Marc Gruenenwald brought his Application for Site Permit to the office for a proposed 8’x 16’ storage
structure on the back lot of the resort. He had previously worked with Marsha Bowman, however she was at
lunch when he arrived. 1 went over the application materials with him and it appeared that the structure
would meet all SMO requirements. 1 verified that a CUP would not be required because this is a storage
structure, not a dwelling structure, and would be considered an expansion of the resort business. As I was
preparing to issue a Site Permit Marc asked if he could get a Site Permit for doing work to replace the roofs on
two existing mobile homes also located on this backlot. He said that he had mentioned it to Marsha during
his previous office visit but there had been no definite discussion about it. 1 asked what he was planning to do
to the mobile homes and he told me that they want to put new siding, new windows (standard windows) and
peaked roofs on them. 1 told him that no permit was required for the siding or the windows or even for new
shingles, however the peaked roof lines would be a change in the size (height) and shape and would require
approval of a CUP by the Planning Commission/County Board before a Site Permit could be issued. Marc
stated that he thought the new SMO made allowances for “existing resorts” to make additions without the
need for a CUP. 1 told him that 1 thought this pertained mostly to changes required under the ADA act, but
that 1 would have to discuss it with Bill Kalar. 1 also asked Mavis Samuelson about it and she agreed with me
that it was her understanding that there had to be some type of requirement for the change or addition before
we could use the exemption from the CUP requirements. Marc left two different application forms just in case
he doesn’t have to follow the CUP Application process: An Application for Site Permit for the 8’ x 16’ storage
structure only and an Application for Site Permit for the 8’ x 16’ storage structure as well as the two mobile
homes (14’ x 70’ and 16’ x 80’), however he left only the check in the amount of $105.00.

I discussed with Bill the proposal to put new peaked roofs on the existing mobile homes at Barky’s Resort. I
asked him about the “exemption” in the new SMO for “existing resorts”. He said the MN Statute that is
referred to makes it clear that any changes or additions must be required by a federal, state, or local code or
official agency. If the resort owners can provide documentation that the proposed change or addition is in
order to bring the structure into compliance with a code requirement then we can process a standard Site
Permit. If however the proposed change is to improve the look or function of a structure without a required
change then they must go through the standard CUP process. I contacted Marc and explained this to him. He
then asked about just replacing the existing mobile homes with new mobile homes of the same size. I referred
his question to Bill and Bill told him that indeed they could remove the existing mobile homes and replace
them with new mobile homes of the same size - but that would have to be same length, same width AND
same height. Otherwise they would still need a CUP before a Site Permit could be issued. Marc told Bill that
he would think about it and probably file for the CUP. I placed a call to the resort late in the afternoon to ask
Marc if he still wanted the separate Site Permit for the storage structure or if he wanted to hold off until he got
the CUP for the new roofs on the mobile homes and then apply for one Site Permit. He was unavailable at the
time of my call, I spoke with Kathy Gruenenwald. She indicated that she would have Marc call me back.

Marc Gruenenwald called and asked me to go ahead and issue the Site Permit for the 8’ x 16’ storage
structure. He will come in to make application for the CUP for the roof changes on the two mobile homes. He
asked to schedule an appointment with Bill to discuss this and I transferred him to Bill’s phone to make this
appointment. I processed the Site Permit for the storage structure and sent it in the mail (#24656).

This review does not pertain to the Engineering design (i.e., plumbing, swimming pools, service
connections, sewage systems). A separate report regarding the Engineering Review will be sent.

The following are corrections or requests for additional information necessary before
construction of your project:
Scope of project: new construction of seven rental units added to resort. Septic compliance
and water supply information of record. Contact Mr. Rick Toms when units are ready for
inspection.
1. Every building structure, or enclosure shall be kept in good repair and maintained to
promote health, comfort, safety and well-being of persons accommodated, shall be kept
clean and free of litter or rubbish.
2. Floors shall be smooth, easily cleaned, shall be kept clean and in good repair. Abrasive
strips for safety purposes may be used to prevent accidents.
3. Walls and ceilings shall be kept clean and in good repair. Studs, joists, or rafters shall not
be left exposed unless suitably finished and kept clean.
4. Every room occupied for sleeping purposes by one person shall contain at least 70 square
feet of usable floor space, and every room occupied for sleeping purposes for more than one
person shall contain not less than 60 square feet of sable floor space for each occupant
thereof Under no circumstances shall there be less than 400 cubic feet of air space per
occupant. Usable floor space excludes closets and bathroom areas. Beds placed side by
side must be separated by a minimum of three feet.

All equipment, fixtures, furniture and furnishings, including windows, draperies, curtains,
carpets, electrical appurtenances, decorative or utility items shall be kept clean and
maintained in good order and repair.

Toilets and bathrooms shall be kept clean and in good repair and shall be well lighted and
ventilated.
7.
All lavatories for public use or furnished in guest rooms shall be supplied \vith hot and cold
running water and soap. Approved sanitary towels or warm air devices shall be provided for
hand drying.
8.A safe adequate supply of water shall be provided and shall be located, constructed, and
operated in accordance with rules governing water supplies.
9.The temperature of hot water which is provided in any public area or guest room, including
but not limited to lavatories, bathtubs or showers, shall not exceed 130 degrees F
(approximately 55 degrees C).
Plans On the plumbing system have not been submitted. The necessary information for
submission of these plans is enclosed.
10.
11. All fire protection measures shall be in accordance with requirements of the State Fire
Marshall.
12. A separate on-site inspection will be conducted by the State plumbing inspector to determine
compliance with the Mirmesota Plumbing Code. ^

We have entered into a purchase agreement with Tim and Theresa Cole to
buy Barky’s Resort on Ottertail Lake. We will take over ownership on or
before August 1, 2005. We would like to remove the old units and replace
with new ones.
Proposal:
We would remove 7 units on the lake side (units 1-7) and replace with 4
duplex cabins. Unit 8 across the road would be removed so we would stay
within the 11 rentals.
There is now: 7,468 sq. ft. on the ground as rental units.

Our new proposal would be 7,392 sq. ft. with 4 new buildings and leaving
unit #9 across the road.
Our goal is to offer a family oriented resort at an affordable price that would

I have been asked to review your file regarding your license
status.It is my understanding that you rent out 11 units.
Three units are available for rent to more than one party per
Eight units are rented seasonally.You are currentlyseason.only licensing the three units.
Otter Tail County Lodging Ordinance does not differentiate
between seasonal or year round rental units. If you feel the
eight units are not part of the resort, they would then be
considered a mobile home park and that ordinance and licensure
fee would apply. The assessor's office states you are currently
taxed for 11 units as a resort. Mobile home park tax rates are
considerably higher than resort rates.
I realize you have been paying this type of license fee since
1990. It is our error that this was not corrected in 1930. As
such, we will correct the error now in 1992, so that all
operators are treated the same in our county.
Please forward to this office either:
1) $21.60 for the 8 units as a resort
OR
2) A completed application for a mobile home park license
You must bewith the $20.00 fee for a seasonal park,
able to comply with the mobile home park ordinance, a
copy of which is enclosed.
Penalty fees will be waived if fees are received prior to July 6,
1992.If not received by that date, penalty fees shall be paid.
