project will disturb more than one acre, a storm water pollution prevention plan will be required for this site. Erosion control features will include a rock construction entrance, silt fence, and turf restoration as shown on the drawings. 4. Frank’s Lodge owns approximately 89 acres of property. A copy of the legal description is provided in Attachment 2. If the eastern 40 acres of the property are considered part of the Facility, the table below summarizes the Facility’s total unit capacity. The maximum units of the 40 acre area are 147, after wetlands, bluffs, and road right of way has been subtracted. The last permit for the facility provided 49 units for the facility based on a maximum design capacity of 80 units. For the enlarged facility boundary, and maximum design capacity of 147 units, a proportionate increase would result in 90 permitted units. Not including the primitive tents only sites, this is very similar to the proposed total facility capacity of 91 units. ROAD DESIGN I Construct approximately 2,100 lineal feet of road, 20 feet wide. The road will be crowned, and constructed with 4 inches of gravel. 1. I According to the proposed design, the maximum slope of the road will be less than 6%. The maximum allowable slope by Otter Tail County is 8%. A plan and profile of the proposed roads is provided in the drawings in Attachment 3. In addition to the two parking spaces provided within each dwelling unit, two additional parking lots are provided. Each parking lot is capable of parking over 20 cars, based on a 9’ x 18’ parking space per car, and 26’ driving lanes. 2. I I I Access to the new units will be from two roads that connect at both sides of Lodge Loop. All the approaches will be more than 700 lineal feet from Star Lake. The connections to the western portion of Lodge Loop are intended to reduce traffic on the eastern portion of Lodge Loop, and minimize noise affects on Star Lake. 3. I I D. LAKEFRONT FEATURES According to the draft certificate of survey provided in Attachment 2, the facility has 447 lineal feet of lakefront. A revised dock layout has been provided in Sheet No. 7. It specifies designated swimming areas, and boat mooring locations. The additional units will be allowed to use the available mooring locations and existing boat ramp at Frank’s Lodge to access Star Lake. 1,I 2.I 3. I I E. SEWER AND WATER RELATED Except for the tent areas, each dwelling will be connected to water and sanitary sewer. Due to winter conditions, an on-site soil survey has not been performed to verify suitability for a drain field. Due to the size of the facility, elevation from the lake, and recent soil surveys results in the area, the soils in this area are suitable for operating a drain field. As provided in Attachment 6, the Otter Tail County Soil Survey map shows that most of the soils in Tiers 3-7 are Snellman sandy loam, Lida-Two Inlets, or Kandota-Egglake series soils. All soils are well to excessively drained, with depth to water tables greater than 6 feet. 1. I 2. This is a conceptual drawing based on preliminary calculations. A complete sanitary sewage treatment system will be designed and permitted. A shared building for ADA compliant laundry, showers, and restrooms is proposed in Tier 4. Frank’s Lodge has submitted the building layout to the Minnesota Department of Health for approval. A drawing of the bath house is provided in Attachment 3. 3. 4. The existing well can be used to provide water service. However, Frank’s Lodge may install a second well. 5. IV.CONCLUSION Based on the information provided herein, the Frank’s Lodge application for a CUP for expansion has made special provisions to minimize impacts on neighboring property. The provisions include multiple access points, noise control, lighting control, and vegetative visual barriers. These are the basis for our rules. We wish to run a Park that is clean, safe and enjoyable for everyone. To obtain this look we need your cooperation. The following policies are for both your protection and ours. SEASONAL RATE for 2008 is $1,850.00. You will also be charged for your electrical usage. A deposit of $350.00 is due by October 1,2007. The balance is due by May 1,2008. Our season is May ls*‘ to October 1®*. The installation of our water system restricts use of RV sites before and after these dates because of freezing. The rate includes leaving your unit on site for the one-year contract period (October 1®‘ 2007 to October 1®*. 2008). uBOATLIFTS; A fee_of $50.00 per year will be charged. This fee includes placing and removing your lift each season. We are limited to 25 spaces. Boats and Pontoons cannot be beached. However we do have a limited number of dock slips available for rent. ?vj'y Each RV owner must have their own property and liability insurance while parked as a seasonal along with proof of RV ownership. All RV's must have current license plates and/or tabs displayed at all times. ADDITIONAL STRUCTURES: Additional structures (decks, storage sheds) must have prior approval from the management before installation to ensure proper placement. The sheds can be no larger than 20 SF and 6' high. Decks are limited to 200 SF. All park models and tip out/slide out units must be skirted within thirty days of set up. Management is responsible for lawn grooming of the campground. However, any leaseholder may use Frank's Lodge equipment to groom their respective space. Boat trailers and excess vehicles should be parked in the back parking area so it is easier to mow grass around the campsites. No screen tents or free standing screen structures are allowed. Page 2 Frank's Lodge and Campground Rules, guidelines & Seasonal Lease Agreement SITE CHANGES AND RV SALES: The management must approve any site changes between leaseholders. Any present seasonal occupant looking to purchase a park model, park trailer or a new RV unit must get management approval. This should be done prior to your purchase to eliminate any problems. Seasonal sites do not go with the sale of your unit. If you are selling your unit and leaving our park, make sure the buyers know this. If you are leaving our park and no one on our seasonal waiting list wants to purchase your RV, then the RV unit must be removed by October 1*‘. No park model or tip out/slid out unit will be allowed to move into the park if the unit is greater than 10 years old. No unit will be allowed to remain in the park when sold if it is greater than 25 years old. Exceptions will be handled on an individual basis. ? The RV sites are limited to use of the renter's immediate family ONLY. (Husband, wife, children, grandparents and grandchildren. All others will be considered as GUESTS. OVERNIGHT GUESTS wUI be charged $7.00 per night. By law, we are required to know who is on the premises so make sure all guests register their names and vehicle license numbers at the oi^ce. Make sure your overnight guests are aware of the Guest Fee. Renters are responsible to make sure that their guests know and abide by the park rules. Parents/Grandparents are responsible for the actions of their children/graudchildren. Please remember, no riding bikes, golf carts, scooters etc. after dark. No additional ATVs will be allowed. Golf carts are acceptable if used responsibly. Joy riding and creating dust in the campground is NOT acceptable. Please obey the posted speed limits. UNDER AGE DRINKING IS PROHIBITED. This policy will be strictly enforced! Renters of violating underage drinkers will be subject to immediate expulsion from the campground. TENTS for additional guests are not acceptable. Below is a brief background of the facility, and proposed changes to the facility.I I. BACKGROUNDIn April 2003, Frank’s lodge applied for a CUP to expand their facility to 49 units. In August, 2003, the Planning Commission made a motion to approve the CUP, provided the following: ! I I 1. An engineer’s drawing is provided to verify that there is sufficient land area to allow for a maximum of 80 units. I 2. Proposed Sites #6 and #12 are relocated to meet the 20’ road right of way set back. I 3. 50’ lot setback requirement is met. 4. No additional boatlifts are allowed (may retain the existing 25). A copy of the current permitted 2003 facility map, and completed 2003 CUP application are provided in Attachment 1. A copy of a draft certificate of survey for Frank’s Lodge is provided in Attachment 2.f II. PLANNING CONCEPTS Prior to preparing the proposed expansion details provided in the following section, Frank’s Lodge outlined provisions of the expansion with consideration of the effect on neighboring property owners; the general public that uses Star Lake; and the tenants of Frank’s Lodge. Frank’s Lodge recognizes that an expansion to their facility may ultimately increase the amount of recreational use on Star Lake. Frank’s Lodge sees increase in recreational activity as a benefit to the Otter Tail County. Below is some commentary regarding several reports and articles relating to recreational activities and boating activities. a. The “2004 Outdoor Recreation Participation Survey of Minnesotans” report prepared by the Minnesota Department of Natural Resources, 2005 (see http://files.dnr.state.mn.us/aboutdnr/reports/orsurvev2004 report.pdf for full report) indicates that the third largest deterrent to outdoor recreational participation is cost. Thirty-nine percent of Minnesotans interviewed indicated that cost was a deterrent. The first deterrent was time. The second deterrent was pests (mosquitos, etc.). Frank’s Lodge and the County cannot give prospective tourists more time, or remove the mosquitos. However, they can provide more affordable methods of recreation. Frank’s Lodge feels that their campground provides a cost effective alternative for Minnesotans who cannot afford to purchase lakeshore, and want to enjoy the outdoors in an area that provides lake access. II I fI I b. The, “Boating in West Central Minnesota, Status in 2005 and Trends Since 1986” report prepared by the DNR, 2006 states that boating activity in our region has stayed the same, or slightly declined since 1986. The report indicates that approximately 90% of the boat and recreational users of the lakes in our area are satisfied or very satisfied with their experience. The number one problem identified by son for dissatisfaction was use of personal watercraft (jet skis). Seven percent of boaters believe that boating restriction and safety related requirements are inadequate. The number one preferred boating restriction was on jet skis. The report also indicated that the number of private and commercial accesses to lakes is dropping, and the number one complaint about access is that public accesses are inadequacies related to size. Frank’s Lodge believes that providing boat access and overnight mooring for their tenants reduces the strain on public accesses, and will not increase the number one problem with boat traffic (jet skis). FI I I c. A newspaper article recently published in the Perham Enterprise (See Attachment 4) indicates that there is a shortage of campground facilities for recreational use of the lakes in this area. Frank’s Lodge believes that this article reiterates the aforementioned concept that recreational activity in the shoreland areas of Otter Tail County should be available to more people than just the private lakeshore property owners. Rules should be established to promote a peaceful and low impact environment for both the tenants at Frank’s Lodge, and the neighboring properties. I 5. Provide adequate parking and dwelling unit density to reduce congestion, and promote safety on public and private roads. III. PROPOSED EXPANSION In consideration of the planning concepts mentioned above, and the Otter Tail County Ordinances, Frank’s Lodge requests approval to add 48 units to its existing 49 unit facility. GENERAL LAYOUT The proposed 48 units would include 28 Park Models, 14 RVs, and 6 primitive, tent only camp sites. A site map illustrating the proposed expansion is provided on Sheet No. 2 in Attachment 3. 1. I The typical proposed dwelling unit size is approximately 40 feet by 50 feet. Any units shown that are not 40 feet by 50 feet are in excess of 2,000 square feet in area. 2.I I 3. To accommodate other property owners on the lake, no additional lighting within Tiers 1-3 is proposed. The existing night lighting and any additional night lighting in Tiers 4 through 7 will have shields installed to minimize the visibility across Star Lake. 4. f In consideration of neighboring land owners, and their own patrons, Frank’s Lodge has rules and guidelines included in their standard lease agreement. A copy of the lease agreement is provided in Attachment 5. It includes quiet hours, visiting hours, limitations on pets, and prohibits under age drinking. According to the standard lease, the season runs from May 1®*, to October 1®*. The proposed expansion will be located in an area that is currently wooded. It will be necessary to remove trees to provide space for the road, sanitary sewer and water lines, and the dwelling units. Frank’s Lodge will minimize the amount of trees removed. The remaining trees will provide screening to minimize the visibility of the expansion from Star Lake and neighboring property. Based on correspondence with the Natural Resources Conservation Service (NRCS), lilac, nanking cherry, redosier dogwood, chokecherry, plum, green ash, sugar maple, silver maple, ponderosa pine and black hills spruce are specifically suitable for planting at Frank’s Lodge. Several large (10-15 feet in height) trees will be planted along the eastern border of the existing campground to provide additional vegetative barrier. Primitive tent only campsites that are not vehicle accessible have been included to provide a more rounded camping experience. Flaving designated tent sites will allow families to occupy RV/Park Model camp sites, and allow their children to tent without violating the shoreland ordinances. As an estimate for the quantity of excavation, there will be grading to construct the roads, and develop suitable pads on each dwelling for parking an RV, or Trailer. REGULATORY COMPLIANCE A mandatory Environmental Assessment Worksheet (EAW) is required if the expansion includes 50 or more sites that are “accessible by vehicle.” The 6 primitive, tent only sites will not be accessible by automobile. Therefore, the proposed expansion includes 42 vehicle accessible units and is 8 units less than the mandatory EAW threshold. The proposed expansion will add dwelling units in Tiers 4 through 7 of the facility. Most of the expansion will technically be outside of the Land and Resource Management District. No additional units are proposed for Tiers 1 through 3. Because the project will disturb more than one acre, a storm water pollution prevention plan will be required for this site. Erosion control features will include a rock construction entrance, silt fence, and turf restoration as shown on the drawings. Frank’s Lodge owns approximately 89 acres of property. A copy of the legal description is provided in Attachment 2. If the eastern 40 acres of the property are considered part of the Facility, the table below summarizes the Facility’s total unit capacity. The maximum units of the 40 acre area are 147, after wetlands, bluffs, and road right of way has been subtracted. The last permit for the facility provided 49 units for the facility based on a maximum design capacity of 80 units. For the enlarged facility boundary, and maximum design capacity of 147 units, a proportionate increase would result in 90 permitted units. ROAD DESIGN Construct approximately 2,100 lineal feet of road, 20 feet wide. The road will be crowned, and constructed with 4 inches of gravel. 1. I According to the proposed design, the maximum slope of the road will be less than 6%. The maximum allowable slope by Otter Tail County is 8%. A plan and profile of the proposed roads is provided in the drawings in Attachment 3. In addition to the two parking spaces provided within each dwelling unit, two additional parking lots are provided. Each parking lot is capable of parking over 20 cars, based on a 9’ x 18’ parking space per car, and 26’ driving lanes. 2. I Access to the new units will be from two roads that connect at both sides of Lodge Loop. All the approaches will be more than 700 lineal feet from Star Lake. The connections to the western portion of Lodge Loop are intended to reduce traffic on the eastern portion of Lodge Loop, and minimize noise affects on Star Lake. 3. I( I D. LAKEFRONT FEATURES According to the draft certificate of survey provided in Attachment 2, the facility has 447 lineal feet of lakefront. A revised dock layout has been provided in Sheet No. 7. It specifies designated swimming areas, and boat mooring locations. 1. 2. I The additional units will be allowed to use the available mooring locations and existing boat ramp at Frank’s Lodge to access Star Lake. 3. I E. SEWER AND WATER RELATED Except for the tent areas, each dwelling will be connected to water and sanitary sewer. Due to winter conditions, an on-site soil survey has not been performed to verify suitability for a drain field. Due to the size of the facility, elevation from the lake, and recent soil surveys results in the area, the soils in this area are suitable for operating a drain field. As provided in Attachment 6, the Otter Tail County Soil Survey map shows that most of the soils in Tiers 3-7 are Snellman sandy loam, Lida-Two Inlets, or Kandota-Egglake series soils. All soils are well to excessively drained, with depth to water tables greater than 6 feet. 1. With resorts closing and selling off, and virtual­ ly no remaining lakcshore available for recreation resort development, availability of camping would expand the lodging mix in the area, said Rieber. Following the December fire at the Cactus RV pgrk, and the subsequent death of its developer. Chuck Minge, the future of that project is uncer­ tain. The Cactus facility would have met some of the RV demand through the private sector. But var­ ious private sector proposals have not materialized over the years, noted Rieber. He believes a munic­ ipal project, on city land, may be necessary to make bring an RV park from idea to reality. This fee includes placing and removing your lift each season. We are limited to 25 spaces. Boats and Pontoons cannot be beached. However we do have a limited number of dock slips available for rent. I I I I I I Each RV owner must have their own property and liability insurance while parked as a seasonal along with proof of RV ownership. All RV's must have current license plates and/or tabs displayed at all times.I ADDITIONAL STRUCTURES; Additional structures (decks, storage sheds) must have prior approval from the management before installation to ensure proper placement. The sheds can be no larger than 20 SF and 6* high. Decks are limited to 200 SF.I I All park models and tip out/slide out units must be skirted within thirty days of set up. I Management is responsible for lawn grooming of the campground. However, any leaseholder may use Frank's Lodge equipment to groom their respective space. Boat trailers and excess vehicles should be parked in the back parking area so it is easier to mow grass around the campsites.^1 I No screen tents or free standing screen structures are allowed. Any present seasonal occupant looking to purchase a park model, park trailer or a new RV unit must get management approval. This should be done prior to your purchase to eliminate any problems. Seasonal sites do not go with the sale of your unit. If you are selling your unit and leaving our park, make sure the buyers know this. If you are leaving our park and no one on our seasonal waiting list wants to purchase your RV, then the RV unit must be removed by October l“. No park model or tip ouf/slid out unit will be allowed to move into the park if the unit is greater than 10 years old. No unit will be allowed to remain in the park when sold if it is greater than 25 years old. Exceptions will be handled on an individual basis. I I I I The RV sites are limited to use of the renter's immediate family ONLY. (Husband, wife, children, grandparents and grandchildren. All others will be considered as GUESTS. OVERNIGHT GUESTS wUI be charged $7.00 per night. By law, we are required to know who is on the premises so make sure all guests register their names and vehicle license numbers at the office. Make sure your overnight guests are aware of tht Guest Fee. Renters are responsible to make sure that their guests know and abide by the park rules. Parents/Grandparents are responsible for the actions of their children/grandchildren. Please remember, no riding bikes, golf carts, scooters etc. after dark. No additional ATVs will be allowed. Golf carts are acceptable if used responsibly. Joy riding and creating dust in the campground is NOT acceptable. Please obey the posted speed limits.
