Otter Tail Beach Club Inc., Mooreton, ND, requested a variance to replace an existing 12’ by 58’ mobile home with a 14’ by 70’ mobile home 5’ from the lot line. After discussion and consideration, motion was made by Randall Mann, second by Steve Schierer and carried with Mark Steuart voting no, to approve the placement of a 14’ by 70’ mobile home at least 10’ from the lot line and with the condition that no more than 25% of the total lot area can be covered with impervious surfaces. It was noted that two mobile homes are being removed and that the applicant’s proposed project will be an overall improvement to the existing situation. This motion died for the lack of a second. After additional discussion and consideration, motion was made by Mark Steuart, second by David Holmgren and unanimously carried, to deny the variance as requested noting that a mound system cannot be constructed in area which has standing water. Minnesota Rules, part 4725.2000 requires that a well shall be located at least 50 feet horizontally from the ordinary high-water mark of a stream, river, or lake. The above-mentioned property was inspected on June 23, 1992, by Mr. Jeffrey Grugel from the Minnesota Department of Health, Fergus Falls District Office (MDH). Based on the results of the site inspection, information supplied in the variance request, supplemental conversations, and in accordance with Minnesota Rules, Chapter 4725, a variance is granted to construct a well less than 50 feet from the ordinary high-water mark of Franklin Lake. The variance is granted because there is no location on the property which satisfies all the required isolation distances. The proposed well location, approximately 24 feet from the lake and 5 feet east of the property line, provides the greatest available separation between the well and known contamination sources. The variance is granted with the following conditions: 1. The well casing shall extend to a depth of at least 50 feet or shall penetrate at least 10 feet of impervious material. 2. The annular space between the plastic casing and the drill hole shall be pressure grouted with bentonite or neat cement pumped through a tremie line from within 10 feet of the lower termination of the casing to 30 feet below the ground surface. The sewer line, which is currently within 50 feet of the proposed well location, shall be replaced with materials approved by this department for this purpose. You are required to notify Mr. Grugel at least 24 hours before beginning construction of the well so that an inspector may be present, if necessary.
