easement area on Parcel # 1300040018000. Stabilize new cuts along shoreline with soil erosion blankets.
Cut area Length: 30 Feet Width: 12 Feet Average Depth: 2 Feet Total Cubic Yards: 27.
Top dress, seed and stabilize disturbed area. Must control and store water run off.

PROTECTIVE ORDER OF ELKS, a Minnesota nonprofit corporation, hereinafter the “Elks,” its
successors and assigns, and DUANE HANSON, hereinafter “Hanson,” his heirs, executore,
administrators, agents, or assigns.
WHEREAS, the Elks has fee simple ownership of and has marketable title to that real
estate and real property located in the County of Otter Tail, and State of Minnesota, described as
follows, to-wit:

All that part of Lot One (1) of Section Four (4) and Lot Eight (8) of Section Nine
(9), lying West of a line miming parallel with and distant 551.70 feet West of the
Section line running North and South between Sections Three (3) and Four (4)
and Nine (9) and Ten (10), all in Township One Hundred Thirty-two (132), Range
Forty-two (42);

Together with an easement for ingress and egress purposes, over a strip of land
66.00 feet in width lying southerly of, parallel with, and adjoining the easterly
125.00 feet of the road right of way for Elk’s Point Road.
Also together with an easement for access and use of the existing concrete boat
landing ramp situated on the adjoining property westerly; said easement lying
within 25.00 feet westerly of the westerly line of the herein-described Tract A and
within 50.00 feet of the shoreline of Wall Lake; (the “Easement”)

WHEREAS, Hanson owns and has marketable title to that real estate and r^l property

Fergus Falls Lodge No. 1093 tract a distance of 36.00 feet, more or less, to the
Point of Beginning of the herein described Tract A. Subject to easements,
reservations, and restrictions of sight ^d or record, if any.
Together with an easement for ingress and egress purposes, over a strip of land
66.00 feet in width lying southerly of, parallel with, and adjoining the easterly
125.00 feet of the road right of way for Elk’s Point Road.
Also together with an easement for access and use of the existing concrete boat
landing ramp situated on the adjoining property westerly; said easement lying
within 25.00 feet westerly of the westerly line of the herein-described Tract A and
within 50,00 feet of the shoreline of Wall Lake _(“the Easement”);

WHEREAS, the Elks wants to relocate the boat landing ramp within the Easement,
which burdens Tract A and benefits Tract B, and Hanson is agreeable to moving the easement
under certain conditions; and
WHEREAS, Hanson and the Elks a^ee as follows:
To allow the Elks to relocate the existing concrete boat landing ramp further to the
west/southwest, but still within the boundaries of the Easement granted to Hanson
in that Warranty Deed dated October 5, 2012, recorded October 9, 2012, as Document No. 1116713; andjHanson shall allow the Elks to install a dock to the
east/northeast of the new concrete boat landing ramp, and within the existing
Easement to Hanson, but noicloser to Hanson’s real property line than ten (10)
feet. Hanson reserves the right to use said dock installed within Hanson’s existing
right-of-way easement.
(a)

The successors and/or assigns of the Elks shall maintain said easement at its/their
own expense.
(b)
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
The Elks for and in consideration of Hanson allowing the Elks to move the concrete boat
landing, does hereby grant, assign, and set over to Hanson, his heirs, executors, administrators,,
agents or assigns, the rights described as follows:

The Elks are allowed to move the existing concrete boat landing ramp further to
the west/southwest, but still within the boundaries of the existing Easement
granted to Hanson in the Warranty Deed dated October 5,2012, recorded October
9,2012, as Document No. 1116713;
(a)
(b)Hanson shall allow the Elks to install a seasonal and temporary dock to the
east/northeast of the new concrete boat landing ramp but still within the existing
Easement granted to Hanson but no closer to Hanson’s real property line than ten
(10) feet;
the Elks grants Hanson the right to use the dock within Hanson’s existing
Easement;
(c)
(d)the Elks and its successors, heirs, and assigns shall maintain the easement at its
own expenses; and
said Easement, which is designed to serve all of said tracts, shall be for the
common use, for foot, watersports, watercraft, boat, jet ski, pontoon, etc., and
vehicle (including ATV’s, UTV’s, etc.) traffic, as a means of ingress and egress
and other lawful purposes, and shall be for the common benefit of the present and
future owners of said tracts, respectively, and each of their contract vendees,
tenants, invitees, and licensees.
(e)
The Elks shall fully use and enjoy the aforesaid premises, except as to the rights2.
herein granted.
Said easement or right of way shall at all times be kept open and free from
obstructions so that the same may be used in common for the purposes contemplated, and none
