Notice of Intent to Amend the Otter Tail County Sanitation Code
Motion by Froemming, second by Block, and unanimously carried to set a Public Hearing for
proposed amendments to the Otter Tail County Sanitation Code at 1:30 p.m. on Tuesday, May 6,
2008, at the Government Services Center in Fergus Falls. The notice of Public Hearing will be
published in the Daily Journal according to statutory requirements.
Amendment of Shoreland Management Ordinance
Upon the motion of Commissioner Mosher, seconded by Commissioner Block, and having passed on
a 5-0 vote, the Otter Tail County Shoreland Management Ordinance was amended, as approved by
the Minnesota Department of Natural Resources.
The subject matter and general purpose of the amendments to the ordinance are: To create
requirements for a buildable area and sewage treatment areas on lots; extend the season for earth
moving; modifying impervious surface provisions; modifying presentation requirements for plats;
clarifying “open space” for cluster developments; excluding commercial use areas from residential
area calculations for cluster developments; authorizing existing resorts to modify existing units without
new conditional use permits; modifying building setback exemptions; authorizing the Zoning
Administrator to extend conditional use permit expiration dates; adding consideration factors for
conditional use permits; adding and modifying some definitions; and correcting some wording and
modifying some formatting of the ordinance. The Ordinance as amended shall be in full force and
effect on and after May, 1, 2008.
Complete copies of the amended Shoreland Management Ordinance are on file in the Office of the
County Auditor and the Office of Land and Resource Management in the Government Services
Center, 550 Fir Avenue West, Fergus Falls, Minnesota. Copies are also available at the County web
site, www.co.ottertail.mn.us.
Planning Commission Recommendations
Conditional Use Permit - Carol M. Lindemann and Ernest & Bette Krabbenhoft:
Motion by Erickson, second by Mosher, and unanimously carried to approve a Conditional Use Permit
for a drainage plan received by Land & Resource Management on March 11, 2008 as recommended
by the Planning Commission. The property is described as Maplehurst Lots 6 & 7, Pt GL 2 150’ tr
lying E of & in rear of Lots 1-14 Maplehurst and a portion of Maplehurst Dr., Section 26 of Lida
Township; Lake Lida (56-747), GD.

I Conditional Use Permit - Rev. Philip & Merrie Holt an:
Motion by Nelson, second by Froemming, and unanimously carried to approve a Conditional Use
^ Permit for operation of a woodworking studio with conditions as recommended by the Planning
Commission. The property is described as Lot 4 BIk 1 Patterson Acres, Section 14 of Pine Lake
Township; Big Pine Lake (56-130), GD.
I Conditional Use Permit - Bill <S Mary Beth Boeraer:
Motion by Nelson, second by Block, and unanimously carried to approve a Conditional Use Permit to
operate a commercial woodworking business as presented. The property is described as Pt GL 4
(5.4 Ac), Section 1, Gorman Township; Dead Lake (3-160), NE.
IConditional tlse Permit - Orison Y. & Cassandra P. Chaffe:
Motion by Froemming, second by Erickson, and unanimously carried to approve a Conditional Use
Permit for expansion of dwelling units in a cluster development with conditions as recommended by
the Planning Commission. The property is described as Lots 18 & 19 of Camp Hatton, Section 12,
Amor Township; Otter Tail Lake (56-242), GD.

Orison Y. & Cassandra P. Chaffe - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): I am requesting confirmation of
the two project variances which were granted; 1®' a 6’ x 13’ roadside entryway and a second
lakeside 18’ wide living room decorative dormer. I am also requesting approval to build a
project, for which a variance was not granted, by use of a string line and not a variance. I am
asking for your approval to build a 24’ x 10’ screened in poarch over 24’ of the south east end of
an existing 60’ cement patio. The new poarch would be lOO’"" from the N.E. corner of the lot
OHWL, 80’" from the SE corner lot OHWL, 64’" from the “wading cut out” OHWL of the rocked
beach, and 75’" from the NE portion of the poarch to the rocked beach OHWL. (Note: This is a
Cluster Development consisting of 3 dwelling units.) The property is described as Lots 18 & 19
of Camp Hatton, Section 12, Amor Township: Otter Tail Lake (56-242), GD.
Orison Chaffe and Ty Stortroen represented the Application.
Motion: A motion by Estes, second by Schwartz to approve provided the following conditions
are met, prior to the Site Permit being processed: 1. The impervious surface be compliant, and
monitored by Land & Resource Management. 2. The vacation of CSAH #1 is complete and
recorded. Voting: All members in favor.
Ken & Donna Pluck - Denied:
A Conditional Use Permit Application (as stated by the Applicant): A Conditional Use Permit is
request to haul in 927 CY of granular fill material. The fill is required to maintain a three foot
vertical separation between the Ordinary High Water Level and the finished floor elevations of
the proposed house, garage and storage shed. The fill will be hauled in from an approved and
licensed gravel pit. A quantity of 330 CY of existing site top soil will be stock piled north of the
proposed storage shed. The existing site soil will be re-used for shaping, grading and to provide
drainage swales and storm water control. The property is described as Pt GL 9, Section 4, Otter
Tail Township; Otter Tail Lake (56-242), GD.
Chad Rushin (Nor-Son Construction) represented the Application.
Motion: A motion by Wilson, second by Maske to deny, due to the following reasons: 1. The
potential environmental impact (topography). 2. The request is not suitable for the proposed
use. 3. It appears that this is a request to create a lot to suit a house. Voting: All members in
favor.
No Formal Action: Bill Kalar informed the Commission of the following:
1. The Pierre & Mary duCharme decision (by the County) has been appealed.
2. We have received a letter from the DNR stating that our Shoreland Management
Ordinance Revision is substantially in compliance. Since this is the case, next week the
County will determine its enactment date.
Adjourn: At 8:45., Chairman Olson set the Meeting. The next Meeting is scheduled for 6:30
P.M. on April 16, 2008.

Since no bedrooms are being added. It does meet code at this time.
