Dear Mr. Bigwood:
Thank you for your letter, dated August 18, 2003. Although it appears that the Planning
Commission approval resolves the issue as far as the number of units, there does remain the issue
of the sewage system on the property. Therefore, I believe that either you or Mr. Frank should be
in contact with Mr. Kalar at your earliest convenience to discuss how that issue can be resolved.
I would hope that that issue could be resolved, and I could then dismiss the complaint in this
case.

Dear Mr. Bigwood;
Thank you for your letter of April 11, 2003, regarding the above-referenced matter. You
mentioned that it was Mr. Frank’s goal to file an application with the Office of Land & Resource
Management to re-locate four camping units into the third or fourth tier of the property. I now
understand that there is a Planning Commission meeting where Mr. Frank is to appear on May
28, 2003, to address the issue. I will look forward to hearing what the Planning Commission
decides. However, I also note that Mr. Frank would still have an issue with the septic system on
his property because there are too many units under the system. Please let me know if Mr. Frank
would like to resolve that issue negating the'need for a trial in this case. As you know, the Court
Trial is now set for June 10, 2003.

Dear Ms. Eldien:
Thank you for your letter of April 3, 2003. It appears to be Mr.
Frank's intention to file an application with the Office of Land
and Resource Management which would relinquish the four camping
units near the lake whose licensure is disputed and to add units
as allowed across the road in the area of the current units.
The final proposed location of additional or replacement units
has yet to be determined, but should be well back into the third
or fourth tiers of the property,

We are enclosing a copy of our report covering an examination of plans and specifications on the above-designated project. The plans and specifications appear to be in general compliance with the standards of this department.
Please see the enclosed report for additional changes and/or comments. It is the project owner’s responsibility to retain the plans at the project location.
This review does not pertain to the Engineering design (i.e., plumbing, swimming pools, service connections, sewage systems). A separate report regarding the Engineering Review will be sent.

system for 2 cabins and 6 campsites.

Part 1 was installed on 6/10/85 apparently

Dear Mr. Bigwood:
Thank you for your letter dated January 22, 2003, concerning the above-referenced matter.
Foremost, you indicated that there w'as some misunderstanding by your client concerning the
number of camping units he may have on his property. There is no question that only 22
camping units are allowed on this property according to his Conditional Use Permit issued on
August 16, 1977. Although the State of Minnesota may allow for an additional four units under
state licensure, such state rules are completely irrelevant and in no way supercede the Otter Tail
County Shoreland Management Ordinance and its requirements. Therefore, Mr. Frank can have
no more than 22 camping units on his property at any time.
As far as statistical information on properties that were inspected on Saturday, June 29,2002, we
do not believe that George Hausske from the Land & Resource Management Office was on the
property of Mr. Frank or any other property on June 29. The Office of Land & Resource
Management Inspectors do not conduct any inspections on the weekends. The complaint does
allege a violation from July 25, 2000 through June 26, 2002. June 26, 2002, was the last date
that the property was inspected by Mr. Hausske. The property was originally inspected back in
July of 2000 under the Star Lake Abatement. Since that time, abatement inspectors do routinely
re-inspect properties abated to ensure compliance.
Should your client wish to resolve this matter prior to a trial in this case, he would need to
remove the excess camping units on the property or request expansion of the number of units
allowed on his property under the Conditional Use Permit process. In addition, he must have in

We will be representing John Frank, the defendant in the above-
entitled matter. Please provide all disclosures as required by
Rule 7 and Rule 9 and any other applicable disclosure

It seems that there may be a legitimate disagreement about how
many camping units are permitted the defendant's business
operation pursuant to their resort and campground licenses. The
defendant may have felt that some or all of what was communicated
by county regulatory personnel was not accurate. We want to be
sure that we understand positions regarding those issues, as the
defendant understood that he was entitled to 22 camping units and
an additional four units under the resort licensure in his wife's
name, as told to him by state personnel.
As for whether there were more than 26 units on the property
temporarily on June 29 of last year, the county official chose to
visit on the very busy first Saturday of the long Fourth of July
week. An overflow of tourists may have been accommodated for
parking on the defendant's spacious and well-managed resort and
campground facility,

The Complainant being duly sworn, makes complaint to the above-named Court and
states that here is probable cause to believe that the above-named Defendant committed the
offense described below. The Complainant states that the following facts establish PROBABLE
CAUSE:
Complainant, Bill Kalar, is the duly acting and appointed Administrator of the Office of Land &
Resource Management, County of Otter Tail, Minnesota, who received information regarding the
below-described offense. On August 3, 1977, the Otter Tail County Planning Commission
authorized John Frank d/b/a Frank's Lodge & Campground, to expand his campground to 22
recreational camping units and five cabins concerning his property located on Star Lake in Otter
Tail County, Minnesota, and more particularly described as; GL 4 & 5 & pt of the NE 1/4 of the
NW 1/4 in Section 9 of Star Lake Township. On July 22, 1986, the Otter Tail County
Department of Public Health sent a letter to defendant indicating that he must remove all
recreational camping units in excess of 22. On July 9, 1990, the Otter Tail County Department of
Public Health inspected the property of defendant and found that 24 recreational camping units
were on-site, and that the defendant was only licensed for 22 based upon the septic system in
place. On July 5, 2000, George Hausske of complainant's department inspected the property and
found 25 recreational camping units on-site. On July 10, 2000, Hausske spoke with defendant
and explained that his property was in excess of the 22 recreational camping units as allowed with
the septic system. Defendant stated, "You send me an abatement notice and I'll wipe my ass with
it, you bunch of assholes." On July 25,2000, Hausske sent defendant a septic system abatement
notice and advised that the property must be brought into compliance within a period of 30 days.
On June 11, 2001, Hausske sent a letter to defendant indicating that the property was still not in
compliance, and that the defendant must bring it into compliance by August of 2001 or the matter
would be referred to the Otter Tail County Attorney's Office for legal action. On August 16,
2001, a letter was sent from the Otter Tail County Attorney's Office to defendant indicating that
he must bring the property into compliance by September 1, 2001, or a formal criminal complaint
would be brought against him. On June 26, 2002, Hausske again inspected the property and
found that 29 recreational camping units were now on-site.

Lodge and informed him that all RCU’s in excess of 22 must be removed.

Otter Tail County Department of Health issues an inspection report.by Doug
Johnson, telling Mr. Frank that he has 24 RCU’s on site and is only, licensed for

Various dates and permits issued: Frank’s Lodge septic system sized for

I made a check of this property and found 25 RCU’s on site.07/05/00

Another check on this date showed the same number of RCU's. I stopped
and talked with Mr. Frank on site and explained the situation about the
excess number of RCU’s. I told him his septic system was sized for 22 RCU’s.
Mr. Frank’s parting words to me, “You send me an Abatement Notice and I’ll
wipe my ass with it, you bunch of assholes”.
07/10/00
Septic System Abatement Notice sent to Mr. Frank for “over use of septic
system. Licensed for 22 RCU sites and 5 cabins. Has 25 RCU sites and 5
cabins”. The Abatement advised correction of this problem within 30 days.

No response or further contact from Mr. Frank in 2000.
