Mr. Sucher, This is a follow up letter regarding the ongoing issues with the new portable screen porches, decks or platforms. The Otter Tail County Shoreland Management Ordinance (SMO) does allow commercial planned unit developments (PUD) to have unenclosed decks no larger than 200 square feet in area. In addition, the decks must meet all the other requirements of the SMO and don't need a permit. Any screen porch and deck over 200 square feet in area require a variance and conditional use permit. It is possible to put all the portable screen porches and any decks exceeding 200 square feet on the same variance and conditional use application. Please keep in mind that you can replace camper for camper without a permit. If you replace a mobile home with a camper that would require a conditional use permit due to change in type. I have enclosed a copy of the SMO information regarding decks and screen porches for your convenience. Please contact our office on or before March 1, 2018 so we may resolve these matters. Mr. Sucher, On June 16, 2017 our office received a complaint on your property regarding replacing trailers, building additions and septic issues. I was onsite on June 26, 2017 to investigate this complaint. While onsite, I did notice multiple new portable screen porches, decks or platforms. While reviewing your file, the last screen porch permitted was in 1996. Portable screen porches and decks are considered structures and therefore are to be permitted. Have any trailers or campers been replaced recently? Also, has any maintenance (pumping) of your septic system occurred recently? Please contact our office on or before July 14, 2017 so we may resolve these matters. Thank you. All new manufactured homes parks constructed after January 1, 1970, and additions to existing manufactured home parks constructed after January 1, 1970, shall allot the following minimum site sizes for each manufactured home; square feet if sewage from the park is discharged into a sc 1 absorption system; 2,800 square feet if areas, recreational camping vehicles shall be separated from each other and from ocher structures by at least 10 feet. Any accessory structure such as attached awnings, carports or individual storage facilities, shall for the purpose of this separation requirement, be considered to be part of the recreational camping vehicles. A minimum site size of 2,000 square feet shall be provided for each recreational camping vehicle in camping areas constructed after January 1, 1970. All recreational camping vehicles shall be located at least 25 feet from any camping area property boundary line abutting upon a public street or highway and at least 10 feet from other park property boundary lir.es. 4,000 D. Domestic Animals. No domestic animals or house pets shall be allowed to run at large or commit any nuisances within the limits of a manufactured home park or recreational camping area. Any kennels, pens or other facilities provided for such pets shann be maiiitained in a sanitary condiciot; at all times. E. Water Supply. An adequate supply of water of safe, saciitary, potable quality shall be provided in each manufactured home park and recreational camping area. When a satisfactory public water supply is not available, an individual water supply system may be developed and used, but such seur:e of supply shall first be approved by the Department and the Minnesota D'-partment of Health.In manufactured home parks, the water supply shall be capable of supplying a minimum of 150 gallons per day per manufactured home, and in recreational camping areas, the water supply shall be capable of supplying 50 gallons per site per day for all sites lacking individual water connections, and 100 gallons per site per day for all spaces provided with individual water connections. In recreational camping areas water from the drinking water supply shall be available within at least 400 feet of every carpsite. (Copy Enclosed). The addition of permanent rooms and screened porches to recreational vehicles is not consistent with the Otter Tail County Recreational Campground Ordinance, however this construction has been permitted by the Shoreland Management Office. This policy interpretation error has resulted in recreational camping vehicles being altered to the extent that they no longer meet the definition of a recreational camping vehicle. (Copies Enclosed). The existing construction will be allowed to remain as is and will be evaluated by the County Health Department on an individual basis during routine inspections. This Department will work with the campground owners in an effort to bring these structures into compliance with current regulations. Such structures may need to be reclassified as a cabin instead of a recreational vehicle. The construction of permanent accessory structures on recreational camping sites will no longer be permitted. Any temporary accessory structure such as attached awnings, carports or individual storage facilities and accessory structures on manufactured home sites must meet all set back requirements of the County Manufactured Home Park and Recreational Camping Area Ordinance.
