Motion
Motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried to deny the
variance as requested noting that the Department of Natural Resources assisted with the establishment of the
bluff impact zone and noting that other good building sites do exist on the applicants’ property that would not
require a variance from the bluff impact zone.

Sayles and Marian Brodersen (Clarification)-
For purposes of clarification the Board was asked if they intended the proposed addition to be 10’ from
the septic tank when they approve a side lot line variance on October 2,1997 for Sayles and Marian
Brodersen. The Board reviewed the information contained within the file and determined that it was
clearly stated that the addition to the existing structure must be at least 10’ from the septic tank.
Jeff and Melody Bober (Reconsideration) -
Jeff and Melody Bober requested, by letter, reconsideration of their variance request which was denied
at the March 26, 1998 Board of Adjustment meeting. The Board reviewed their application and
determined that the information being presented had not change significantly to warrant reconsideration
of the previous hearing or the Board’s decision. The Board also stated that they would not consider
any lessor setback from the top of the bluff then the required 30’.
With no further business Chairman Walter declared the meeting adjourned at 10:10 p.m.

Kevin and Margie Kuehl - Approved
Kevin and Margie Kuehl, Maple Grove, MN, requested a variance to replace an existing roof with a new
roof having a 10/12 pitch. The structure is approximately 47’ from the ordinary high water level and
within 4’ of two 600-gallon septic tanks. The property is described as the South 114’ of the North 55T
of the East 208’ of Government Lot 4, Section 16 of Candor Township by Leek Lake. The audience
was polled with no one speaking for or against the request. After consideration, motion was made by
John Everts, seconded by Craig Anderson and unanimously carried, to approve the variances
necessary to replace an existing roof with a new roof having a 10/12 pitch with the condition that site
permit for this project cannot be issued until the water and/or septic system has been upgraded to meet
current standards.
Sheldon and Stacy Hein - Tabled
Sheldon and Stacy Hein, Battle Lake, MN, requested “an addition being 20’ from the top of bluff facing
the lake (Lot 13) and 0 to 7’ from the side of the bluff (being parallel to bluff) Lot 12 and Lot 13. Lot 12
is not a bluff lot from facing the lake.’’ The required setback from the top of bluff is 30’. The applicants
are proposing a 10’ by 44’ addition to an existing dwelling with an attached 26’ by 34’ garage. The
property is described as Lot 12 and 13, Anderson Beach, Otter Tail Lake in Otter Tail Township. The
audience was polled with no one speaking for or against the request. After consideration, motion was
by Cecil Femling, to allow the applicants to withdraw their request. No action was taken on this motion
and after additional discussion and consideration the following motion was made by Craig Anderson,
seconded by John Everts and unanimously carried, to table this request until the April 2, 1998 meeting
so that the applicants would have an opportunity to consider other alternatives.
Jeffrey A. and Melody Bober - Denied
Jeffrey A. and Melody Bober, Moorhead, MN, requested a variance to construct a dwelling, having a
walkout basement, within the bluff impact zone. The structure will be approximately 120’ from the lake.
Per the Land and Resource Office the top of the bluff is 125’ from the lake. The required setback from
the top of a bluff is 30’. The property is described as Lot 6, Block 1, Pelican Heights Subdivision, Little
Pelican Lake in Dunn Township. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and
unanimously carried to deny the variance as requested noting that the Department of Natural
Resources assisted with the establishment of the bluff impact zone and noting that other good building
sites do exist on the applicants’ property that would not require a variance from the bluff impact zone.
Doug Sukut and Dale Hinsverk - Approved
Doug Sukut, Wahpeton, ND, and Dale Hinsverk, Wahpeton, ND, requested a variance to “subdivide
parcel “B” from parcel “A" and to add parcel “B” to parcel “C” as depicted on the registered surveyor’s
drawing on file in the County Auditor’s office. The property is described as part of Government Lot 1,
Section 2 of Everts Township by Otter Tail Lake. A letter from Roland R. Mann, Manager of the Otter
Tail Water Management District, expressing concerns with the existing sewer systems was read for the
record. Clem Hendrickson, Surveyor, appeared along with the applicant at the public hearing. The
audience was polled with on one speaking for or against the request. After consideration, motion was
made by Craig Anderson, seconded by John Everts and unanimously carried, to approve the variance
as requested noting the following: that Parcel “C” cannot have another residential structure, that no
other variances will be granted for Parcels “A”, “B” and “C”, that the sewer system use by each dwelling
must be brought up to the standards of the Otter Tail Water Management District before the
conveyance of Parcel “B” to Parcel “C” and that no substandard lots are being created by the granting
of this variance.

In response to our conversation this momingy lam sending this letter
requesting that the board please consider a lesser setback.
With regards to our meeting on March 26thy the board had mentioned
that th^ would consider a variance setback amount of 8~10 feet instead of
the 30 feet we had or^naUy requested. At that time, we did not realize
that we could change our request or settle for less. However, after recentfy
staking out the building site, we realize that even a partial variance would
be helpful and appreciated.
Also, we are hoping to save an 80 ^100 year old oak tree that would
be preserved if given a variance of 8^10 feet
