Planning Commission November 16, 2005 Page 2 necessity of the retaining wall and indicated there is reasonable use without the retaining wall; he requested denial. Motion: A motion by Trites, second by Schwartz to deny for the following reasons: 1. This request negatively impacts the bluff creating the potential for erosion that could adversely affect the lake and adjacent property owners. 2. The integrity of the bluff has already been threatened when the vegetation was removed. 3. The owner can enjoy reasonable use of this property without this requested alteration. 4. Granting of this request would establish a precedent contrary to the intensions of the Otter Tail County Shoreland Management Ordinance, and to past practices of this Planning Commission. Voting: All Members in favor. Brad Dirkman - Tabled to April 12. 2005: A Conditional Use Permit Application (as stated by the Applicant): 1) Transfer soil from highest point on Lots 1 & 2 to fill lowest points on Lot 1. 2) Blend/level previous gravel pit area on Lot 1. 3) 300 - 500 yds soil moved total. 4) Max cut depth @ 1 ft. 5) Max depth of fill @ 2 ft in any area. The information must be received by Land & Resource Management not later than March 15, 2006. The areas (dwelling and septic system) must be staked onsite, no later than April 1,2006. Voting: All Members in favor. Jav Turner - Approved As Presented: A Conditional Use Permit Application (as stated by the Applicant): Please consider this a request for an After-the-Fact Conditional Use Permit to allow a previously installed natural boulder wall to remain in place for the preventive retention of soil due to excavation for dwelling footings. The wall maintains an average height of approximately 4’ and protects the toe of the hillside from slumping. Length of wall is approx. 80’. The property is described as Pt of GL 3 ..., Section 3 of Dunn Township; Pelican Lake (56-786), GD. Mike Lloyd and Jon Gunkelman represented the Application. Motion: A motion by Erickson, second by Schwartz to approve as presented for the following reasons: 1. The project would have been approved if requested prior to the installation. 2. The project will not have an adverse effect on the lake. 3. Removal would destabilize the area. Note, that if this project is located in a bluff, an After-The-Fact Variance is required. Voting: All Members in favor. Barky’s Resort - Approved As Presented: A Conditional Use Permit Application (as stated by the Applicant): Requesting a Conditional Use Permit to continue to operate as Barky’s Resort, but to replace existing units 1 - 7 along the lake with 3 duplex cabins and one single cabin.
