Caristen, Rt. 1, Eagle Bend, MN. 56446 I; ? - 5 ■}' Thomas Allstopp - Spitzer Lake» No. 56-160 1)Letter dated March 8» 1982 from Mr. & Mrs. Allstopp to our office re­ questing a permit for the construction of a 20’ X 34' cabin on tract Ef Sec. 19» Leaf Mountain Twp. 2) March 12» 1982 letter from Tim Griep of our office to Mr. Allstopp requesting more information regarding the location of his proposed cottage. 3) On or about March 15» 1982 our office received a call that a house was being moved across Spitzer lake and would be placed in in illegal location on a lot. 4) March 15, 1982 Tim Griep and myself went out to investigate the aforementioned complaint and found that a house had indeed been moved across the ice as was evident by the tracks in the snow. By following the tracks we soon came upon a burned out house still a trailer on the lake (see photographs #1, #2, and #3). When we first arrived onsite no one was present, however, a moving truck with the name Badger Movers (photograph #4) on it was present as were building footings onshore (photograph #5). The building footings were found to be approximately 33' from Spitzer lake at their closest point whereas the required distance is at least 200' since Spitzer lake is classified as a Natural Environment lake. Several minutes after we arrived on the scene several men arrived and said they had been hired to place the aforementioned house on the footings which had been installed. I told them that the setback of the footings was sub­ standard and that the house should not be placed there. One of the movers said that was not his problem but was Mr. Thomas Allstopp's problem since he was the owner. He also said that the plan was to place the house on the footings. When we left the scene the house was still on the lake. 5) On March 16, 1982 Mr. Allstopp was contacted by telephone: a) He said that he had applied for a permit for his house - I told him that applying for and receiving a permit were two different things. b) He said that he had contacted our office previously and was told that exceptions to the setback requirements were made for points and islands - I told him that variances could be granted in certain instances for minor variations in setback requirements but that a variance of approximately 170' would have to be approved by the Otter Tail County Board of Adjustment. c) I mentioned that a sewage system would have to be located 150' from the Ordinary High Water Mark of Spitzer lake - he said he would only have an outhouse for this cabin - I told him that an outhouse was considered the same as a sewage system. d) I gave him two options: 1. Move the house off of the lot immediately. 2. Apply for and receive a variance from the Board of Adjustment if the house is to remain in it's present location - if the variance application is denied the house would have to be removed. e) He said the existing mobile home would be moved off of the lot once the cabin was finished. Sent Mr. Allstopp a variance application form, on or about March 16,6) 1982. On April 8, 1982 our office received Mr. Allstopp*s variance application and scheduled his application with the Board of Adjustment on May 6, 1982. Also, apparently received a Site Permit signed by Mr. Allstopp dated April 3, 1982 which is to be held until the Board of Adjustment grants approval for the location of his house (to date this approval has not been given). 7) 8) On May 6, 1982 the Otter Tail County Board of Adjustment denied Mr. Allstopp's variance request "because of failure to prove a hardship shown for justifying violating the standards set forth in the ordinance",' On May 13, 1982 letter from Mike Kirk to Mrs. Allstopp regarding her lot being substandard in size and her house being illegally located. 9) 10)Letter from Mike Kirk to Mrs. Allstopp regarding the removal of the house from the lot on July 16, 1982. 11) On June 3, 1983 our office reinspected the Allstopp property - house still there as can be seen in photographs lA through 4A. In addition to the illegally placed house and the old mobile home a small camper was seen on this property (on June 8, 1983 the Otter Tail County Sheriff's office ran a license plate check and it was found that Mr. Allstopp was the last registered owner). 12) On June 21, 1983 our office received another variance application signed by Mr. and Mrs. Allstopp from Mr. Robert Bigwood of the Rufer law firm. This application was then scheduled with the Otter Tail County Board of Adjustment on August 4, 1983. 13)The Board of Adjustment denied Mr. Allstopp's second application on August 4, 1983 for a variety of reasons including: a) Failure to show a hardship. b) The area clearly has other non-building uses. c) Aesthetic reasons. d) A precedent would be set etc. 14) On October 3, 1983 our office received a third variance request ap­ plication from Mr. Allstopp. This request differed from the previous two requests in that this time Mr. Allstopp's illegally placed house would be i moved to the site of a "grandfathered” in house which would be torn down (as is indicated on map in file). Application was scheduled with the Board of Adjustment on November 3» 1983. 15)On November 3» 1983 the Otter Tail County Board of Adjustment denied approval of Mr. Allstopp's third variance request for failure to show ade­ quate hardship.
