On cabins 3 & 4 there would also be the widening of the front rooms of 2 1/2' to the same width as the rest of the cabin. Cabins sit 20' August V - 30' from the High Water Mark rather than the required setback of 100'.Variance of approximately: 1) 70' - 80' : 30' from requiredfrom OHWL setback of 100'. September 8, 94 - Hearing: Approved - variance of approximately 70' 30' from required SIZ 80' from OHWL. setback of 100', 20' setback of 50' and 28' from lotline (buffer) setback of 50'. September 16, 94 - Site Permit #13140 issued. Additions to: Cabin #1 - 7' X 7', 7'x 7', 8' X 27' & 27' x 29' loft. Cabin #2 - 6' x 7', 6' x 7', 8' x 23' &'23' x 29' loft. Dimensions are from Variance Application drawing. .-t. ; ■ Page 4 September 27, 94 - 1 drove by the Resort on my way to inspect a sewage system installation (Permit #10282). I took two (2) pictures from the car. It appeared they were doing more than just building additions. Only the South & East stud walls, floor & foundation of the main portion of Cabin #5 remained. Only the North & East stud walls, floor & foundation of the main portion of Cabin #4 remained. Only the South stud wall, floor & foundation of the main ' portion of Cabin #3 remained. All walls on the lakeside portion of Cabins #3, #4 & #5 were gone. I could not see if the foundations or floors of those portions were gone. On Cabin #2 the North & South walls (main portion only), floor & pilings (foundation) remained. On Cabin #1 the North, South & East walls and roof were intact. The doors and windows were gone. I could not see the lakeside portion. September 28 to September 30, 94 - 1 checked the Resort's lake file the next day. appeared to me that this was more like replacement and discussed the situation with Bill Kalar, Administrator, and Tim Griep, Asst. Administrator. It 94 - Tim Griep also checked the site.He took two (2) pictures from the road and informed me by radio that he also saw this project as replacement. October 3, 94-1 tried contacting Mr. or Mrs. Chase by telephone at 367- 2603. left a message on his voice mail requesting him to call me. October 4, A recording said to call 731-3205, which I did.I 94 - Since no one returned my call by 4:30 P.M., certified letter informing him of the problem, to stop the work and to contact Tim Griep or myself. October I sent a5, 94 - Allen Chase telephoned Tim Greip and stated: 1) 7' x 13' addition replacing (he never checked with our office). Board of Adjustment knew he was replacing cabins (as they talked, Mr. Chase backed off somewhat). Structure is basically still there. Existing framed walls still there. Pat Eckert knew what was going on and issued permit. October 6, found out it was rotting and needed 2) The When I issued the permit, I remember Allen Chase saying "What if once we start tearing into the buildings we find rotten areas? Can we replace some boards here and there?". I responded, that would be Ok. He then asked "What if it is more than that?". I responded that he should put down on paper what all needs to be replaced and submit that to our office. I would have Bill Kalar look at it and he could determine if it would be allowable or not. Page 5 3, 94 - Reconsideration Hearing: Referred back to the Land and Resource, and the County Attorney offices to determine if the actions taken by Allen Chase are in compliance with the granted variances. The B of A did not find any substantial changes to warrant reconsideration as explained by Kurt Mortenson, Assistant County Attorney. November 4, 94 - Illustration of which walls were removed, as per the property owner. Bill K. made notes and sketch indicating which walls he expected would be removed during construction. November 3 other notations attached to this are: Check with Wally - can stud walls be considered in the 50%. - remove 1 cabin - remove the front additions on ceUsins 1 & 2 - remove the loft on cabins 3, 4 & 5 Our position is that this is a replacement Wally did not say stud walls were OK 8, 94 - Note by Bill K. Variance - No authority to differentiate between new and old construction- therefor we can not prevent you from completing the structures- Wants to check with Bob on tax assessments. John Ramacher - Tabled John Ramacher, Maple Grove, MN, requested the following variances: 1.) minimum lot area be waived due to lot size, 2.) ordinary high water level setback waived as bluff set back is more restrictive, 3.) a top of bluff setback of 25' instead of the required 30' setback, 4.) a road right-of-way setback of 15' instead of the required 20' setback, and 5.) extend the maximum landing area to 50 square feet Instead of 36 square feet. On cabin 1 a total of 104 sq ft would be added on the lake side part of the cabin and a second story loft. Cabin 2 a total of 136 sq ft svonld also be arlrled on tlie lake side part of the cabin and a second story loft. (See attached drawing) All additions to both f;aliins I & 2 w?ould not lie any closer to the liigh water marls ami would not exceed the 30 ft height limit upon comiiletion. 'Hiese additions would add living area only and would not increase capacity. The object of this letter it to obtain a letter from the County Commissioners stating that the additions and remodeling projccis on cabins 1 & 2 should not have a problem at this time of receiving a variance for work described.
