Under requested variance we would like the setback to be 17’ which is less than the required 50’, asking for a variance Of 33’. Current setback on south line is 17’. Under requested variance we would like the setback to be 18’ which is less than the required 50’, asking for a variance of 32’. the units as situated now are within 25’ of the ordinary high water mark. We are proposing to situate the new units at least 37.5’ from the ordinary high water mark. This is closer than the required 75’, asking for a variance of 37.5’ but further back than the current units. The requested variances are for the following project; We would remove 7 units on the lake side (units 1-7) and replace with 4 duplex cabins. Units 8 across the road would be removed so we would stay within our 11 rentals. Unit 10 is on the upstairs of the duplex house. We will reside in Unit 11. There is now 11,067 square feet of structures. Our new proposal would be 9,664 square feet with 4 new buildings and leaving Unit 9 across the road. We propose to do this renovation over a period of 3 to 5 years. Of 100’ and a variance of 14' from the required bluff setback of 30’ for the construction of an addition 64’ from the ordinary high water level and 16’ from the top a bluff. September 1, 2005 Meeting - The audience was polled with no one speaking for or against the variance as requested. Letters from Corey Nyhus and Gregg Schuler in support of the variance as requested were read for the record. After discussion and consideration, Steve Schierer made a motion, second by Joe Maske and unanimously carried, with the verbal agreement of the applicants, to table this variance request until the September 8, 2005 meeting to allow the applicants an opportunity to consider other alternatives. September 8, 2005 Meeting - After discussion and consideration, Michael Conlon made a motion, second by Paul Larson and carried with Cecil Femling voting no, to approve a variance of 36’ from the required ordinary high water level setback of 100’ and a variance of 10’ from the required bluff setback of 30’ for the construction of an addition 64’ from the ordinary high water level and 20' from the top of the bluff as depicted on the revised drawing submitted, by the applicants. The revised drawing has been dated September 8, 2005 and has been placed in the applicants’ file. The Board noted that the variance as approved will provide the applicants with a reasonable use of there property and will allow them to enjoy the same rights and privileges as others in the immediate area. The resort has been in business for decades. The units were placed on the property in the early 60’s and are now is need of updating and repairs to keep up with our guests changing expectations. Attachment A shows the property as it is situated now with the current setbacks. Due to the unique shape of our parcel of land we are requesting the following variances. The current setback on the north line is 7’. Under the requested variance we would like the setback to be 17’ which is less than the required 50’, asking for a variance of 33’. The current setback on the south line is 17’. Under the requested variance we would like the setback to be 18’ which is less than the required 50’, asking for a variance of 32’. The units as situated right now are within approximately 25’ of the high water mark. We are proposing to situate the new units at least 37.5’ from the high water mark. This is closer than the required 75’, asking for a variance of 37.5’, but further back than the current units. Attachment B shows the proposed renovations. We will not be in code by requesting these variances, but we will be closer to code compliance than we are currently.
