(9:00 p.m.) Elaine Skjenven, Lot 9, Block 1, Tanglewood Shores, Little Pelican Lake in Dunn Township, requested a variance of 2.5’ from the 10’ maximum allowable height of water oriented accessory structures for an existing gazebo having an overall height of 12.5’. The audience was polled with no one speaking for or against the request. April 3, 2003 Meeting - After consideration, motion was made by Randall Mann, second by Cecil Femlnig and unanimously carried, to tabled this variance request until the May 1, 2003 Board of Adjustment meeting so long as the applicant provides, by April 17, 2003, a written statement authorizing the Board’s action to table this hearing, otherwise, the variance as requested by the applicant is denied. May 1, 2003 Meeting - After additional discussion and consideration, motion was made by Paul Larson, second by Cecil Femling and carried with Leona Zimmerman abstaining, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and noting that if the variance requested was approved it would establish precedence. (7:30 p.m.) Mike and Pam Cicharz, Lot 1, Holman’s Maple Lane Beach, Stuart Lake in Nidaros Township, requested a variance of 22' from the required ordinary high water level setback of 100’ for the placement of a cabin and a deck 63.5’ from the ordinary high water level. From the drawing, it would appear that the cabin is 80’ from the ordinary high water level and that the deck would be 63.5’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. A letter from Rita J. Cicharz in support of the variance as requested was noted for the record. After discussion and consideration, motion was made by Paul Larson, second by Steve Schierer and unanimously carried, to approve a variance of 22’ from the required ordinary high water level setback of 100’ for the placement of a cabin 78’ from the ordinary high water level and to approve the placement of a deck 63.5’ from the ordinary high water level as depicted on the applicants’ drawing with the condition that no more than 25% of the total lot area can be covered with impervious surfaces. Hardship is a substandard lot of record and the granting of the variance as requested will provide the applicants with an ability to enjoy the same rights and privileges as others in this immediate area. After discussion and consideration, motion was made by Steve Schierer, second by Leona Zimmerman and unanimously carried, to approve a variance of 134’ from the required ordinary high water level setback of 200’ for the location of a building site (replacement structure) 66’ from the ordinary high water level with the following conditions; 1) the existing dwelling must be removed no later than 12 months after the date of the site permit, 2) an existing storage structure must be placed behind the building line upon substantial completion of the garage, and 3) no more than 25% of the total lot area can be covered with impervious surfaces. The audience was polled with no one speaking for or against the variance as requested. Larry Millner appeared along with the applicant at the public hearing. A letter from Paul and Mary Kloster in support of the variance as requested was read for the record. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling and carried with Mark Steuart and Leona Zimmerman voting no, to approve a variance of 9’ from the required road right-of-way setback of 20’ for the placement of a garage IT from the road right-of-way with the condition that a letter must be obtained from the township approving the proposed location and noting that the property owner is responsible for any damages to the garage which might result from the maintenance of the township road. It was noted that the variance as requested is being approved because the applicant was issued a site permit for the proposed location, because of the odd shape of the lot and because the road right-of-way increases from 66' to 100’ at this location.
