October 9, 2007 Joyce Thompson Kyle Westergard called from the site. He had made all the measurements and found that the proposed entry/foyer would be less than 20’ from the ROW and the proposed screened porch would be less than 75’ from the OHWL. He also informed me that this property was probably still considered a “Cluster” since there were multiple dwellings on site. He suggested I discuss this with Bill Kalar, since it would also require CUP approval for the proposed projects. He told me that he would review everything with me when he returned to the office on the 10**’. I reviewed the file again and found that Bill had met with Mr. Chaffee on August 29, 2005. He had prepared a “Cluster Development Pre-Application Meetings Notes” form based on their discussions. I had mistakenly assumed the lot to be considered as “single-family residential” because the file was not indicated as a Cluster File (filed in with the lake files). Based on those notes 1 discussed the property with Bill. He confirmed that this property is still a Cluster and therefore any proposed additions would be considered expansions and require an approved CUP as well as approved Variances. October 10, 2007 Joyce Thompson Kyle discussed his findings with me and I confirmed that indeed he was correct about it being a Cluster. I called Mr. Chaffee and explained everything to him. We discussed the fact that no permits could be issued until Variances had been approved and a CUP had been approved for the proposed additions. I told him that I would return the materials. He asked me to wait until he could determine if he could make it in to the office to file the Variance by October 11* at 3:00p.m. He also needed to discuss all of these issues with his son and daughter-in-law. We also discussed the need to sign the applications and the Waiver forms. Bill had told me that Mr. Chaffee could sign all the forms if he had a legally executed Power of Attorney to act for the family. October 11, 2007 Joyce Thompson Having heard nothing more from Mr. Chaffee since the morning of October 10*, 1 prepared a cover letter and returned the Site Application along with the CUP & Variance materials (see copy in file). Ul V Date L&R Official Action/Comments. f ^ > V J' L & file memo PARCEL #PROPERTY OWNER LAKE/RIVER/WETLAND NAME 1Joyce ThompsonOctober 4, 2007 Mr. Orison Chaffee (father of property owner Orison Chaffee III) brought in copies of application materials for proposed additions to the existing structure (formerly the store building) on this property. His son is out of the country and could not present the materials himself, however he had copies of his proposal sent to his father. Mr. Chaffee requested to speak with me since I had talked with his son during the summer about his proposed plans. I told Mr. Chaffee that we could use the copies as references for reviewing the proposal, however in order to file for actual permits only original documents (application & scale drawing) could be submitted. As we reviewed the proposed plans we discussed that the black top/concrete parking area that was in front of the structure had all been removed. (Note: I had explained to Orison Chaffee (son) during our conversation earlier in the year that before any permits could be issued the impervious cover would have to meet the 25% maximum allowed. What he proposed to do along with what existed on site would have put the lot over the 25%. At that time Orison Chaffee suggested that they could remove the hardscape of the parking area, since they had already made plans to do so in the future. I told him that once the lot was in compliance he could submit the application materials. At the time of that conversation we also discussed the other SMO requirements including setbacks.) Mr. Chaffee and I went over the application form requirements as well as scale drawing requirements in detail. We also discussed all setback requirements until he clearly understood how he was to measure from OHWL, lotlines, ROW, septic, etc. When we started discussing the ROW he was not clear as to how to locate it. I told him that there were triangle-shaped signs along CSAH 1 with “RW” on them - that identifies the ROW. He said he had seen them and didn’t know what they were. I told him the proposed addition to the front of the structure had to be at least 20’ from the ROW of Highway 1. We also discussed the stringtest requirements because he asked about how that was done, since one of the neighbors had built using the stringtest for his location. I gave Mr. Chaffee an application form, several scale drawing forms and the SMO. I told him that he could request that one of our inspector’s make a site visit to verify all setbacks before any permits were issued. He thanked me and left. f'i- Joyce ThompsonOctober 5, 2007 Mr. Chaffee called. He had been able to make all the measurements and was working on the scale drawing. His concern was that the 20’ setback to the ROW could not be met. He said they may have to alter the size of the proposed addition. I told him to bring the scale drawing of the proposals to the office on Monday or Tuesday (10/8 or 9) and we would request a site inspection. If the setback could not be met the property owners would have the option to file for a Variance by October 11* at 3:00 p.m. I reminded Mr. Chaffee that as the agent for his son he could sign the application forms but could not sign the 60-day Waiver. He said that his daughter-n-law was still in the U.S. and he could FED EX the documents for her signatures. It appears from his measurements that all setbacks would be met. However, he agreed that we should request a Pre-Application Site Visit. I told him that I would contact him after the inspection was completed. This policy Interpretation error has resulted In recreational camping vehicles being altered to the extent that they no longer meet the definition of a recreational camping vehicle.
