In the Matter of the Application for the vacation of a portion of that certain public road which is a part of the Plat of Anderson Beach JUDGMENT The above entitled matter came on for hearing before the undersigned Judge of the above court at the Court House in the City of Fergus Falls, County of Otter Tail, State of Minnesota, on the 29"' day of December, 2011, at 1:45 p.m. upon the Petition of Eldevick Resort Limited Partnership; for the vacation of a road as described herein. Petitioner Eldevick Resort Limited Partnership appeared by its counsel, Greg Larson, Attorney Registration No. 311820, Svingen, Cline & Larson, P.A., P.O. Box 338, Pelican Rapids, Minnesota 56572. There were no appearances made by or on behalf of any person other than the petitioner, either in person, by counsel, or in any manner whatsoever. Due proof having been filed with the Court, that the Order and Notice for Hearing has been served, published and posted, as required by law; and it further appearing from the Affidavit of No Answer Hied by Greg Larson, the attorney for the plaintiff, that no notice of appearance, answer or other pleading has been served by or on behalf of any person. fhe Court, having heard the matter, has duly made and filed herein its Findings of Fact, Conclusions of Law, and Order for Judgment. NOW THEREFORE, pursuant to said Findings of Fact, Conclusions of Law, and Order for Judgment, IT IS HEREBY ORDERED, ADJUDGED AND DECREED AS FOLLOWS: I. That Applicant Eldevick Resort Limited Partnership is the owner of the following described real estate located in Otter Tail County, Minnesota, to-wit: Lots 1, 2, 3, 4 and 5, of Anderson Beach, and the following described tract, to-wit: All that part of Government Lot 4, of Section II, Township 137, Range 43, within the following boundaries: Beginning at the southeast corner of said Government Lot 4, thence running due West a distance of 272.5 feet along the centerline of the township road as now located; thence running North 29 degrees 43 minutes West along the average tangent center line of the existing township road for a distance of 1370 feet to a point on the south line of the access roadway to Anderson Beach; thence running South 87 degrees 9 minutes West along said south line of said access roadway a distance of 490 feet; running thence South 79 degrees 41 minutes East along the south line of said access roadway a distance of 75 feet to a point on the westerly boundary line of Anderson Beach, as now surveyed, platted and recorded; thence running in a southeasterly direction following along the said westerly boundary of said Anderson Beach, a distance of 770 feet to its intersection with the East boundary line of said Government Lot 4; running thence South along the East line of said Government Lot 4, a distance of 602.5 feet to the point of beginning, and said tract containing 12.6 acres, more or less. II. That there shall be vacated herein that portion of the public/platted road located in the County of Otter Tail. State of Minnesota, and is legally described as follows, to-wit: DESCRIPTION OF ROAD TO BE VACATED: All that part of the Public/Platted Road, as dedicated in Anderson Beach, said plat is on file in the office of the Recorder, Oiler Tail County, Minnesota, which lies southerly of the westerly extension of the northerly line of Lot 5, said Anderson Beach. Be sure survey - shows land height above vtater level. In addition you should have percolation tests of the area made and also determine where the ground water table ia located. Thus you will be in a better position to draw up an acceptable plan or have a professional sewage system engineer design a system for you. The system to which you refer at Horseshoe Bay Lodge on Leech Lake is operating on an experimental basis subject to the collection of certain data relating to soils, soils effluent, sewage effluent, etc. the system will be judged on the basis of this collected data by the Minnesota Department of Health and by the Minnesota Pollution Control Agency. The success or failure of At this date there are no general design criteria that would apply to all spray disposal systems. Each design would have to be considered individually and approved by the Minnesota Pollution Control Agency. It is necessary to have an accurate site survey of the property involved. There are minimum distances from the disposal area to the nearest human dwelling. As you probably recognize, the spray disposal of the sewage effluent is g£aSflJig^,^ndthus^__^g£iiip- vision must be made for considerable storage during the months when the etflu-"-'-. ent cannot be sprayed on the land. Thus storage ponds will be required. At the present time there is some consideration that it may be necessary to chlo­ rinate the sewage effluent prior to spray disposal. This decision will likely be made based upon the work being done in Minnesota and in other states. a; I am wondering if you have considered the possibility of effluent disposal by the use of a soil absorption system. If adequate area of a suitable soil is available, I believe that this is an alternative which should seriously be considered. If the soil is suitable, a properly designed soil absorption system__ can operate satisfactorily as a disposal method. Since you indicate that you have a trailer park, I believe that you should con­ tact the Minnesota Department of Health for their regulations concerning trailer parks.
