(6:53 p.m.) After consideration and discussion, Paul Larson made a motion, second by Thomas Lee and unanimously carried, to approve the placement of an addition to the rear of the existing structure with the following conditions: 1) the addition must be at least 50’ from the ordinary high water level, 2.) at least 10’ from the side lot lines, and 3.) no more than 25% of the total eligible lot area can be covered with impervious surfaces. It was noted that the variance as approved does not directly or indirectly grant any other variances for the proposed development. It was also noted that the variance as approved will provide the applicants with a reasonable use of their property. (6:53 p.m.) Chad and Becky Richards Living Trust, Lots 2 and 3, Inwood Beach Third Addition, Fish Lake in Dunn Township, requested a variance of 4T from the required ordinary high water level setback of 75’ for the placement of a 38' by 24’ addition to the existing dwelling 34’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. Tom Shulstad, Contractor, appeared with the applicant at the public hearing. An email from Grant and Laurie Hoovestol in support of the variance as requested was read for the record. (7:08 p.m.) Joyce Alfson and Virgil Alfson Jr., part of Government Lot 3, Section 12 of Amor Township by Otter Tail Lake, requested the following; This lot was recorded in 1974 and does not meet the size requirements for a buildable lot. The lot is 35 hundredths of an acre. I am requesting to have this lot declared buildable for single family residential use. The audience was polled with Dean Rindy addressing the variance application. After consideration and discussion, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to approve the variance as requested in the variance application dated October 12, 2009. It was noted that there are dwellings on both lots and the Board’s approval is consistent with past board actions. Terry Dohman - Denied. (7:19 p.m.) Terry Dohman, part of Government Lot 1, Section 29 of Amor Township by Otter Tail Lake, requested the following: We are requesting a variance of 5’ from the normal 10’ side yard requirement on each side of our property allowing us to build within 5’ of each side line. This would enable us to construct our home as per the plan we designed for our lot. We based the design off the 60.5’ of frontage. However, the layout of our lot only gives us a 5T building width. Rick Bladow, Contractor, appeared with the applicant at the public hearing. The audience was polled with David Lundeen, Attorney, speaking on behalf of Phyllis Johnson in opposition to the variance as requested. Also, expressing concerns with the applicant’s request was Clara Hansen. Mr. Lundeen also submitted for the record a written statement of objections on behalf of Phyllis Johnson, six pictures and two survey drawings. Letters from Linda McDougall and Jolene Miller in support of the variance as requested was read for the record. After consideration and discussion, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to deny the variance as requested as no adequate hardship/practical difficulty had been shown that would allow for the granting of the variance as requested and noting the following: 1.) the dwelling should be designed to fit the lot, and 2.) the applicant has adequate room to obtain a reasonable use of his property without the requested variance from the side lot lines. Gary Winterquist - Approved the variance application as requested. (7:48 p.m.) Gary Winterquist, Lot 1 Oakwood Beach, Silver Lake in Everts Township, requested the following: Enclose existing carport. No new rooflines or foundation. Per phone conversation with Gary Winterquist on October 13, 2009 the 12’ by 24’ existing carport is approximately 42’ from the lake (EB). The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve the variance as stated in the application dated October 9, 2009 and as depicted on the drawing submitted with the variance application.
