Re: Clear Lake Resort, Clear Lake (56-559)
Dear Mr. Finkelson:
This letter is a follow up to our telephone conversation regarding changes to the cabins
on your resort. I discussed this matter with two other inspectors in our Office. They
explained to me that lifting the cabins and putting a new foundation under the cabin
would require a Site Permit.
They further explained that this alteration would also cause you to lose the grandfather
rights for the current location of the cabins. The cabins would then have to be moved
back to a legal location or you have the right to apply for a Variance.
Enclosed please find a copy of the Shoreland Management Ordinance. On Page 20 of the
Ordinance it reviews Cluster Developments (No. 11). Section V. on Page 25 of the
Ordinance has the information you were inquiring about. Please note you should review
the Ordinance in its entirety. Also note you should contact Bill Kalar, Administrator, for
any changes you plan to pursue on your resort.
Also enclosed, I have included the information you have requested for relocating the
abated Outhouses to legal locations.

Conditional Use Permit - Barbara Anton:
Motion by Nelson, second by Lee, and unanimously carried to uphold the Planning Commissions’
recommendation to deny a Conditional Use Permit to elevate lot. The property is described as
Nedberg-Nye Survey Lots, GL 1, 2 & 3, 75’ on lake (called Lots 40 & 41), section 1 of Edna
Township; Devil’s lake (56-245).
Preliminary Plat - Lake Ridge Estates:
Motion by Froemming, second by Lee, and unanimously carried to uphold the Planning
Commissions recommendation to deny a Preliminary Plat to construct 400’ of gravel road. The
property is described as Lot 17 Auditor’s Subdivision No. 116, Section 22 of Leaf Lake Township:
East Leaf Lake (56-116).
Discussion - West Silent Lake RetreatAA/est Silent Lake (56-519):
The applicants appealed the County’s decision to deny the Preliminary Plat of West Silent Lake
Retreat. This decision was appealed to District Court. County Attorney, David Hauser, reported
that the County had received an order from the Court. The judge invited the petitioners to apply for
summary judgement. The County lost on the 60 Day Ruling. It appears that the County had
misinterpreted the timeline. A possible appeal is being explored by the County.
Discussion - Clear Lake Resort/Clear Lake (56-5591:
Tim Griep, Assistant Administrator for Land & Resources, reported that a surveyor’s drawing is
needed for a proposal to add additional units to Clear Lake Resort.
BEST Food Contracts
Gary Waskosky, Jail Administrator, presented a contract for approval with BEST, Inc. for Detention
Facility Food Service. Motion by Nelson, second by Froemming, and unanimously carried to
authorize the Chair’s signature to execute a contract agreement between BEST, Inc. and the
County of Otter Tail for Detention Facility Food Service from July 1, 2001, through June 30, 2002.
. The County agrees to pay BEST, Inc. for meals furnished as indicated on the following schedule,
which includes a 2% increase:

Western Exposure / Wesley Hagen & Rodney Hagen - Tabled to August 8. 2001:
A Preliminary Plat of "Western Exposure” consisting of 10 single family residential lots, 1
block. Also, construct 3,030’of gravel road to county specs to service proposed plat. The
property is described as Pt of GL’s 3,4,5 & 6, Section 29 of Scambler Township; Pete
Lake (56-941), NE.
Rodney Hagen, Gary Johnson & Clem Hendrickson represented the Application.
Linda Augustus had questions regarding the lot sizes and the type of houses that would
be built. Randy Arnston commented as to why someone would spend this kind of money
for a lot and put a mobile home on it.
Motion: A motion by Estes, second by Zimmerman to table, at the Applicant’s request, to
the August 8, 2001 meeting to allow the Planning Commission members to view the
staked Oots were not staked at the time the Commission members viewed the lots) lots.
Voting: All members in favor.
Discussion -West Silent Lake Retreat / West Silent Lake (56-519):
Bill Kalar discussed with the Commission that at this time, it appears (ruling from the
courts) that the County lost on the 60 Day Ruling. The County is reviewing the situation
for a possible appeal. (Interpretation as to the starting date of the 60 Day Period being
the issue.)
Discussion - Clear Lake Resort / Clear Lake (56-559):
Bill Kalar discussed the necessity of a surveyor’s drawing for a proposal to add additional
units to Clear Lake Resort in an area behind Ed’s Clear Lake Beach (a subdivision that is
across the road from the resort). The Resort Owner like to use the drawing that was filed
with Ed’s Clear Lake Beach and not have a surveyor’s drawing prepared. The
Commission indicated that this would not be appropriate, they would like to see the whole
resort and not just a portion.
Adjourn: A motion by Lachowitzer, second by Maske to adjourn the Meeting at 10:05
p.m., the next meeting is scheduled for July 18, 2001

Meeting with Ottertail County Commissioners
Proposal (intentions):
Darren and Julie Lund (and kids) would like to purchase the resort in Dalton
MN in the spring of 2006, as is. Since I hold a job in the Twin Cities we
would rent out only the RV spots seasonally to begin with (lower
maintenance while not there full time yet).
Areas that impact safety, the environment and public health would be
addressed before any remodeling starts. During hard rains there is some
washout of the cart path that creates safety and environmental issues. The
grading/landscaping would be addressed to reduce or eliminate this. The
general debris scattered around the site is viewed, in my opinion, as a public
health and safety issue. The debris would be sorted for what is usable,
recyclable and what needs to be properly disposed of.
During the first couple of seasons work would be done on the office/bar. A
new roof, siding and windows would eventually be replaced. Nothing of the
super structure would be altered.
Within two years the 5 sheds (significant eyesore) on site would be tom
down and consolidated into one new structure that would house utility type
equipment like lawn mowers and shop tools.
In years 2 through 7 the cabins (probably only 4 of the 5) will take on the
same uniform look as the office/bar. I may have access to some log siding
in NW Minnesota if the timing works out. I would like to create a
traditional “log cabin” style resort. Again not changing the footprint of the
cabins or modifying the super structure.
Years 8 and beyond is when the resort would run more from a full time
status (year ^ound) by our family. The exception to this is if the timing is
accelerated (unlikely) and someone other than our immediate family
member would be running it in the mean time.

Our intent is to move up to the area and run the resort year around but it will
be a work in progress for nearly the first ten years. Our ultimate desire is to
provide affordable camping experiences for families that can no longer
afford lakeshore property because it has gotten out of reach for most
working families. The only reason we are in a position is from a purchase of
a lake lot in Alexandria in 2000 that we must sell to buy this.■ 1
I read that in the 1970’s there was over 4000 resorts in Minnesota and now
there is less than 700. My family and I would like to add one back to that
list and provide a little economic prosperity for the Dalton area. Below are a
couple questions that will potentially impact the purchase of the property :
1. Are permits required for:
a. Roof replacement
b. Siding replacement
c. Window replacement
Does this differ for non-conforming property?
2. There are 5 sheds and 6 cabins on the site with 9 permitted RV spots,
a. Do I need a special permit each year for the RV spots? Cost?
b. Do I need any additional permits to keep the proper operating
status for the resort?•:
c. What does it take to get a 3.2 beer permit? Cost? Annual
renewal?
d. What is the largest structure I can build on site if I tore down all
5 sheds and built one attractive pole bam(garage) in their place?
e. If I can’t build a pole bam (garage), what is the largest storage
shed I could build?

3. Under the modification rule of non^conforming properties, how is the
cost determined if the modification is greater than 50% if I do the
work myself? Is it only the materials that are figured into the cost or

does my labor somehow get factored into the cost and if so what is
that factor?
4. Does the water need to be tested each year by the MN Dept of Health
to remain compliant as a resort?
5. Is there any other permits or licenses that are required either as a one
time application or Set renewal that I need to pull?. V
6. When the septic is upgraded does the cabin plumbing need to come
up to current code? If so, how does this impact the modification rule
for non-conforming buildings?r
7. Can separate septic systems be installed between the RV spots and the
cabins?
8. Can a partial septic replacement be constructed? For instance can the
RV spots be on their own septic system? Can the cabins septic system
be capped or sealed until the time we start using them again even
though the system is non-compliant in August 2006?
9. What happens to the resort status if the septic isn’t replaced in August
2006?4
10. If there was an approved perc test completed, can the septic system be
of a natural drain field on Clear Lake? Any restrictions?
11. Can the septic non compliance be delayed until the end of the
camping season in 2006 (after Labor Day)?

Consultation with the Shoreland Management Office has resulted In
the following policy concerning remodeling or new construction at a resort
or recreational campgroundt SCfective February 1, l99l| prior to the
Shoreland Management Office Issuing the required permit, you will need to
provide them with a complete plan review form from the Health Department.
(Copy Enclosed).
The addition of permanent rooms and screened porches to recreational
vehicles Is not consistent with the Otter Tall County Recreational
Campground Ordinance, however this construction has been permitted by the
Shoreland Management Office. This policy Interpretation error has
resulted In recreational camping vehicles being altered to the extent that
they no longer meet the definition of a recreational camping vehicle.

The existing construction will be allowed to remain as is and will
be evaluated by the County Health Department on an Individual basis
during routine inspections. This Department will work with the campground
owners In an effort to bring these structures Into compliance with
current regulations. Such structures may need to be reclassified as a
cabin instead of a recreational vehicle.
The construction of permanent accessory structures on recreational ”
camping sites will no longer be permitted. Any temporary accessory
structure such as attached awnings, carports or Individual storage facilities
and accessory structures on manufactured home sites must meet all set
back requirements of the County Manufactured Home Park and Recreational
Camping Area Ordinance.
