Pettit Trust - Denied (9:13 p.m.) Alan W. Pettit Trust, Wadena, MN, requested the following: “We will have to re-roof the roof in the future. So we want to raise the back or south side of roof in a dormer fashion so that we will have more headroom on that side or south side of roof. The north side of roof is higher than the back or south side. The building will not be made wider, longer etc. Just part of same maybe 3 to 5 ft higher to match front. Carpenter calls it changing roof style.” It appears that the variance necessary is a variance to raise a roof on a second dwelling (sleeping room). The property is described as part of Jackson and McKees Addition and part of Government Lot 1, Section 23 of Pine Lake Township by Big Pine Lake. December 13, 2001 Meeting - An email from Sylvester and Louise Knapp in support of the variance as requested was read for the record. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Cecil Femling, second by David Holmgren and unanimously carried, to table per the applicant’s written request the public hearing concerning this application until the next scheduled meeting of the Board of Adjustment. April 11, 2002 Meeting - After discussion and consideration, motion was made by Randall Mann, second by Steve Schierer and unanimously carried, to deny the variance as requested noting that the applicant’s request if granted would allow for the continued use of a prohibited use. Lorraine Hicks - Approved Option 2 (9:23 p.m.) Lorraine Hicks, Fergus Falls, MN, requested the following: as shown in the site plan drawing on file with the County we wish to add onto the existing structure, which was built pre-ordinance in 1935. The new addition shall be no closer to the ordinary high water level than the existing structure, or approximately, 38’, therefore, requiring a variance of 162’ from the required ordinary high water level setback of 200’. It should be noted that the applicant owns approximately 360’ of shoreline covering six lots, the plot contains a wetland and the site of the septic system leaves little choice on the placement of this request. The applicant would like to develop the wetland area into a natural habitat area and is prepared to consider making part of the shoreline into a natural frontage. The property is described as Lots 4, 5, 6, 7, 8 and 9, Fish Lake Beach, Fish Lake in Aurdal Township. December 13, 2001 Meeting - Anthony Hicks appeared along with the applicant at the public hearing. The audience was polled with Clifford and Margie Ringquist speaking in favor of the applicant’s request. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to table, with the verbal agreement of the applicant, this public hearing until the next scheduled meeting of the Board of Adjustment so that the applicant will have an opportunity to consider other possible alternatives for the proposed development. April 11, 2002 Meeting - It was noted that the applicant has done what the Board of Adjustments had requested at the December 13, 2001 meeting. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve option two as presented in the revised detailed plans submitted by the applicant for this public hearing. (8:31 p.m.) Jim and Gwen Howe, Et. A!., Casselton, ND, requested a variance of 7’ 6” from the required side lot line setback of 10’ for an addition to an existing structure 2' 6” from the side lot line. The property is described as the East Half of Lot 8 and the West Half of Lot 9 and part of Government Lot 6, Section 5 of Dunn Township by Pelican Lake. A letter from Anne Gjesdahl Anderson requesting that the 10’ side lot line setback be maintained was read for the record. A letter from Mary Harpstead, Trustee noting several objections to the variance as requested was read for the record. The audience was polled with Philip Harpstead speaking against the variance as requested. Mr. Harpstead noted visual and drainage concerns that would be created by placing this addition so near to the lot line. After consideration, motion was made by Cecil Femling, second by Paul Larson and unanimously carried, to deny the variance as requested noting that placing this much additional structure next to the lot line would only enhance the existing problem and would not be consistent with prior actions of the Board of Adjustment. John and Margaret Lewis - Approved as requested. (8:45 p.m.) John and Margaret Lewis, Pelican Rapids, MN requested a variance to place a septic tank and a lift station closer than 50’ to a wetland. The property is described as a 10 acre parcel in the Northeast Quarter of the Southeast Quarter, Section 14 of Norwegian Grove Township. A letter from I. A. Slatten in support of the variance as requested was read for the record. Ross Seifert, Sherbroke Septic Service, also appeared with the applicant. The audience was polled with Joe Maske speaking for the variance as requested. Mr. Makse noted the extremely high water levels, which are beyond the applicants’ control. After consideration, motion was made by Cecil Femling, second by Steve Schierer and unanimously carried, to approve the variance as requested and in the location as depicted on the applicants’ drawing. The Board of Adjustment understood that the granting of this variance would place the septic tank less than 10’ from the deck, however, due to practical difficulties (water level), the need to provide the applicants with a reasonable use of their property and the lack of other alternative sites for the placement of the septic tank it was the opinion of the Board of Adjustment that this was the best that could be done and that this variance approval will not establish a precedence because of the unique situation. Donald and Joyce Grant - Approved with condition. (9:00 p.m.) Donald and Joyce Grant, Fergus Falls, MN, requested a variance of 19’ from the required ordinary high water level setback of 100’ for an addition to a dwelling 8T from the ordinary high water level. The property is described as Lot 5, River View Lane, Otter Tail River in .Aurdal Township. Scott D. Grant and Mark Bezek represented the applicants at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve a variance of 19’ from the required ordinary high water level setback of 100’ for an addition, as depicted on the submitted drawing, to a dwelling 8T from the ordinary high water level with the condition that the proposed addition must meet the string line test. The string line test is to be applied from the front corner of the applicant’s house to the neighbor’s house to the North. Hardship is the terrain of the applicants’ property.
