The property is described as Lot 12, Block 1, Rus-Dic, Otter Tail River in Aurdal Township. The applicant’s contractor represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Randall Mann, second by Frank Lachowitzer and unanimously carried, to approve the construction of a 16’ by 16’ four season porch addition being in line with the front part (river side) of the existing dwelling. It was noted that the addition will not obstruct the view of the neighboring property and is not within the shore impact zone. Hardship is the terrain of the applicant’s property, which does not accommodate the placement of the proposed addition on the other side of the existing structure. . Bonnie Anderson - Denied Bonnie Anderson, Hillsboro, ND, requested a variance of 60’ from the required ordinary high water level setback of 100’ for the construction of dwelling 40’ from the ordinary high water level. The property is described as Lot 25, Bergsten North Shore Park, Crane Lake in Clitherall Township. Andy Nordick represented the applicant. The audience was polled with a representative from Lot 26 speaking for the request. After consideration and discussion, motion was made by Mark Steuart, second by David Holmgren - to deny the variance as requested as no adequate hardship unique to the property had been shown and there is room to place the proposed structure outside of the shore impact zone. The vote on this motion was as . follows: David Holmgren, Steve Schierer, and Mark Steuart voting for the motion and Cecil Femling, Frank Lachowitzer and Randall Mann voting against the motion. After additional consideration and discussion, a motion was made by Randall Mann, second by Frank Lachowitzer to approve the variance as requested and as depicted on the applicant’s drawing, excluding the proposed shed, with the condition that all existing structures must be removed before a site permit can be issued for the proposed development. It was noted that applicant’s proposed project will meet the existing building line and will be a significant improvement. Hardship is a substandard lot of record. This second motion failed with Cecil Femling, David Holmgren, Steve, Schierer and Mark Steuart voting no. Noting again that adequate area is available to place the structure outside of the shore impact zone. Gerald Smith - Approved Gerald Smith, Fargo, ND, requested a variance to subdivide a small triangular tract for conveyance and permanent attachment to the neighbor's’ property. This small tract will be used by the neighbor to upgrade his, drain field. The triangular tract is approximately 28’ wide on the roadside and runs southerly on the common lot line for approximately 115 feet. The property is described as a part of Government Lot 5, Section 2, the West 59.69’ of Lot 2, Block 3, Reserve B and the easterly 6’ of Reserve A, Pelican Heights Subdivision, Little Pelican Lake in Dunn Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Steve Schierer, second by Cecil Femling, and unanimously carried, to approve the variance as requested. Hardship is the buyer’s substandard lot and the granting of the variance will improve the adjacent property with little or no iriripact to the applicant.
