Joyce ThompsonDecember 12, 2005 Rick Miller, Contractor, called to ask about adding 4’ walkways across the front of the house he is building for Mary Schommer on this property. According to Rick, Ms. Schommer told him that while she wouldn’t be able to have a deck built on the front of the house she could have 4’ walkways as she was told by the gentleman at the meeting she attended. Ms. Schommer told Rick that she wanted a walkway built across the front of her home on the 2"‘* level as well as the loft level, thereby giving her two 4’ walkways. I pulled the file and found the documentation from both the Variance that was granted on 7 /14/05 as well as the CUP that was approved on 8/ 17/05. I told Rick I would read through the materials and call him back. After reviewing the CUP and Variance documents I was unable to find any indication that Ms. Schommer could have “walkways” built. She received a Variance from the BOA to build a replacement dwelling and a deck no closer than 37 14 feet from the OHWL. This Variance was granted based on her request for a replacement year-around home and a deck. At no point did she request more than one deck on multiple levels of the proposed home. There was nothing in the minutes from that BOA meeting that indicated she could have a “walkway” rather than a deck. And the subject was not addressed in the minutes from the Planning Commision Meeting of August 17, 2005. I also took the materials to Bill Kalar and discussed the situation with him. I told him that my understanding of what had been granted to Ms. Schommer was a Variance for a dwelling and a deck no closer than 37 14’ from the OHWL. He agreed with me and also agreed with me that there was nothing in the minutes from either meeting that would allow Ms. Schommer to have walkways on the front of the dwelling. He suggested I obtain the taped record of the BOA meeting from 7/14/05 and listen to determine what discussion took place and what, if anything, may have been said about walkways. I also asked Bill if this subject had come up at the Planning Commission Meeting and he said it was never discussed. I called Rick Miller and explained to him what the Variance was for. I also told him that according to Tim Griep’s inspection report for Site Permit #22682 (11/2/05), the new dwelling was 38’ from the OHWL, which means that there is no room for a deck on the lake side of the house. 1 also told him that I could find no record of a discussion regarding walkways. Rick said he would contact Ms. Schommer. Joyce ThompsonDecember 12, 2005 Mary Schommer called me after she was contacted by Rick Miller. She insisted that she had been told by the gentlemen at her meeting that she could have 4’ wide walkways on the front of her house without the need for any Variance or permits. She also insisted that this had taken place at the Planning Commission meeting with Bill in attendance. I told her that she was possibly confusing the two meetings and explained that I would obtain the tapes from both the Planning Commission and BOA meetings and would contact her after Ustening to both tapes. # - ^00^1^ fMjmrrUAj dUl M'f- I listened to the tapes from the July 14, 2005 BOA meeting and the August 17, 2005 PC meeting. There was nothing said at the PC meeting with regards to walkways. The Planning Commission recommended approval of Ms. Schommers request based on the Variance granted by the BOA in July for the dwelling and a deck no closer than 37 14’ from the OHWL. However, the taped minutes of the BOA did reveal that after the BOA members had voted to approve Ms. Schommers request for the replacement dwelling with a deck there was discussion about walkways. Ms. Schommer had expressed her displeasure in having to move the house back further to allow for the deck she wanted. She was concerned that this would cause problems with the neighbors because they did not want her to block their view on the road side of the houses on this property and moving the house back further might do exactly that. The Board members explained that while that might be a concern their reasons for granting the Variance at 37 14’ from the OHWL was to give her reasonable use of the property to build a dwelling with a deck. They agreed that this would be an improvement over the existing structure but emphasized that they wanted the new structure and deck moved back on the lot. One of the BOA members stated that Ms. Schommer could put a 4’ wide walkway on the house without the need for a Variance or permit from Land 8s Resource Management. There was discussion about this among the members and it was also brought up that they had told another applicant the same thing at an earlier session of this meeting. The result of this conversation was that the BOA felt that she could have a 4’ wide walkway on the 2"'* level of the house, however it could not be built across the entire length of the house, but a walkway with stairs giving her access from the 2"<* level. There was no discussion of multiple walkways nor did the BOA members indicate that this walkway was to be treated as a deck. I called Ms. Schommer and told her what I had heard on the tapes. I also explained that Bill had listened to the tape with me and that we determined that she could, have what amounted to a landing with stairs coming off the second level of the dwelling and that the landing could not exceed 36 square feet in size. I also pointed out that while the BOA had introduced the walkway idea, there was nothing in the SMO that addresses walkways. This would be the only option we could allow. The 3'''* or loft level of the dwelling will not be allowed a walkway or . landing of any type. As for the lower level, she can have a patio as she had planned provided it does not exceed 36” in height. Ms. Schommer disputed my interpretation of the tape so 1 told her that when a time was convenient for her to contact me aind come to the office, I would have the tape ready for her to listen to. She said she was currently working in Montanna and that she would call me upon her return to this area and ■ schedule a time to come to the office. In the meantime she would contact Rick Miller and tell him not to do 1., anything with regards to a deck/walkway/landing until the matter was cleared up. ) .'Ti
