PLANNING COMMISSION RECOMMENDATIONS
Motion by Rogness, second by Bucholz and unanimously carried to approve a Preliminary Plat of
“Overland Acres”, owned by Harold & Janet Overland, consisting of 4 Non-Riparian Lots, 1 Block, (1
Single Family Residential Non-Riparian Lot & 3 Non-Residential Lots Permanently attached to a
Riparian Lot). The proposal is located at 43928 Paul Lake Dr. E., Section 14, Edna Township; Paul
Lake (56-335), RD.
Motion by Mortenson, second by Johnson and unanimously carried to approve a Conditional Use
Permit for Tisherman’s Village Resort” owned by Dave & Bev Thompson to convert the Commercial
Plan Unit Development (PUD) to a Residential PUD, CIC #97. The owners have torn down one cabin
and built parking spaces. The proposal is located at 27621 County Highway 83, Section 6, Everts
Township; Deer Lake (56-298), RD.
Motion by Rogness, second by Mortenson and motion carried with Johnson abstaining, to approve a
Conditional Use Permit for “Bayview Shores Association" owned by Joan Knecht to replace the current
1969 Parkwood 12’ x 14’ concrete patio with a 4’ x 16’ sidewalk. The property is located at 20393 S.
Pelican Dr., Section 11 of Scambler Township; Pelican Lake (56-786), GD.
Motion by Johnson, second by Mortenson and unanimously carried to approve a Conditional Use
Permit for Green Cabin LLC owned by Ryan Hanson and Kevin Hanson for site grading to build a new
access road, house, storm water pond and storage building per the PUD approved at the November
2021 Planning Commission Meeting with the condition that both septic system areas be fenced off
with snow fence and no significant earthmoving work being done after October 15, 2022. Total cubic
yards requested is 20,000 CY. The property is located between 34737 and 34965 Sybil Lake Rd.,
Section 5 of Edna Township; Sybil Lake (56-387), RD.
Motion by Johnson, second by Mortenson and motion carried with Murphy and Bucholz opposed, to
approve a Conditional Use Permit for property owners Loren & Barbara Hawes for a permit change
from agricultural to commercial use for a Landscape Construction business for storage of landscape
materials and equipment with the condition that the Township is consulted regarding any Hawes Beach
Road improvements that may need to be done to meet the Township standards. With concern among
local property owners, the Planning Commission reached out to MNDOT for input regarding safety
and received a letter stating no traffic concerns that would require a right turn lane, but recommended
the driveway be established further to the East to allow for stacking of trucks if needed. The proposal
is located North from 44033 Hawes Beach Rd., Section 2, Otter Tail Township; Buchanan Lake (56-
209), GD.

Teams.

Michelle Eldien represented the County Attorney's Office and Chris LeClair represented the

Minutes of July 13. 2022: A motion by Trites, second by Fischer to approve the July 13,
2022, Minutes as presented. Voting By Roll Call: All members in favor.

stabilization.

From: Jim Wolters DNR Area Fisheries Supervisor Fergus Falls, MN
MNDNR Fisheries has promoted shoreline stabilization projects since the early 2000's to curb nutrient
input into lakes and rivers due to upland runoff and also to provide fish and wildlife habitat. A cost-
share program (75% DNR-25% shoreline owner) was developed to encourage more property owners to
establish/reestablish native vegetation along the shorelines and also into the lake adjacent to their
properties. A project was done on Deer Lake in Otter Tail County in 2002 at Fishermen's Village Resort.
The steep bank along this shoreline was "Lakescaped" with native trees, shrubs, grasses and flowers
following DNR planting protocol. The area is still intact today.
From the MNDNR website, property owners can find much information about the benefits of
establishing native plants along the shorelines.
Shoreland Information for Property
Owners
The decisions you make on your property have a direct impact on the health of your
lake or river. The single most important thing you can do is maintain and/or restore
natural vegetation along your shoreline. Natural vegetation:
• Holds soil in place protecting shorelines from increasingly intensive rain events
and rising water levels
• Slows runoff and stores moisture
• Filters out nutrients, which along with rising lake temperatures, accelerates algae
blooms
• Provides habitat so species can survive in a changing climate
• Increases property values by keeping lakes clean

Good morning,
The Minnesota Pollution Control Agency (MPCA) Detroit Lakes office received the attached notices of public hearing for
the August 10*^ Planning Commission meeting. If required, the applicants should obtain and comply with any necessary
permits as applicable, including the National Pollutant Discharge Elimination System (NPDES)/State Disposal System
(SDS) Construction Stormwater permit. Information on the MPCA's Construction Stormwater permitting program,
including who needs to obtain the permit prior to construction, can be found on the MPCA's website
at https://www.pca.state.mn.us/water/construction-stormwater. In general, permit coverage is needed by the owner or
operator of any construction activity disturbing one acre or more of soil, or less than one acre of soil if that activity is
part of a larger "common plan of development or sale" that covers more than one acre. An example of a larger common

plan of development or sale might be a housing subdivision. If required, permit coverage should be obtained prior to
starting construction work. Questions can be directed to the contacts at the bottom of that webpage.
For the Overland project near Paul Lake (DNR ID tt 56-0335-00), note that Paul Lake is included on MPCA's 2022 303(d)
Impaired Waters List due to fish bioassessments failing to meet state standards. If permit coverage is required and if site
drainage flows to Paul Lake, sections 23.1, 23.2, and 23.7 through 23.10 of the MPCA's NPDES/SDS Construction
Stormwater Permit includes special requirements for projects that drain to a point within one mile of these impaired
waters and that flow into these impaired waters.
