We discussed the reason for Mark Ronning’s (Inspector) Site Inspection (sewage discharge seen from Co. Hwy #83), our file record (9 cabins and 4 campers), Mark’s count of 10 campers onsite and potential resolution options. This matter can be resolved as follows: 1. On our before June 1, 2007, Mr. Turner must remove the 6 unpermitted campers from the property. 2. On or before June 1, 2007, Mr. Turner must provide this Office with written approval from both the MN Department of Health and the Otter Tail Water Management District for his proposed sewage system to serve the 4 remaining campsites (west of Co. Hwy 83) or, all water and sewer connections must be removed. 3. Should Mr. Turner decide to apply for additional campers, he may submit a Conditional Use Permit (CUP) Application. We briefly discussed the Shoreland Management Ordinance requirements for Cluster Development including the need for a surveyor’s drawing and that a CUP Application allows the County an opportunity to review and improve current situations. I also suggested that he prepare an accurate scale drawing of his property from which we could do a rough density calculation in order to determine whether or not its worth his time to apply for a CUP. 4. You also need to remember that you even had more than the 8 RCU’s that the MN Dept, of Health licensed you for. Thus this violation remains valid. The violation for allowing sewage to be deposited onto the surface of the ground is valid and does not require your knowledge or participation, it remains your responsibility. The policy of this Department is to not allow an unlimited supply of water (hose connections) to a “dependent” RCU site. Therefore, if the water spigots are to stay on the West side of the highway, the Otter Tail Water Management District must approve a plan to provide sewer service to the sites. Please re-examine my 20 December 2006 letter and the enclosures so that we can agree on how best to bring this facility into compliance with the Shoreland Management Ordinance and the Otter Tail County Sanitation Code (as well as the Otter Tail Water Management Districts’ rules). Presently, we are comfortable with the goal of bringing your facility into compliance by 1 June 2007 as stated in ref (a). You made mention of a Conditional Use Permit and the fact that the resort does not have one. If this is a necessity, then please explain to me the steps 1 must take in order to get one. I completely agree that sewage should not be dumped at the 4 RCA sites. I have never allowed - as your Violation states - campers to dump sewage at the RCA sites. Any dumping they are doing is completely without my permission or knowledge. As far as water being available on the RCA sites, this has been the case since 1 purchased the resort 17 years ago. The seasonal slow-down now allows me to catch up on pending actions. 1 noticed that the refrigerator has been removed from the shore-impact area (SIA) and that satisfies part of the violation. However, the old van parked between the highway and the shore is not currently licensed and as such is a structure. This must be moved out of the SIA also. Your resort does not have a Conditional Use Permit (CUP), and therefore is limited to the number, type and size of units that were in operation as of 15 October 1971. Your file indicates that as of 15 May 1984, you were authorized 9 cabins and 4 RCA sites. It further states that the RCA sites were without water and sewer. The file further indicates that as of 7 May 1992, the resort had 9 cabins and 4 RCA sites. Your 2006 MN Dept, of Health license states that you have 9 cabins and 8 RCA sites. Please explain to me how this increase happened without a CUP. My last visit to the resort on 11 Dec 06 indicted 10 RCU’s on site and that there were also water spigots for each site available within hose reach. I am not aware of an authorized sewage dump station at the resort, and on 25 August noted that the units down by the shore were connected by hose to the spigots and had been draining sewage onto the ground (a violation of the OTC Sanitation Code). Our position is that no water or sewer should be available for the 4 allowed RCA sites, no sewage spills should take place, and that any and all non-complying structures or supporting equipment should be removed from the resort. These actions should be completed by 1 June 07. I have enclosed copies of the appropriate section of the OTC Sanitation Code, Shoreland Management Ordinance and pages from the Resort file folder. Layout and width of proposed streets and utility easements showing lake setback boundaries, buffer zone boundaries, lot boundaries and dedicated roads. b. Preliminary road grades, including a center line profile, and drainage plans shall be shown on a copy of the contour map. All roads must be identified and signed in accordance with the provisions of the County’s Enhanced 911 Countywide Addressing System. ■ c. Statement of source of water supply. d. Cluster Developments: A. General; All cluster developments; which have been in operation continuPQSiy'since October 15, 1971 may continue to operate the number, type and size of dwelling units which were in operation on October 15, 1971. Any change will require that the owner obtain a Conditional Use Permit which will authorize a specific number, type and size ofE«* dw^Jing units. All owners of cluster developments which have opened since October 15, 1971, must have a Conditional Use Permit which specifies the number, type and size of dwelling units which they are authorized to operate. Any change in number, type or size of dwelling units requires a new Conditional Use Permit. When applicable, all resorts, recreational camping areas, manufactured home parks and campgrounds must also receive a license from the Minnesota Department of Public Health. 1. Pre-Application Meeting: Prior to the submission of any plans for consideration to the Planning Commission under the provisions of this Ordinance, the potential applicant shall meet with the Administrative Officer and learn what shall be expected of them in such a capacity. ■■ 2. Before final approval of all Cluster Developments, adequate provisions must be developed for preservation and maintenance in perpetuity of open spaces and for the continued existence and functioning of the development as a community. Open spaces must be preserved by deed restrictions, covenants. permanent easements, public dedication and acceptance or other equally effective and permanent means.
