M Peter Doll Et. Al. part of Government Lot 2, Section 15 of Rush Lake Township by Boedigheimer Lake, requested the
following: This is a request for a variance of 30’ from the ordinary high water level setback of 100’ for the placement
a residential structure (24’ 5” by 26’ 5”) 70’ from the ordinary high water mark of the unnamed creek that winds ^^^^through the property. The audience was polled with Gordon Rosenthal speaking for the variance as requested. A
letter from Peter and Katrina Doll in support of the variance as requested was read for the record. After consideration,
Randall Mann made a motion, second by Les Estes and carried with Paul Larson voting no, to approve a variance of
25’ from the ordinary high water level setback of 75’ for the placement of a residential structure (24’ 5” by 26’ 5”) 75'
from the ordinary high water mark of the unnamed creek that winds through the property with the condition, if
necessary, this action is subject to the review/approval of the Planning Commission. The practical
difficulties/hardships are water on two sides and the unique shape of the property. It was noted that the variance as
approved will provide the applicants with a reasonable use of their property. It was also noted that all other setback
an Martin Stobie - Approved modified plan submitted September 4, 2008 with a condition. (9:25 p.m.)
Joan Martin Stobie, Lot 17 and North Half of Lot 18, K-B Beach and Lot 3 Block 1 Tomlinson Oaks, Little Pine Lake in
Corliss Township, requested the following; 1) Change roof line of existing 14’ by 28’ 1 - story. The north portion of
home is located 1.5’ from the lot line and 58’ from the ordinary high water level. Requesting a variance of 8.5’ from
the required lot line setback of 10’ and a variance of 17’ from the required ordinary high water level setback of 75’, 2)
Remove existing middle section of home and construct a 34’ by 45’ 2 story addition 64’ from the ordinary high water
level. A variance of 1T from the required ordinary high water level setback of 75’, and 3) Change existing 18’ by 26’
VA - story. South portion of home to a full 2-story located 7.5’ from the lot line and 64’ from the ordinary high water
level. A variance of 2.5’ from the required lot line setback of 10’ and a variance of 1T from the required ordinary high
water level setback of 75’. September 6, 2007 meeting - The audience was not polled as there was no one in
attendance at the time of this public hearing. A letter signed by Lois Bossert, Stephen Fox, Kathy Johnson and
Steven Bigler in support of the variance as requested was read for the record. During discussion concern was
expressed with the exact location of the side lot lines and the need to have additional information regarding the lot line
location before acting upon the requested variances. After consideration and discussion, Steve Schierer made a
motion, second by Paul Larson and unanimously carried, to table this hearing until the October 4, 2007 meeting to
provide the applicant with an opportunity to provide additional information regarding the location of the side lot lines.
October 4, 2007 meeting - Prior to the meeting the applicant submitted a letter requesting the tabling of her
application until the June 2008 meeting of the Board of Adjustment. After consideration, Randall Mann made a
motion, second by Steve Schierer and unanimously carried, to acknowledge the applicant’s letter, to grant the
applicant’s request and to table this public hearing until the June 2008 meeting of the Board of Adjustment.
November 1, 2007, Decembers, 2007, January 3, 2008, April 3, 2008 and May 1, 2008 meetings - No hearing
held as the applicant requested in October 2007 to have their hearing tabled until June 2008. June 5, 2008 meeting
- The applicant was not in attendance. After consideration, Michael Harris made a motion, second by Joe Maske and
unanimously carried, to deny the variance as requested due to the failure of the applicant to appear at the June 5
meeting and due to the fact the Board has no written permission to table the applicant’s application past June of 2008.
July 3, 2008 meeting - It was noted that after the June 5, 2008 meeting the secretary of the Board received a letter
from the applicant requesting that her hearing be tabled until the August 7, 2008 meeting. August 7, 2008 meeting -
Prior to the meeting the applicant contacted, by telephone, the Board secretary to request that her application be
tabled until the September 4, 2008 meeting. After consideration, Randall Mann made a motion, second by Steve
Schierer and unanimously carried, to table, based upon the applicant’s verbal request to the secretary, this hearing
until the September 4, 2008 meeting. September 4, 2008 meeting - A letter from Steven J. Fox, an adjacent
property owner in support of the applicant’s request was noted for the record. After consideration and discussion,
Paul Larson made a motion, second by Steve Schierer and unanimously carried, to approve a 13’ by 18’ second story
addition to that portion of the existing structure identified on the revised drawing dated September 4, 2008 with the
condition that the proposed development must be at least 10’ from the side lot line. It was noted that the entire
original request had been withdrawn in favor of the revised plan.

GENERAL PROVISIONS
The permittee shall comply with ail rules, regulations, requirements, or standards of any applicable federal, state or local agencies;
including, but not limited to, the U.S. Army Corps of Engineers, Board of Water and Soil Resources, MN Pollution Control Agency,
watershed districts, water management organizations, county, city and township zoning. This permit does not release the permittee of any
permit requirement of the St. Paul District, U.S. Army Corps of Engineers, Army Corps of Engineers Centre, 190 Fifth Street East, St.
Paul, MN 55101-1638.

This permit is not assignable by the permittee except with the written consent of the Commissioner of Natural Resources.2.
The permittee shall notify the Area Hydrologist at least five days in advance of the commencement of the work authorized hereunder and
notify him/her of its completion within five days. The Notice of Permit issued by the Commissioner shall be kept securely posted in a
conspicuous place at the site of operations.
3.
The permittee shall make no changes, without written permission previously obtained from the Commissioner of Natural Resources, in
the dimensions, capacity or location of any items of work authorized hereunder.
The permittee shall grant access to the site at all reasonable times during and after construction to authorized representatives of the
Commissioner of Natural Resources for inspection of the work authorized hereunder.

This Permit may be terminated by the Commissioner of Natural Resources at any time deemed necessary for the conservation of water
resources of the state, or in the interest of public health and welfare, or for violation of any of the provisions of this permit, unless
otherwise provided in the Special Provisions.

Construction work authorized under this permit shall be completed on or before date specified above. The permittee may request an
extension of time to complete the project upon written request to the Commissioner of Natural Resources.
7.
In all cases where the permittee by performing the work authorized by this permit shall involve the taking, using, or damaging of any
property rights or interests of any other person or persons, or of any publicly owned lands or improvements thereon or interests therein,
the permittee, before proceeding therewith, shall obtain the written consent of all persons, agencies, or authorities concerned, and shall
acquire all property, rights and interests necessary.

9.No liability shall be imposed by the State of Minnesota or any of its officers, agents or employees, officially or personally, officially or
personally, on account of the granting hereof or on account of any damage to any person or property resulting from any act or omission
of the permittee or any of its agents, employees, or contractors. This permit shall not be construed as estopping or limiting any legal
claims or right of action of any person other than the state against the permittee, its agents, employees, or contractors, for any damage
or injury resulting from any such act or omission, or as estopping or limiting any legal claim or right of action of the state against the
permittee, its agents, employees, or contractors for violation of or failure to comply with the permit or applicable provisions of law.
10.Any extension of the surface of protected waters from work authorized by this permit shall become protected waters and left open and
unobstructed for use by the public.
Where the work authorized by this permit involves the draining or filling of wetlands not subject to DNR protected water jurisdiction, the
permittee shall not initiate any work under this permit until the permittee has obtained official approval from the responsible local
government unit as required by the Minnesota Wetland Conservation Act of 1991.

SPECIAL PROVISIONS
PERMIT 94-1178
EXPLOSIVES: The use of explosives in any of the waters of the state is prohibited unless
the local Conservation Officer is notified thereof at least 48 hours in advance of the time
the work is to be done.
I.
Spoil material shall not be placed on the beds of protected waters, and.SPOIL:
wherever possible, such material should not be placed anywhere within areas subject to
flooding.
n.
BED RESTORATION: Upon completion of construction, the bed of the protected water
shall be restored as nearly as practicable to the original cross-section.m.
EROSION CONTROL: The permittee shall cover or protect all exposed soil resulting from
the construction authorized by placing riprap, sod, and/or seed on banks and slopes of said
construction for the prevention of soil erosion, sedimentation and lake/stream discoloration.
IV.
FILL: Any organic material or mud wave that may be raised or pushed up above the
existing lake bed as a result of grade fill placement shall be removed to the satisfaction
of the Department of Natural Resources.
V.
SEEDING: In the event the site cannot be stabilized with vegetation before September
15, all exposed soil shall be adequately mulched atr-a rate of not less than 3500 Ibs./acre
leaving no more than 20% visible soil surface and maintained until seeding/sodding can
be achieved.

SUBJECT: Fill and Grade & Culvert/Bridge Permits
Below is the information needed to apply for a fill and grade permit to build a road to
provide access to parcels G and H in the SE 1/4 of the NW 1/4 of section 15, T 135 N,
R36 W:
1. The road will exit the township road approximately 100 feet from the westerly corner
of parcel H.
2. The west side of the creek has no trees by the proposed road.
3. Upon crossing the creek a small gentle natural ridge runs about 2/3 of the way back
from the lake and 1/3 up from the creek.
4. The road will be placed just off the center of the ridge to the creek side.
5. The road will be as straight as possible but will meander to avoid cutting as many
trees as necessary.
6. Trees will be cleared approximately 14 feet wide. It will be graded for traffic using
fill only if necessary.
7. The road way and crossing presently are marked with red flags.
8. There will be a 30 - 40 foot turnaround radius at the end of the roadway to allow a
turnaround for a pull behind camper.
9. The east side of the creek has predominately poplar trees, basswood and other
broad leaf trees.
10. The camp site will be formed by thinning less desirable trees, brushing and leveling
the ice ridge on the shore line.
11. The camper is a self-contained unit requiring no on site sewage system or water
supply.
Below is the information needed to apply for a culvert/bridge permit to build a creek
crossing to be used with the above roadway.
1.The road will cross the creek at a 90 degree angle.
2.Two four feet in diameter culverts will be used.
a. The creek crossing coming into Boedigheimer Lake uses two four feet
culverts.
b. The creek crossing going out of Boedigheimer Lake under Highway 78 is five
feet high and less than five feet wide.
c. Two four feet culverts exceed the capacity of the five feet culvert.
d. The proposed culverts will be materially shorter than the existing culverts
(approximately 25 feet in length). This reduces restriction and allows for
greater capacity.
3.The creek has reasonable bank elevations at the point the culverts will be placed.
4.Fill will be used to match existing bank elevations to the new crossing elevation.
5.The road height from the creek bed to the top of the roadway will be five feet.
Riprap will be used to prevent erosion and ice damage to the portion of the roadway
that is exposed to the creek.

7.Beaver grates will be placed on both ends of the culverts.
8.The water conditions at the project site;
a. Normal creek bed is 9 feet wide and has an average depth of 14 inches.
b. The deepest point of the creek is 20 inches.
c. The creek bed is nearly flat.
d. The creek is outside of the normal banks and is 19 feet wide. The water
outside of the banks is very shallow and has very little current.
e. The creek appears to be at an all time high water mark. This is caused by
the spring melt and the very heavy fall rains.
f. The creek will not flow on dry years.
9. Vegetation at the project site:
a. The creek has no vegetation in it.
b. There are patches of tall grasses on the gentle edges of the creek bed.
c. Where the bank is not gentle, short grass and trees meet the stream bed.
d. No other aquatic plants were noted.
e. The upland vegetation are short grasses, trees and underbrush.
10. A back hoe tractor will be used to place the culvert, fill and rock.

I have reviewed the request made by Mr. Pete Doll in regard to
the installation of a private drive to property located between
Boedingheimer and Rush Lakes. The private drive would require
the installation of a culvert on the creek as described.
The subject in question was the size of the culvert required. It
was brought to my attention that downstream of the proposed
culvert is an existing culvert. This existing culvert is
approximately 4 feet in width and 5 feet in height. The
resulting cross-sectional area of the existing culvert is 20
square feet. Mr. Doll has proposed to install a double barrel
culvert system for his driveway. The proposed size of the
culverts are each 4 feet in diameter. The resulting cross-
sectional area of the two culverts would be 25.12 square feet.
It is my recommendation that the installation of the two 4-foot
culverts for Mr. Doll's driveway would be more than equivalent to
the downstream culvert.
