Request for Forgiveness of Penalty
The County Treasurer requested forgiveness of penalty on behalf of Rod Wenstrom.
Mr. Wenstrom submitted information that substantiated that the Ben Franklin substation in
- Fergus Fslis had erroneously hand cancelled the tax payment with an incorrect data " i - -
Motion by Lee, second by Portmann and unanimously carried to approve the above request for
forgiveness of penalty in the amount of $81.36.
Market Price for the Solid Waste Management Tax
Otter Tail County Resolution No. 98 - 63
UPON a motion by Nelson, second by Stone and unanimously carried, the Otter Tail County Board
of Commissioners adopts the following resolution:
WHEREAS, the solid waste management tax requires political subdivisions to identify by resolution
a market price if the political subdivision: Subsidizes the cost of service at a facility.
WHEREAS, the market price is identified in state statutes as the “lowest price available in the
area”.
WHEREAS, Otter Tail County has performed research to identify the lowest price available in the
area;
THEREFORE, the county of Otter Tail declares a market price of $41.95 per ton for a facility,
based on a tipping fee amount of $41.95 per ton at Fergus Falls and an additional transportation
cost of $0 per ton.
Adopted at Fergus Falls, Minnesota, this 24“^ day of November, 1998.

Contract Approval - Consulting Services
Motion by Portmann, second by Lindquist, and unanimously carried to authorize the Chair’s
signature to execute an agreement between the County of Otter Tail and The Barlow Group of
Fort Collins, Colorado to assist Otter Tail County by providing a technical and economic evaluation
of the Quadrant Resource Recovery Facility. The cost of the service is $27,650 with $10,000
being paid from a potential grant from the OEA and the remainder from the Solid Waste Joint
Powers Contingency Fund.

The vote was a tie, therefore the Application was considered
denied. The Commission indicated to the Applicant that they could
return at the end of the meeting with a proposal provided an
agreement could be reached with the neighbor. Further discussion
and a motion did take place approving the request, refer to the
last consideration in these minutes (pages 5& 6).
David Kaldahl/Fair Hills, Inc. - Approved As Revised:
A Conditional Use Permit Application to pull off sod and topsoil
off 120' of shoreline on the east end of property - sod and
topsoil removed would start near existing sidewalk and slope 3'
down to 1998 high water mark 12' away. This is 150' from property
line - on west end we wish to do the same for 100' . The bank is
2' high and would slope back for 10'. REASONS: 1. No beach at
all for most of 1998. A judge issued permission for Cormorant
Lake to dump its excess water into Pelican Lake. We had a lot of
sod and black dirt pulled into the lake by waves this past year.
Having sand instead of sod will prevent this. 2. We have rocks
along a lot of shoreline, but need some area to pull up paddle
boats, kayaks, sailboats, rowboats and for small children's play.
The property is described as Killarney Beach, Lots 23 - 41 & Pt
42, Section 4 of Dunn Township; Pelican Lake (56-786), GD.
