Victor Petterson, Chairman, Otter Tail County Planning Commission. Application for Variance and Conditional Use Permit "by Mr. Charles Hayes of BayView Shores Resort at the west end of Pelican Lake. TO; RE; Mr. and Mrs. Daniel K. Reitan; permanent residents, registered voters of Pelican Lake, Pelican Rapids, Minnesota. FROM: The Department of Land & Resource Management provides for rules, reg ulations and guidelines for the necessary protection of the lakes, shore lines, general lake surroundings, and lake property owner-taxpayers from overcrowding, non-code structures, and non-code unsafe sewer and water systems on lake properties. No doubt there are many other additional, desirable, protective measures provided by the Department of Land & Resource Management and County Boards. These officials have been doing a good job which is appreciated by the lake residents who realize the importance and necessity for the regulations and their enforcement. This present application by Mr. Charles Hayes for a Variance for more trailer-homes is very disturbing and violates the regulations for over crowding and shoreline safety.We are greatly in opposition to more trailers and the request to relax the code-requirements for lake frontage per dwelling and code-requirements concerning road right-of-way setbacks. BayView Shores is presently in violation of existing code and there is no logic and it would be a dangerous precedent to allow BayView Shores Resort to violate further these requirements - this would be unduly discriminatory toward the neighbors and the many other code-abiding lake residents. The residents in the BayView Shores Resort area have been talking about petitioning County Officials for a reduction in the magnitude of the Resort operation and population because of the unsafe conditions this overcrowding causes along the shoreline and the hazard to the entire bay swimming and boating activities. The rights of the lake residents are seriously curtailed by the magnitude of the BayView Shores Resort present size; i.e. rights to utilize and enjoy their hard-earned, highly taxed property in a normal manner; rights to have a safe water area for swimming and fishing; rights to venture out in the Bay waters in their own boats without fear of the many high-powered transient boats from the Resort zig-zaging at excessive speeds from all directions. The mentioned decrease in the number of campers is of trivial consideration and useless to attempt to monitor as these campers come However, the proposed increase in mobile home- house trailers (which translates into further overcrowding, overpopulation and code violations) would be an increased injustice to the lake, the shoreline, and entire bay area. Lastly, the lake residents realize the Department of Land & Resource Management, the County Board of Adjustment, and the County Planning Commission need to hold the Variance hearings soon after such applications are filed. The property owners affected have long noted the fact that these commercial enterprises carefully orchestrate these applications to occur during the winter months when the lake residents are absent; and they rely on this timed disorganizing effect to force their proposals past the County Board and/or Planning Commission. and go on a daily basis.
