July 13,2006 Meeting - After discussion and consideration, Randall Mann made a motion, second by Steve Schierer and
unanimously carried, to table this variance hearing until the August 3, 2006 meeting to allow the applicants an opportunity to
consider other alternative which would not require a variance from the wetland for the installation of a septic system. August 3,
2006 Meeting - Wayne Johnson, System Designer, appeared with the applicant at the public hearing. Mr. Johnson stated that this
is the best location if perhaps not the only location. After discussion and consideration, Steve Schierer made a motion, second by
Paul Larson and unanijjiotisly^arried, to approve a variance of 20’ from the required setback from a wetland of 50’ for the

James Venaas - Approved the variance as requested. (9:27 p.m.)
James Venaas, Lots 8, 9 and 10 Oak Haven Beach, Tamarac Lake in Scambler Township, requested a
variance to place a drain field up to and into the road right-of-way. Scambler Township has approved the
placement of the drain filed in the road right-of-way. July 13, 2006 Meeting - A letter from Vincent Floberg
in support of the variance as requested was read for the record. Also, a letter from Wayne Johnson,
Scambler Township Clerk, indicating no objection to the installation of the drain field in the road right-of-
way so along as the applicant understands that he is responsible for any damage to the road during
installation or during maintenance of the system in the future and that the township accepts no liability
should the system be damage during normal road maintenance or road re-construction was noted for the
record. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Steve Schierer made a motion, second by Cecil Femling and unanimously
carried, to table this variance hearing until the August 3, 2006 meeting for an explanation from the
proposed system installer as to why the proposed system cannot be placed in another location on the
applicant’s property. August 3, 2006 Meeting - Steve Egge, System Installer, appear with the applicant at
the public hearing. Mr. Egge noted that the proposed location is not necessarily the only location, but is
definitely the best location. A letter from David Nudell in support of the variance as requested was noted
for the record. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson
and unanimously carried, to approve the placement of the proposed drain field in the road right-of-way as
depicted on the drawing submitted with the variance application dated June 13, 2006.
Matt Amundson - Approved a building site area based on the submission of a revised drawing with
a condition. (9:30 p.m.)
Matt Amundson, Lot 3 Block 1 Coney Island Acres Second Addition, West Battle Lake in Girard Township,
requested variances from the required ordinary high water level setback of 75’ for the location of a structure
less than 75’ from West Battle Lake. July 13, 2006 Meeting - Jim Peterson, Surveyor, appeared with the
applicant at the public hearing. The audience was polled with no one speaking for or against the variance
as requested. A letter from Jim Davis in support of the variance as requested was read for the record.
After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and
unanimously carried, to table this variance application until the August 3, 2006 meeting for a more
specific/detailed development plan. August 3, 2006 Meeting - Jim Peterson, Surveyor, appeared with the
applicant at the public hearing. After discussion and consideration, Michael Harris made a motion, second
by Steve Schierer and unanimously carried, to approve the proposed building footprint as identified on the
revised drawing dated July 21, 2006 with the condition that whenever construction/development should
occur the applicant must comply with the impervious surface coverage requirement in affect at that time, as
well as, any other setback requirements in affect except for the setback from the ordinary high water level
which has been established by the building footprint identified on the drawing referenced above.

variance from the wetland for the Installation of a septic system.
Janet Houser - Approve the variance application as requested. (9:02 p.m.)
Janet Houser, part of the Northeast Quarter and part of Government Lot 1, Section 30 of Everts Township
by North Turtle Lake, requested a variance of 72’ from the required ordinary high water level setback of
200’ for the placement of 24’ by 30’ detached garage 128’ from the ordinary high water level. Renee
Christenson appeared with the applicant at the public hearing. The audience was polled with no one
speaking for or against the variance as requested. After discussion and consideration, Steve Schierer
made a motion, second by Michael Harris and unanimously carried, to approve the placement of 24’ by 30’
detached garage no closer to the ordinary high water level than the existing garage as depicted on the
drawing dated June 14, 2006 and as submitted with the variance application. Hardship is the terrain of the
property. The Board noted that the proposed development will be no closer to the ordinary high water level
than the existing garage.
Dean and Cathy Merhiy - Approve the variance application as requested with a condition. (9:05
p.m.)
Dean and Cathy Merhiy, Lot 4 Kabicona Beach, Pelican Lake in Scambler Township, requested a variance
of T from the required drain field setback of 10’ and a variance of 1’ 6” from the required septic tank
setback of 10’ for the placement of a shed 9’ from the drain field and 8’ 6” from the septic tank. The
audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Paul Larson made a motion, second by Randall Mann and unanimously carried, to approve
a variance of T from the required drain field setback of 10’ and a variance of T 6” from the required septic
tank setback of 10’ for the placement of a shed 9’ from the drain field and 8’ 6” from the septic tank with the
condition that no more than 25% of the total lot area can be covered with impervious surfaces. Hardship is
a substandard lot of record. The Board noted that the structure is a non dwelling structure and its
placement will not pose a health issue. The variance as approved will provide the applicants with a
reasonable use of there property.
With no further business, Randall Mann, Chairman declared the meeting adjourned at 9:10 p.m.
