requested as no adequate hardship unique to the property had been shown that would allow for the granting of the

Kim Rickert- Denied as requested.
Kim Rickert, Fargo, ND, requested a variance to leave an existing icehouse in its present location. It appears
from the applicant’s drawing that the icehouse is currently 10’ from the road, V2 foot from the property lot line
and 10’ from the septic system. The property is described as the west 50’ of the east 70’ of Lot 4, Henry’s Hill,
Franklin Lake in Dunn Township. A letter from Merle Miller, Chairman of the Dunn Town Board, opposing the
variance as requested was read for the record. The audience was polled with no one speaking for or against
the request. After discussion and consideration, motion was made by Steve Schierer, second by David
Holmgren and unanimously carried, to deny the variance as requested as no adequate hardship unique to the
property had been shown that would allow for the granting of the variance as requested and noting the
township letter opposing the variance as requested.
Harold and Jean Diederick - Approved as modified.
Harold and Jean Diederick, Battle Lake, MN, requested a variance of 5’ from the required side lot line setback
of 10’, a variance of 17’ from the required ordinary high water level setback of 75’ and a variance of 1% from
the allowable impervious surface coverage of 25% for the construction of an addition 5’ from the side lot line,
58’ from the ordinary high water level and with total impervious surface coverage of 26%. The property is
described as Lot 23, Pleasant Grove, Otter Tail Lake in Amor Township. The applicant presented an
alternative plan. The audience was polled with Paul Ness speaking in support of the applicants’ second
proposal. After consideration, motion was made by Steve Schierer, second by Mark Steuart and
unanimously carried, to approve a variance of 5’ from the required side lot line setback of 10’ for the
placement of an addition, as depicted in the applicants’ drawing for their second (alternative) proposal, 5’ from
the side lot line. It should be noted that the addition would not exceed the string line and impervious surface
coverage will not exceed 25% after the proposed project is completed.
J. Patrick and Linda K. Hilley - Approved with conditions.
J. Patrick and Linda K. Hilley, Fergus Falls, MN, requested the following: “We propose to decrease the size of
the screen porch by 8” in width and 4” in length, for approximately 16 square feet in total size and we propose
to lower the ceiling by 4” in height. This screened porch is in the bluff and 37’ from the lake. We propose to
build a second story addition above existing house to be 24’ by 32’ or 768 square feet. This is in the bluff and
47’ from lake. We propose to build a 936 square foot addition off the back of the existing house. This addition
meets the string line, but is 18’ from the top of the bluff. We propose an 896 square foot garage addition.”
The required ordinary high water level setback is 75’ and the required bluff setback is 30’. The property is
described as part of Government Lot 3, Section 23 of Amor Township by Otter Tail Lake. Letters in support of
the applicants’ request from Loraine Dean, Warren and Clarice Nye, Jim and Marilee Bergerson, Sandra S.
Thomas and P. R. Becken were read for the record. The audience was polled with no one speaking for or
against the request. A letter from Steve Miletto, Contractor, indicating how the bluff zone would be protected
during construction and how it would be restored after construction was read for the record. Prior to
consideration by the Board of Adjustment the applicants noted the following changes: 1) they are no longer
requesting variances for a second story addition, and 2) the proposed addition between the garage and the
existing house will be no wider than the existing dwelling (approximately 28’). After discussion and
consideration, motion was made by Randall Mann, second by Mark Steuart and carried, with Cecil Femling
voting no, to approve a variance for the screen porch with the condition that the applicants must make the
adjustments to the screen porch as stated in their variance application and to approve a variance for an
approximately 28’ wide addition directly to the back of the existing dwelling with the condition that the run off
from both the existing structure and the proposed addition must be directed to the back of the lot and away
from the lake. Hardship is a substandard lot of record. It was also noted that all construction is to the rear of
the existing dwelling and none of the proposals are any closer to the bluff than the exiting dwelling.

Gentlemen:
The Dunn Township Supervisors have looked at the property of Kim Rickert at 47809
Henry Hill Lane, which is in Section 27 and Range 42 of Dunn Township. The Dunn
Township Supervisors would ask that the variance requested be denied as the ice house
is to close to the neighboring property line and is in the township right-of-way.
We hope that you will consider Dunn Township’s request for denial of the variance
requested by Kim Rickert. Thank you for your consideration in this matter.
