John Frank Application for Conditional Use Permit ■;

Applicants operate a resort and campground on Star Lake, which has been a family
operated resort for nearly 75 years. The resort consists of a home dwelling, six cabins
(one also used as summer office), and four campsites adjacent to the cabins in the first
tier, six campsites south of the town road in the second tier, and sixteen campsites north
of the road in the second and third tiers. There is currently a dispute with Otter Tail
County about the licensure of the four campsites adjacent to the lake. Although
applicants have had seasonal dwellings on those sites every year since prior to the
enactment of the county shoreland ordinance, the county takes ithe position that those
campsites are not and must be licensed, citing a 1977 conditional use permit 'with total
licensure for 22 units, not 26 units, in which the application materials did not mention
those 4 existing campsites.!
Applicant proposes to remove those four campsites near the lake in the first tier.
Applicant seeks current licensure for the following: Dwelling and six cabins currently in
the first tier which will remain. Fifteen campsites (six existing south of road plus nine
existing north of road) which will remain in the second tier. Seven existing plus nine
additional campsites in the third tier. Eleven additional campsites in the fourth tier. A
total of 49 units.!

Applicants property consists of approximately 92 acres with 450 feet of shoreline in
Section 9 of Star Lake Township on the West Arm of Star Lake. Their resort has
received praise &om customers and the tourism industry for its operations.

Bruce A Jackim - Tabled to July 9, 2003:
A Conditional Use Permit Application requesting: To repair and reduce severe terrain cuts
created by previous road construction of Devils Lake Road. Create more natural contours
suitable to the locale and to allow direct access to Devils Lake Road in proposed plat.
Total cubic yards are approximately 590 cu. yds. No wetlands are affected. (Maps &
diagrams are availabie for viewing at Land & Resource Mgt. Office.) The property is
described as Nedberg-Nye Survey of G.L. 1, 2 & 3 no Lk. frt. (Lots 97 - 105), Section 1 of
Edna Township; Devils Lake (56-245), GD.
Robert Bigwood (Attorney) represented the Application. Mr. Bigwood indicated that the
Applicant wishes to be tabled to July 9, 2003. This would allow the Conditional Use Permit
Appiication be considered along with a preliminary plat (not yet filed).
Duane Heley spoke against removing the existing lake road & expressed concerns
regarding safety (sight distance), erosion & the inconvenience for 3 adjacent lots. Jerry
Bernauer expressed concerns regarding the lawsuits from the previous project & erosion
(water run-off). Scott Sem expressed concerns regarding water run-off & erosion. Leon
Koczer (Viking Gas Transmission) expressed concerns regarding the their pipeline and
requested notification of the project. Todd Baumgartner expressed concerns regarding the
water run-off & its effect on his lot.
Motion: A motion by Lachowitzer, second by Trites to table (applicant agreed to waive the
60 Day Rule), to July 9, 2003 in order to allow the Conditional Use Application be
considered along with a Preliminary Plat. Voting: All Members in favor.
Break: At 7:55 P.M., the Commission took a 10 minute break.
Mark Walz - Approved With Conditions:
A Conditional Use Permit Application requesting: To allow 855 c.y. of fill over
approximately 8925 s.f., up to 2’ - 0” deep. Details available for viewing at Land &
Resource Management Office. The property is described as Lot 9 BIk 1 McDonald Shores,
Section 20 of Edna Township; Big McDonald Lake (56-386), RD.
Steve Rose (Nor-Son Inc) and Mark Walz represented the Application.
Motion: A motion by Schwartz, second by Sha to approve provided: 1. The Applicant
complies with the Township’s request (letter dated May 20, 2003). 2. Surface water run
off must be directed towards the road ditch and away from the proposed building. 3.
Surface water run-off must be directed away from the neighbors, toward the road ditch and
not pond onsite. Voting: All Members in favor.

presented. Voting: All Members in favor.
Girard Township - Approved With A Condition:
A Conditional Use Permit Application requesting: Widen existing road (Lake Ethel Road) to
provide approx. 25’ subgrade with 3:1 inslopes within public right-of-way from C.R.5 W & S
to 265“' Street (1.3 miles). Aggregate base and bituminous paving. Approx. 4,000 cubic
yards excavation. The property is described as Lake Ethel Road from C.R.5 W & S
approx. 1.3 miles (7,000 LF) to 265"' St., Sections 4, 5 & 8 of Girard Township; Lake Ethel
(56-193), RD.
Jeff Stabnow (Township Engineer) represented the Application.

Gary Gunderson questioned the width of the existing road & the reason for widening the
road.
Motion: A motion by Sha, second by Estes to approve as presented provided appropriate
erosion control methods are implemented. It should be noted that the Applicant is aware of
the requirement for a Stormwater Permit from the MPCA. Voting: All Members in favor.

Jeffrey Johnson spoke against the campsites, he indicated that he is speaking for other lot
owners of D & J Estates. He expressed concerns regarding wildlife, the narrowness of the
arm of the lake & safety. Glen Shaw expressed concerns regarding the shallowness of the
lake, habitat of wildlife, boat traffic & safety. He had questions regarding the number of
docks, boats & lifts that is allowed by the Ordinance.

License Center Promotion
Motion by Mosher, second by Lee, and unanimously carried to approve the promotion of
License Center Specialist, Tracy Williams, (Grade 10) to Senior License Center Specialist
(Grade 12) based upon obtaining a higher level of work performance effective July 1, 2003.
Exempt Permit
Motion by Lee, second by Mosher, and unanimously carried to approve, with no waiting
period, the LG220 Application for Exempt Permit as submitted by the Pelican River
Pheasants Forever for an event scheduled for September 20, 2003, at the Blue Water
Restaurant and Sports Bar.
Housing & Redevelopment Authority
HRA Executive Director, Jeff Gaffaney, provided a handout requesting the County to levy
approximately $200,000 for operational and program needs for the Otter Tail County HRA
beginning CY2004. A list of county and city HRA’s that are currently levying for housing
purposes was included. Housing Specialist, Dennis Christenson, briefed the Board on HRA’s
programs and problems with some MHFA eligibility requirements. Further research regarding
anticipated tax rates for 2004 is needed to determine the impact of this request.
Highway Contracts
Motion by Lee, second by Mosher, and unanimously carried to authorize the Chair’s
signature to execute a contract between the County of Otter Tail and Robert R. Schroeder
Construction, Inc. for S.P. 56-696-02 & S.A.P. 56-696-03, Bridge No. 91932 in the City of
Pelican Rapids. This motion is subject to the approval of the County Attorney.
Motion by Froemming, second by Block, and unanimously carried to authorize the Chair’s
signature to execute a contract between the County of Otter Tail and All Building Corporation
for Phelps Mill Roofing work.
Recess & Reconvene
At 11:10 a.m.. Chair Lee declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 11:15 a.m.
Planning Commission Recommendations
Conditional Use Permit - Frank’s Lodge & Campground/John S. and Lucille C. Frank:
Motion by Lee, second by Mosher, and unanimously carried to approve a Conditional Use
Permit for expanding the number of dwelling units in the campground/resort with conditions
as recommended by the Planning Commission. The property is described as NV2 NW% Lots
4 & 5 ex Star Lake Beach & ex trs...(91.26 AC) Section 9 of Star Lake Township; Star Lake
(56-385).
Preliminary Plat and Conditional Use Permit - “Mullen’s Country Courf'A/incent Mullen:
Motion by Froemming, second by Nelson, and unanimously carried to approve a Preliminary
Plat consisting of 3 single family residential lots and a Conditional Use Permit to construct a
road, with conditions as recommended by the Planning Commission. The property is
described as Pt GL 3 & 4 & Pt NE% NW% (60.38 AC), Section 15 of Maine Township; Round
Lake (56-476).

Motion: A motion by Trites, second by Sha to table for the preparation of an
Environmental Assessment Worksheet (EAW) as it is mandatory due to the number of
units being proposed. Voting Yes: Bergerud, Boyer, Lachowitzer, Maske, Sha, Trites &
Zimmerman. Voting No: Olson & Schwartz.
Break: At 10:39 P.M., the Commission took a 4 minute break.
No Formal Action: Bill Kalar discussed with the Commission a letter that was referred to
the Planning Commission by the County Board of Commissioners. The letter was from
Tom Ebacher and recommended 7 changes to the Shoreland Management Ordinance.
No formal action was taken.
No Formal Action: Bill Kalar discussed with the Commission a letter that is addressed
to the Secretary, Planning Commission. The letter was from Jennie’s Nature Preserve,
Inc. which opposed the granting of Gene Ernst & David McFarland a permit to widen an
existing roadbed. Mr. Kalar indicated that he is not aware of any Application being filed
for this reguest. No formal action was taken.
Frank’s Lodge - Denied Modified Calculation: Bill Kalar indicated that Frank’s Lodge,
Star Lake (56-385), has reguested the Planning Commission allow the 13 existing units
in the first tier be included in the calculations rather than the 6 allowed by the Ordinance.
Motion: A motion by Bergerud, second by Lachowitzer to deny the modified calculation
& follow with the language in the Shoreland Management Ordinance.. Voting: All
Members in favor.
Adjourn: At 10:55 P.M., Chairman Olson set the meeting, the next meeting is scheduled
for December 10, 2003.

Re: Proposed Expansion of Frank’s Lodge and Camp Ground,
West Arm Star Lake
I am writing to express serious concerns and offer a constructive suggestion
regarding the proposed expansion of Frank’s Lodge, on the West Arm of Star
Lake. In the your deliberations, I urge the Commission give fair consideration to
the cumulative effect of recent past actions and pending additional proposals for
the West Arm of Star Lake:
• the Frank’s 2003 expansion to 49 units,
• the 2006 single family subdivision approved across the bay near the Co. 41
bridge, and
• the pending 2007 application to establish the duCharme campground directly
adjacent to Frank’s.
I urge the Planning Commission to consider the following factors:
• The West Arm of Star Lake is essentially a small lake by itself, connected to
the rest of Star Lake only by a very narrow (but important) channel under
County Highway 41.1 would estimate the lake surface area west of the #41
bridge to be approximately 300 acres.
• The West Arm of Star Lake has many characteristics of a river channel in
terms of its ability to safely handle water surface traffic and recreation.
• If it were not for historical reasons and the channel connection to the “main
lake”, the West Arm would certainly be considered a separate body of water
and be classified as a small and sensitive “Natural Environment” lake by the
DNR.
• With its long narrow and winding shape, the West Arm’s ratio of miles of
shoreline to acres of surface water is very high. This should be factored in
determining acceptable density of existins and development and
re-development, regardless of DNR lake classification. In particular, the
existing resort/campground’s number of docks and lifts should be
monitored and controlled.
• The West Arm includes substantial and extensive “sensitive” aquatic
vegetation and habitat important to wild life and the lake’s fishery. The
cumulative effect of the additional density on this small body of water is a
critical factor.
• The extensive and (seemingly) unrestricted use of individual docks and lifts
that dot the shoreline on the lake, including the West Arm, should be
avoided if at all possible.
• The pressure to over-develop this sensitive bay is intense. Please keep in
mind the precedence that will be set as you consider the current
application(s) and the further development of other near-by properties.
Recommendation: As a standard benchmark, I believe the Planning Commission
should apply “Natural Environment” density and multiplier criteria to all
applications with respect to West Arm Star Lake development. The one factor
that the entire audience (public, applicants and County officials) UQreed upon at
November 14 meeting (regarding the duCharme application) was that the West
Arm of Star Lake is distinctly different, more sensitive and more threatened by
over-development than the main body of the lake (classified General
Development). The County needs to be as diligent with the “density creep” and
expansion of existing permitted uses as it is with new applicants.
I support the basic premise of property owner rights to develop their property in a
way that respects and minimizes the impact on others. With regard to the West
Arm of Star Lake, I believe the only consistent, fair and practical way for the
Planning Commission to balance property owner rights with public waters
preservation and safety is to apply the most conservative “Natural Environment”
standards with respect to density and tier multiplier factors. West Arm
development should not be administered using “General Development” criteria as
the “starting point” for negotiations between the County and applicants.
I urge the commission to consider the Frank’s application in that context.

First of all, thank you for the work that you do with regards to the delicate situations that
arise when it comes to caring for our land and waters. Extreme balance must be required to
let people realize their dreams and yet protect the .state of nature, enhancing the wildlife and
resources around us that we so greatly treasure.
I must admit, the last meeting was truly a learning experience. It was interesting to see the
process in action and the diligence put forth to make the experience fair to all. It is my hope
that you will seek a fair result in the outcome of our west arm of Star Lake.
It was my feeling at the last meeting that the trailer park proposed by the DuCharmes was
something that just wouldn't fit in on our small arm of the lake. Now, T have received notice,
and thank you for notifying me, of the proposed permit to add more units at Frank's I,odge.
Could someone on the commission tell me just when we may reach the point of .saturation?
The we.st arm of Star is minimal in size compared to the main lake. Not only do we get
increa.sed boat traffic from the main lake on windy days, but now proposals are on the table
that could conceivably add almost 100 more watercraft to this small etrea of the lake. The
DNR website states the following about Star T-ake: “Stands of hardstem bulrush,wild rice,
and common cattail are scattered along the shoreline of the entire lake; however, the largest
stands are located in the south bay and the West Ann. Aquatic plants provide valuable fish
and wildlife habitat, and are critical for maintaining good water quality. They protect
shorelines and lake bottoms, and can actually absorb and break down polluting chemicals.
These plants also provide spawning areas for fish such as northern pike, largemouth bass, and
panfish. To maintain the excellent water quality and angling that this lake has to offer, it is
imperative to preserve the water quality of the aquatic habitat.”
I know most of my neighbors on the west arm. and I also know tlicm to be all good stewards
of the land and water. liacb of these individuals respects the environment and strives to
maintain a light footprint. Footprint, this is a term that should be brought up more often.
Although we each as cabin owners have our own little piece of paradise at Star Lake, our
footprint, or impact on the environment is minimal at best. Mo.st of us are sportsmen or
enjoy wildlife, so we strive to keep the surrounding area as natural as possible.
When looking at the proposed trailer park and the density of these units in a small aiesi, it
would seem logical to me that the water, shoreline and land environment are going to suffer
severe consequences. In other words, this would be a very large footprint, perhaps too large
for llie west arm to handle.
When looking through the Land Ordinance Booklet in the Conditional Usage Section, 1 see
there are 12 points listed that are to be satisfied by the applicant. Number one
reads,’’Compatability with the surrounding aiea-both water and land”. Personally, 1 don’t see
how 45 trailers sitting in a field is compatible with the surrounding area. When passing
under the Hwy. 41 bridge by boat, or going over the bridge by car, your attention would be
immediately drawn to this lU'ea. To me, this in itself would support the decision to deny this
conditional use permit. Need it be necessary to look at the other 11 points?
There may be a place for a trailer park, and there may be a place for a resort to add 42 more
units, but it shouldn’t be on the small acreage of the west arm of Star Lake. Again, I thank

Re: John and Kathy Frank, RCU Development on Star Lake
Dear Chairman Bert Olson and the Honorable Members of the Ottertail
Planning Commission,
This proposal for development at Frank’s Lodge on the West Arm of
Star Lake is not suitable for our lake under the regulations for
conditional use of the shoreline management ordinance. It creates a
density factor that threatens our wildlife, our property values, and the
quality of life on the West Arm.
Franks' Lodge already has 42 units, plus cabins, a huge footprint on a
small body of water, the West Arm, an extension of Star Lake.
The West Arm is one of the smallest self-contained bodies of water
under your jurisdiction. This part of the lake, is, as you know, very
narrow, less than a quarter of a mile across. Boats going up one side
of the lake are just a few yards from boats coming down the other.
The lake is about 160 acres of water. The area under most pressure of
development is all in the northeast corner.
In 2002, the commission granted Frank's Lodge 42 additional RV units.
In 2006, you authorized another 9 unit development across the lake.
In 2007, the DuCharmes proposed for a 45 unit RV Park addition right
next door to Franks.
In less than five years, the number of units on this tiny body of water
has doubled, and, if you let the Franks have their way it would double
again, increased population on the lake by 200%.
This means renters at Frank's would outnumber owners on the West
Arm 2 to 1. There isn't another lake in Ottertail County where this
would be allowed, tolerated, or even conceivable.
We have to draw a line somewhere. The a pace of development on the
West Arm is simply too much, too fast. The Commission needs to take
a firm stand and reject this proposal.
At the last hearing, I learned from my neighbors about the effect of the
earlier Frank's Lodge expansion. The addition of 42 RV units had an
impact beyond what the neighbors could anticipate. Boat traffic went
up significantly. The level of boat traffic now is at the point where
some weekends it is dangerous.
Several of my neighbors told me at the last hearing that they simply no
longer come down to their cabins in July and August.
Boats drive out from Frank's Lodge docks directly into the path of
other boats going around the lake, endangering swimmers. Jet skiers
and fishing boats.
My neighbors don't like to take their own children and grandchildren
out tubing on weekends because the traffic is hazardous.
Why should we be forced away from using our properties to
accommodate a few owners who have commercial ambitions?
The problem of density in that part of the lake is multiplied by the fact
that we also face another 45 unit proposal on the Ducharme property.
Both are close to the outlet that leads to the main body of the lake,
where boats from the eastern body of the lake are also coming in and
out. This creates a hazard.
I'm directly across from Frank's Lodge, so I'm well aware of the noise
from unrestrained boat traffic. Every weekend the incessant sound of
motorboats. Jet skis circling in front of the Lodge, drive me inside off
the lake. Everybody has the right to enjoy themselves, the lake is small
and it Just gets to be too much.

What about the impact on wildlife? The DNR has determined that
increased human population on a lake has a direct negative effect on
the fish population.
These new units are being proposed in an area which also contains
sensitive habitat area where the loons nest and raise their young.
A huge RV park is simple not compatible with such a small lake.
Frank's Lodge is vastly over-reaching. They need a firm "No."
The lake is a public resource. The Franks have no right to monopolize
it for their clients. Yet, this is what is happening. Property owners on
the West Arm are being squeezed. No wonder we are upset and angry.
If Ottertail County does not set firm guidelines, it risks sending a
signal to unscrupulous and greedy developers, who may have less
stake in our area than the Franks, that we are incapable or unwilling to
protect our lakeshore and existing home owners from incompatible
use and development.
Each decision the Board makes affects the future character of our lake.
These developments add up. Over-use of the lake by one party will
have an impact on every owner, as well as the public who uses the lake
through public access. And the wildlife, who require the resources of
the lake for their very survival.
A crowding indicator which is used by Douglas County, to the north,
advises at least 2.5 acres per potential unit on a general development
lake.
With a rough estimate of 160 acres in the West Arm, I understand that
to mean we could support about 63 units, total, on the lake. Frank's
Lodge is asking to have 101 units, themselves, alone. That's before
you count in the other property owners on the lake, and the
Ducharme's RV Park proposal.
Ottertail County doesn't use a crowding indicator, I understand, but we
need some way to put a number to the problem of density. By this
equation, Franks' Lodge is already well over what's been advised.
Without adding ANY more units to the lake.

When existing owners tell me they can't use their own properties, we
are past the point of reasonable density on the West Arm of Star Lake.
The lake is too small, the habitat is too sensitive, the development is
happening at a pace and rate that is disproportionate to the acreage
and character of the lake.
The character of our lake matters deeply to us. Many of us chose this
lake over others because it had the qualities of having lots of wildlife
and habitat. We've been supportive of the resort, but enough is
enough.
It's very likely that more traffic will upset and drive away the loons off
the east side of the lake. At worst, someone could end up getting hurt
or killed.
Bad feelings between neighbors, anger, our property values going
down because of the crowding. That's what this means. Our lake
getting a reputation for being overused or one that anyone can
exploit.
If you took a simple democratic vote of property owners on the West
Arm, you would get a resounding no to this development.
I would like to see the Commission declare a moratorium of
development on the West Arm. The Planning Commission needs time
to study the impact of existing development. To really understand our
situation, and get a sense of what's happening to our lake, the
Commission needs to assess the lake in the summer on a weekend,
especially a peak weekend like the 4th of July.
If the County had someone in to do a noise assessment, I believe you
would find the decibel level of current boat traffic on a weekend to be
disturbing. The Planning Commission needs some way to evaluate
traffic patterns on this lake, and assess what is safe. We need an
environmental review to evaluate impact of increased population
impact on an area with a lot of wildlife, many springs, and a high water
table. Current residents deserve to have those numbers that will give
us some way to measure the potential impact on wildlife and fishing.

Not to ask for this would be a serious breach of the Commission's
oversight responsibilities.

Subpart 1. Prohibitions. If an EAW or EIS is required for
a governmental action under parts 4410.0200 to 4410.6500, or if

complies with the requirements of subparts 1 and 2 of that part,
a project may not be started and a final governmental decision,,.,,

governmental unit shall not take any action with respect to the
project, including the acquisition of property, if the action
will prejudice the ultimate decision on the project, until a
petition has been dismissed, a negative declaration has been
issued, or until the final EIS has been determined adequate by
the RGU or the EQB, unless the project is an emergency under
subpart 9 or a variance is granted under subparts 4 to 8. An
action prejudices the ultimate decision on a project if it tends
to determine subsequent development or to limit alternatives or
mitigative measures.

may not exceed ten percent of the applicable EIS threshold, by
means of the procedures of parts 4410.1200 to 4410.1700 instead
of the procedures of parts 4410.2000 to 4410.2800.

The local governmental unit is the RGU for construction of
a permanent or potentially permanent residential development of:
100 or more unattached or 150 or more attached
units in an unsewered unincorporated area or 400 unattached
units or 600 attached units in a sewered unincorporated area;
A.
400 unattached units or 600 attached units in a
city that does not meet the conditions of item D;
B.
400 unattached units or 600 attached units in a
city meeting the conditions of item D if the project is not
consistent with the adopted comprehensive plan; or
C.
1,000 unattached units or 1,500 attached units in
a city within the seven-county Twin Cities metropolitan area
that has adopted a comprehensive plan under Minnesota Statutes,
section 473.859, or in a city not located within the
seven-county Twin Cities metropolitan area that has filed with
the EQB chair a certification that it has adopted a
comprehensive plan containing the following elements:

Dear Bill:
On behalf of Mr. and Mrs. John and Kathleen Frank, Interstate Engineering is providing
this letter and attached drawings as information required for a conditional use permit
(CUP) application for expanding Frank’s Lodge to serve 101 dwelling units. Below is a
brief background of the facility, and proposed changes to the facility.
BACKGROUND
In April 2003, Frank’s lodge applied for a CUP to expand their facility to 49 units. In
August, 2003, the Planning Commission made a motion to approve the CUP, provided
the following:
1. An engineer’s drawing is provided to verify that there is sufficient land area to
allow for a maximum of 80 units.
2. Proposed Sites #6 and #12 are relocated to meet the 20’ road right of way set
back.
3. 50’ lot setback requirement is met.
4. No additional boatlifts are allowed (may retain the existing 25).
A copy of the current permitted 2003 facility map, and completed 2003 CUP application
are provided in Attachment 1.

Prior to preparing the proposed expansion details provided in the following section,
Frank’s Lodge outlined provisions of the expansion that would minimize the effect on
neighboring property owners; the general public that uses Star Lake; and the tenants of

1. The proposed units should be located to minimize visibility from Star Lake.
2. The proposed units should be located to minimize noise, traffic, and dust effects
on Star Lake and neighboring properties.
3. Rules should be established to promote a peaceful and low impact environment
for both the tenants at Frank’s Lodge, and the neighboring properties.
4. Provide adequate parking and dwelling unit density to reduce congestion, and
promote safety on public and private roads.
PROPOSED EXPANSION
In consideration of the planning concepts mentioned above, and the Otter Tail
County Ordinances, Frank’s Lodge requests approval to add 52 units to its existing
49 unit facility. Below is a brief summary of the expansion:
1. The proposed expansion will add dwelling units in Tiers 4 through 7 of the facility.
Most of the expansion will technically be outside of the Land and Resource
Management District. No changes are proposed for Tiers 1 through 3. No
additional dock, waterfront structures, or buildings are proposed.
2. Frank’s Lodge owns approximately 89 acres of property. A copy of the legal
description is provided in Attachment 2. If the following are considered:
a. All 89 acres are considered part of the Facility
b. 7.5 acres are in Tiers 1 and 2 (where 24 units are currently permitted)
c. 4.5 acres are assumed unusable in Tiers 3-7 due to wetlands and road
right of way
Then, the maximum number of dwelling units according to the ordinance is
approximately 359 units are allowed on the entire facility. In 2003, Frank’s Lodge
received a permitted expansion for a total of 49 units, based on demonstration
that the facility was capable of 80 units based on the current regulations. If this is
considered a “safety factor” of 1.6 by dividing the maximum capacity by the
permitted units, this current application would propose a safety factor 359 divided
by 102, equaling 3.5.
j 3. 10 of the proposed dwelling units are tent only sites. 42 of the proposed dwelling
units are for Recreational Camping Units (RCU), and manufactured homes. At
this time the proposed dwelling units are not specified as RCU or manufactured

homes. If each dwelling units cannot be capable for use by either class of
dwelling, a mixture of them is proposed.
To accommodate other property owners on the lake, no additional lighting within
Tiers 1-3 is proposed. The existing night lighting and any additional night lighting
in Tiers 4 through 7 will have shields installed to minimize the visibility across
Star Lake.

Construct approximately 2,100 lineal feet of road, 20 feet wide. The road will be
crowned, and constructed with 4 inches of gravel. Maximum slopes will not
exceed 8%. A plan and profile of the proposed roads is provided in the drawings
in Attachment 3.

Because the project will disturb more than one acre, a storm water pollution
prevention plan will be required for this site.
The typical proposed dwelling unit size is approximately 40 feet by 50 feet. Any
units shown that are not 40 feet by 50 feet are in excess of 2,000 square feet in
area.

8. In addition to the parking space provided within each dwelling unit, two additional
parking areas are provided. Each one is capable of parking over 20 cars, based
on a 9’ X 18’ parking space per car, and 26’ driving lanes.
9. Except for the tent areas, each dwelling will be connected to water and sanitary
sewer. The existing well can be used to provide water service. However,
Frank’s Lodge may install a second well. A new septic tank and drain field, or
multiples there of will be constructed at the locations shown on the drawing. A
shared building for laundry, showers, and restrooms is proposed in Tier 4. A
sketch of the drawing provided by Frank’s Lodge is in Attachment 4.
10. In consideration of neighboring land owners, and their own patrons, Frank’s
Lodge has rules and guidelines included in their standard lease agreement. A
copy of the lease agreement is provided in Attachment 5. It includes quiet hours,
visiting hours, limitations on pets, and prohibits under age drinking. According to
the standard lease, the season runs from May 1®', to October 1®‘.
11. Access to the new units will be from two roads that connects at both sides of
Lodge Loop. All the approaches will be more than 700 lineal feet from Star Lake.
The connections to the western portion of Lodge Loop are intended to reduce
traffic on the eastern portion of Lodge Loop, and minimize noise affects on Star
Lake.

and water lines, and the dwelling units. Frank’s Lodge will minimize the amount
of trees removed. The remaining trees will provide screening to minimize the
visibility of the expansion from Star Lake.
13. The space within the facility property directly west of the proposed dwelling units
will be, “open space” as defined and required by the Ordinance.
14. As an estimate for the quantity of excavation, there will be some grading to
construct the roads, and develop suitable pads on each dwelling for parking an
RV, or Trailer. Based on the proposed grading provided in the attached
drawings, approximately 9,000 cubic yards of excavation is proposed, more or
less.
15. The additional units will be allowed to use the existing boat ramp at Frank’s
Lodge to access Star Lake.
16. Due to winter conditions, an on-site soil survey has not been performed to verify
suitability for an ISTS system. Due to the size of the facility, elevation from the
lake, and recent soil surveys results in the area, this should not be a problem. As
provided in Attachment 6, the Otter Tail County Soil Survey map shows that most
of the soils in Tiers 3-7 are Snellman sandy loam, Lida-Two Inlets, or Kandota-
Egglake series soils. All soils are well to excessively drained, with depth to water
tables greater than 6 feet.

Rules, Guidelines and Seasonal Lease Agreement
As a Resort and Campground we are regulated by county and state laws. These are
the basis for our rules. We wish to run a Park that is clean, safe and enjoyable for
everyone. To obtain this look we need your cooperation. The following policies are
for both your protection and ours.
SEASONAL RATE for 2008 is $1,850.00. You will also be charged for your
electrical usage. A deposit of $350.00 is due by October 1,2007. The balance is due
by May 1,2008. Our season is May Is*" to October 1**. The installation of our water
system restricts use of RV sites before and after these dates because of freezing.
The rate includes leaving your unit on site for the one-year contract period
(October 1** 2007 to October 1*‘. 2008).
BOATLIFTS: A fee of $50.00 per year will be charged. This fee includes placing
and removing each season.
SLIPS are available for $75.00 per season. Boats'and pontoons will not be allowed
to be beached.
$
Each RV owner must have their own property and liability insurance while parked
as a seasonal along with proof of RV ownership. All RV's must have current license
plates and/or tabs displayed at all times.
ADDITIONAL STRUCTURES: Additional structures (decks, storage sheds) must
have prior approval from the management before installation to ensure proper
placement. The sheds can be no larger than 20 SF and 6' high. Decks are limited to
200 SF.
All park models and tip out/slide out units must be skirted within thirty days of set
up.
Management is responsible for lawn grooming of the campground. However, any
leaseholder may use Frank's Lodge equipment to groom their respective space.
Boat trailers and excess vehicles should be parked in the back pai kiug area so it is
easier to mow grass around the campsites.

No screen tents are allowed. Manufactured-screened structures that sit on your
deck are allowed; otherwise no permanent screened structures are permitted.
SITE CHANGES AND RV SALES: The management must approve any site
changes between leaseholders. Any present seasonal occupant looking to purchase
park model, park trailer or a new RV unit must get management approval. This
should be done prior to your purchase to eliminate any problems.
Seasonal sites do not go with the sale of an RV. If you are selling your unit and
leaving our park, make sure the buyers know this. If you are leaving our park and
no one on our seasonal waiting list wants to purchase your RV, then the RV unit
must be removed by October 1*‘.

No park model or tip out/slid out unit will be allowed to move into the park if the
unit is greater than 10 years old. No park model or tip out/slid out unit will be
allowed to remain in the park when sold if it is greater than 20 years old.
Exceptions will be handled on an individual basis.

The RV sites are limited to use of the renter's immediate family ONLY. (Husband,
wife, children, grandparents and grandchildren. All others will be considered as
GUESTS. OVERNIGHT GUESTS will be charged $7.00 per night.
By law, we are required to know who is on the premises so make sure all guests
register their names and vehicle license numbers at the office. Make sure your
overnight guests are aware of the Guest Fee. Renters are responsible to make sure
that their guests know and abide by the park rules.i I
Parents/Grandparents are responsible for the actions of their
children/grandchildren. Please remember, no riding bikes, golf carts, scooters etc.
after dark. AT Vs are discouraged. Golf carts are acceptable if used responsibly.
Joy riding and creating dust in the campground is NOT acceptable. Please obey the posted speed limits. L
UNDER AGE DRINKING IS PROHIBITED. This policy wiU be strictly enforced!
Renters of violating underage drinkers will be subject to immediate expulsion from
the campground.
TENTS for additional guests are not acceptable. Our license does not allow for
tenting.

327.10 LODGING ESTABLISHMENT OPERATOR, DUTIES.
Every person operating within this state a recreational camping ar^ lodging'house, hotel or
motel, or resort furnishing sleeping or overnight stopping accommodations for transient guests,
shall provide and keep thereat a suitable guest register for the registration of all guests provided
with sleeping accommodations or other overnight stopping accommodations thereat; and every
such guest shall be registered therein. Upon the arrival of every such guest, the operator of the
establishment shall require the guest to enter in such register, or enter for the guest therein, in
separate columns provided in such register, the name and home address of the guest and every
person, if any, with the guest as a member of the party; and if traveling by motor vehicle, the make
of such vehicle, registration number, and other identifying letters or characters appearing on the
official number plate carried thereon, including the name of the state issuing such official plate.
Such registration shall be kept in an accurate and orderly manner and retained for one year so that

Dear Bill:
On behalf of Mr. and Mrs. John and Kathleen Frank, Interstate Engineering is providing
this letter and attached drawings as information required for a conditional use permit
(CUP) application for expanding Frank’s Lodge to serve 101 dwelling units. Below is a
brief background of the facility, and proposed changes to the facility.
BACKGROUND
In April 2003, Frank’s lodge applied for a CUP to expand their facility to 49 units. In
August, 2003, the Planning Commission made a motion to approve the CUP, provided
the following:
1. An engineer’s drawing is provided to verify that there is sufficient land area to
allow for a maximum of 80 units.
2. Proposed Sites #6 and #12 are relocated to meet the 20’ road right of way set
back.
3. 50’ lot setback requirement is met.
4. No additional boatlifts are allowed (may retain the existing 25).
A copy of the current permitted 2003 facility map, and completed 2003 CUP application
are provided in Attachment 1.
PLANNING CONCEPTS
Prior to preparing the proposed expansion details provided in the following section,
Frank’s Lodge outlined provisions of the expansion that would minimize the effect on
neighboring property owners; the general public that uses Star Lake; and the tenants of
Frank’s Lodge. One the following page is a summary of these considerations:

1. The proposed units should be located to minimize visibility from Star Lake.
2. The proposed units should be located to minimize noise, traffic, and dust effects
on Star Lake and neighboring properties.
3. Rules should be established to promote a peaceful and low impact environment
for both the tenants at Frank’s Lodge, and the neighboring properties.:;r
4. Provide adequate parking and dwelling unit density to reduce congestion, and
promote safety on public and private roads.
PROPOSED EXPANSION
In consideration of the planning concepts mentioned above, and the Otter Tail
County Ordinances, Frank’s Lodge requests approval to add 52 units to its existing
49 unit facility. Below is a brief summary of the expansion:
1. The proposed expansion will add dwelling units in Tiers 4 through 7 of the facility.
Most of the expansion will technically be outside of the Land and Resource
Management District. No changes are proposed for Tiers 1 through 3. No
additional dock, waterfront structures, or buildings are proposed.
2. Frank’s Lodge owns approximately 89 acres of property. A copy of the legal
description is provided in Attachment 2. If the following are considered:
a. All 89 acres are considered part of the Facility
b. 7.5 acres are in Tiers 1 and 2 (where 24 units are currently permitted)
c. 4.5 acres are assumed unusable in Tiers 3-7 due to wetlands and road
right of way
Then, the maximum number of dwelling units according to the ordinance is
approximately 359 units are allowed on the entire facility. In 2003, Frank’s Lodge
received a permitted expansion for a total of 49 units, based on demonstration
that the facility was capable of 80 units based on the current regulations. If this is
considered a “safety factor” of 1.6 by dividing the maximum capacity by the
permitted units, this current application would propose a safety factor 359 divided
by 102, equaling 3.5.
3. 10 of the proposed dwelling units are tent only sites. 42 of the proposed dwelling
units are for Recreational Camping Units (RCU), and manufactured homes. At
this time the proposed dwelling units are not specified as RCU or manufactured

homes. If each dwelling units cannot be capable for use by either class of
dwelling, a mixture of them is proposed.
To accommodate other property owners on the lake, no additional lighting within
Tiers 1-3 is proposed. The existing night lighting and any additional night lighting
in Tiers 4 through 7 will have shields installed to minimize the visibility across
Star Lake.

Construct approximately 2,100 lineal feet of road, 20 feet wide. The road will be
crowned, and constructed with 4 inches of gravel. Maximum slopes will not
exceed 8%. A plan and profile of the proposed roads is provided in the drawings
in Attachment 3.

Because the project will disturb more than one acre, a storm water pollution
prevention plan will be required for this site.
The typical proposed dwelling unit size is approximately 40 feet by 50 feet. Any
units shown that are not 40 feet by 50 feet are in excess of 2,000 square feet in
area.

In addition to the parking space provided within each dwelling unit, two additional
parking areas are provided. Each one is capable of parking over 20 cars, based
on a 9’ X 18’ parking space per car, and 26’ driving lanes.

Except for the tent areas, each dwelling will be connected to water and sanitary
sewer. The existing well can be used to provide water service. However,
Frank’s Lodge may install a second well. A new septic tank and drain field, or
multiples there of will be constructed at the locations shown on the drawing. A
shared building for laundry, showers, and restrooms is proposed in Tier 4. A
sketch of the drawing provided by Frank’s Lodge is in Attachment 4.

10. In consideration of neighboring land owners, and their own patrons, Frank’s
Lodge has rules and guidelines included in their standard lease agreement. A
copy of the lease agreement is provided in Attachment 5. It includes quiet hours,

11.Access to the new units will be from two roads that connects at both sides of

and water lines, and the dwelling units. Frank’s Lodge will minimize the amount
of trees removed. The remaining trees will provide screening to minimize the
visibility of the expansion from Star Lake.
13. The space within the facility property directly west of the proposed dwelling units
will be, “open space” as defined and required by the Ordinance.
14. As an estimate for the quantity of excavation, there will be some grading to
construct the roads, and develop suitable pads on each dwelling for parking an
RV, or Trailer. Based on the proposed grading provided in the attached
drawings, approximately 9,000 cubic yards of excavation is proposed, more or
less.
15. The additional units will be allowed to use the existing boat ramp at Frank’s
Lodge to access Star Lake.
16. Due to winter conditions, an on-site soil survey has not been performed to verify
suitability for an ISTS system. Due to the size of the facility, elevation from the
lake, and recent soil surveys results in the area, this should not be a problem. As
provided in Attachment 6, the Otter Tail County Soil Survey map shows that most
of the soils in Tiers 3-7 are Snellman sandy loam, Lida-Two Inlets, or Kandota-
Egglake series soils. All soils are well to excessively drained, with depth to water
tables greater than 6 feet.

Rules, Guidelines and Seasonal Lease Agreement
As a Resort and Campground we are regulated by county and state laws. These are
the basis for our rules. We wish to run a Park that is clean, safe and enjoyable for
everyone. To obtain this look we need your cooperation. The following policies are
for both your protection and ours.
SEASONAL RATE for 2008 is $1,850.00. You will also be charged for your
electrical usage. A deposit of $350.00 is due by October 1,2007. The balance is due
by May 1,2008. Our season is May Is*' to October 1®*. The installation of our water
system restricts use of RV sites before and after these dates because of freezing.
The rate includes leaving your unit on site for the one-year contract period
(October 1®* 2007 to October 1®*. 2008).
BOATLIFTS: A fee_of $50.00 per year will be charged. This fee includes placing
and removing each season.
SLIPS are available for $75.00 per season. Boats and pontoons will not be allowed
to be beached.
Each RV owner must have their own property and liability insurance while parked
as a seasonal along with proof of RV ownership. All RV’s must have current license
plates and/or tabs displayed at all times.
ADDITIONAL STRUCTURES: Additional structures (decks, storage sheds) must
have prior approval from the management before installation to ensure proper
placement. The sheds can be no larger than 20 SF and 6' high. Decks are limited to
200 SF.
All park models and tip out/slide out units must he skirted within thirty days of set
up.
Management is responsible for lawn grooming of the campground. However, any
leaseholder may use Frank's Lodge equipment to groom their respective space.
Boat trailers and excess vehicles should be parked in the back parking area so it is
easier to mow grass around the campsites.

No screen tents are allowed. Manufactured-screened structures that sit on your
deck are allowed; otherwise no permanent screened structures are permitted.
SITE CHANGES AND RV SALES; The management must approve any site
changes between leaseholders. Any present seasonal occupant looking to purchase a
park modd, park trailer or a new RV unit must get management approval. This
should be done prior to your purchase to eliminate any problems.
Seasonal sites do not go with the sale of an RV. If you are selling your unit and
leaving our park, make sure the buyers know this. If you are leaving our park and
no one on our seasonal waiting list wants to purchase your RV, then the RV unit
must be removed by October 1^'.

No park model or tip out/slid out unit will be allowed to move into the park if the
unit is greater than 10 years old. No park model or tip out/slid out unit will be
allowed to remain in the park when sold if it is greater than 20 years old.
Exceptions \vill be handled on an individual basis.

The RV sites are limited to use of the renter's immediate family ONLY. (Husband,-
wife, children,.grandparents and grandchildren. All others will be considered as
GUESTS. OVERNIGHT GUESTS will be charged $7.00 per night.
By law> we are required to know who is on the premises so make sure all guests
register their names and vehicle license numbers at the office. Make sure your
overnight guests are aware of the Guest Fee. Renters are responsible to make sure
that their guests know and abide by the park rules.
Parents/Grandparents are responsible for the actions of their
children/grandchildren. Please remember, no riding bikes, golf carts, scooters etc.
after dark. ATVs are discouraged. Golf carts are acceptable if used responsibly.
Joy riding and creating dust in the campground is NOT acceptable. Please obey the
posted speed limits.
UNDER AGE DRINKING IS PROHIBITED. This policy will be strictly enforced!
Renters of violating underage drinkers will be subject to immediate expulsion from
the campground.I
TENTS for additional guests are not acceptable. Our license does not allow for
tenting.

fellow campers you will refrain from loud talking and music during the quiet hours.
Fire works will only be allowed on July 3*^**. and 4***.
DOGS must be leashed at all times and must not be left unattended. PETS ARE
NOT AlLLOWED ON THE BEACH, DOCKS OR IN THE WATER AROUND
THE SWIMMING AREA. THIS IS A HEALTH DEPARTMENT REGULATION.

Swimming is at your own risk as there will be NO lifeguard on duty at the beach.
NO GLASS bottles or containers are allowed on the beach.
Cigarette butts are not to be left on the ground; but disposed of in proper

The above rules and guidelines may be modified as to management's discretion. We
welcome your input and suggestions in order that we can create a place that is calming
and enjoyable for all.

327.10 LODGING ESTABLISHMENT OPERATOR, DUTIES.
Every person operating within this state a recreational camping area, lodging house, hotel or
motel, or resort furnishing sleeping or overnight stopping accommodations for transient guests,
shall provide and keep thereat a suitable guest register for the registration of all guests provided
with sleeping accommodations or other overnight stopping accommodations thereat; and every
such guest shall be registered therein. Upon the arrival of every such guest, the operator of the
establishment shall require the guest to enter in such register, or enter for the guest therein, in
separate columns provided in such register, the name and home address of the guest and every
person, if any, with the guest as a member of the party; and if traveling by motor vehicle, the make
of such vehicle, registration number, and other identifying letters or characters appearing on the
official number plate carried thereon, including the name of the state issuing such official plate.
Such registration shall be kept in an accurate and orderly manner and retained for one year so that
the same will be always accessible for inspection by the proper authorities.
