Re: Attention: R. B. Newman Dear Mr, Newman: Pursuant to our telephone conversation of this date, I have now considered the matter of the pending application of Bonnie Beach Resort for a beer license, which application as I understand it will be the subject of a hearing before the Coianty Planning Commission at Fergus Falls, Minnesiia, on this date, June 6, 1973. This letter will give you my comments. 1, All previous applications for beer licenses in Clitherall Township outside of incorporated municipalities whee the application is subject to the other jurisdiction, have been denied as a matter of policy established by the Town Board of Clitherall Township and followed without variation for years. The Town Board has the authority to establish such a policy and once established, that polic3’’ ■will continue until the Board itself sees fit to change it or in the alternative the voters of the township, at a regular or special meeting called for the purpose, vote to approve the issuance of beer licenses by the Town Board and instruct the Town Board to change their policy accordingly in an instance of a proper applicant. The current rejection of tte Bonnie Beach application is merely a continuance of that policy upon which no change ha s ever been ordered by the voters of the township. 2, The area in which the Bonnie Beach Resort is located is and has been for many years a quiet year-round and seasonal recreational dwelling area ‘in an atmosphere upon vjhich its residents, both permanent and seasonal, have come to rely and to obtain which they acquired their properties in that area. The recent extension of drinking privileges do-wn to the age of 18 years adds a large segment of the population to the potential list of customers of such a license to be established. As this Board of Supervisors June 6, 1973 Page 2 void be the only licensed establishraent in the tovmship outside of municipalities and located in the lake area, it could draw a considerable amount of traffic from the recently franchised drinkers who seem, to be equipped with motor vehicles of every type and description and the resulting turmoil of travel could become a public nuisance affecting the entire beach and residential area. Should such a situation arise, the property owners who object to the license and others in the area would be required to expend funds for the suppression of a public nuisance. 3. The property owners in the near vicinity of the proposed license are the ones most strongly effected but because of the nearby township road running on the beach area resulting traffic could also cause problems for others not in the inmediate vicinity. If people affected in either fashion objected to the issuance of such a license there wishes should be given primary consideration over any support for the issuance of the license given by people who live in areas more remote from the proposed license site and who would in all probability not be personally effected by any adverse situation that might be created. 4. The power of issuing beer licenses is mcst exclusive in the Town Board of each township. Only if the action of the Town Board can be legally established as arbitrary.or resulting from prejudice or discrimination can the matter be taken to the district court by way of appeal. So far as statutory law is concerned, only the Town Board of Clitherall Township and the District Court of Otter Tail County has jurisdiction to even consider this problem. Very truly yours. This was received by the Board of Supervisors at their regular meeting on Tuesday, April 10th. f ’ Mr. & Mrs. Crow were informed by the Chairman, Earl Hustad, that due to the absence of one of the supervisors, consideration would be given at a later date. s The Clerk was instructed to send the application to the Sheriff of Otter Tail Coiinty for checking, which was done. The Board of Supervisors further considered the application on April 19, 1973. "Resolved that the TownEarl Hustad offered the following resolution; Board of Clitherall do not approve the issuance of a beer license to Bonnie Beach Resort, for the sale of non-intoxicating malt liquor". Battle Lake, Minnesota 56515 ! iJune 6, 19T3 Mr. Bob Fritz, Chairman Otter Tail County Planning Advisory Ccmmittee Otter Tail County Court House Fergus Falls, Minnesota 5653T5 Dear Mr. Fritz: The Clitherall Township Board of Supervisors received notice of a hearing on application of Frank Crow, Bonnie Beach Resort, for a retail (on-sale) and (off-sale) non-intoxicating malt liquor license. The original application was made by Frank and Deloris Crow, at a regular meeting of the Clitherall Board of Supervisors on April 10, 1973. Earl Hustad, Chainnan of the Board of Supervisors, stated at the meeting that no licenses to sell non-intoxicating malt liquor had been granted in Clitherall Township. There have been other requests in the past. Due to the absence of one of the supervisors, it was stated consideration of the application would be held at a special meeting in a week. 'J The special meeting was held on April 19th to consider the application. Earl Hustad offered the following resolution: "Resolved that the Town Board of Clitherall do not approve the issuance of a beer license to Bonnie Beach Resort, for the sale of non-intoxicating malt liquor". The resolution was seconded by Kermit Boyum. On roll call the vote was: Aye - none Nay - three. The Board of Supervisors of Clitherall Township are of the same opinion today. Since I am unable to attend the hearing in person, I xvish to advise you in v/ritlng of my oppositioh to this petition. I feel that the granting of such a license v/ould lead to an upsurge of traffic in an area unsuited for and incapable of coping with such traffic, to a possible influx of detrimental Influences, and to the disruption of tran.^uillty in an area set asioe for ^.uiet relaxation.
