The string test may not be appropriate here because the lake juts sharply in to the south. The cabin to our north is even with ours on the west. A variance would bring our cabin up to the standards of neighboring cabins. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, motion was made by Paul Larson, second by Richard Sha and carried with Mark Steuart and Steve Schierer voting no, to approve the variance as requested and as depicted on the applicants’ drawing. (8:30 p.m.) Raymond and Peggy Suess, part of Reserve Lot F, Leaf Lake Pleasure Grounds and part of Government Lot 5, Section 21 of Leaf Lake Township by West Leaf Lake, requested a variance of 61’ from the required ordinary high water level setback of 100’ for an addition to an existing dwelling 39’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, motion was made by Paul Larson, second by Cecil Femling and unanimously carried, to approve the proposed development being no closer to the ordinary high water level than the existing dwelling, which is assumed to be approximately 39’ from the ordinary high water level. Hardship is the terrain. It was also noted that the proposed development will not obstruct the view from the adjacent properties and that it will be in line and/or behind the existing string line. Bruce and Nancy Monson - Approved as requested. (8:34 p.m.) Bruce and Nancy Monson, part of Lot 3, Clearmont Beach, Otter Tail Lake in Everts Township, requested a variance of 15” from the required side lot line setback of 10’ for a 20’ by 17’ addition 8’ 9" from the side lot lines. The variance as requested would allow the addition to match the existing structure and transition area from the existing to new deck/patio. The transition area begins 3’ from the lot line. The audience was polled with Jim Cook speaking for the variance as requested. An email from Doug Geeslin in support of the variance as requested was read for the record. After consideration and discussion, motion was made by Steve Schierer, second by Paul Larson and unanimously carried, to approve a variance of 15" from the required side lot line setback of 10’ for a 20’ by 17’ addition 8’ 9" from the side lot lines as depicted on the applicant’s drawing. Hardship is a very substandard lot of record. It was also noted that the proposed development would not be as close to the side lot line as the existing cabin. Debra and Kirstin Mooney - Approved Plan B. (8:40 p.m.) Debra and Kirstin Mooney, part of Lot 4, Lucky Horse Shoe Bay, Lake Lida in Lida Township, requested the following; Plan A - Replace existing dwelling located in line with adjacent dwellings on either side (using string line to northwest corner of adjacent dwelling closest to lake) Dwelling to be approximately 60’ from ordinary high water level and 1’ from the east property line at the closest corner. Plan B - Replace existing dwelling located in line with adjacent dwellings on either side (using string line to northwest corner of adjacent dwelling closest to lake). Dwelling will be approximately 60’ from ordinary high water level and will be 6.5’ from the east property line at closest corner. The audience was polled with no one speaking for or against the variance as requested. Lot B, Denwood Acres First Addition, Pickerel Lake in Maine Township, requested a variance to attach a substandard back lot to my lake lot so that in the future it is buildable for non- residential purposes. Joan and Curt Houston represented the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve the variance as requested with the following conditions; 1.) only one nonresidential structure can be placed on this lot, 2.) all other setback requirements must be met, and 3.) the area within the back lot cannot be used when calculating the 25% impervious surface coverage for front lot development. Randall and Kathleen Josephson-Tabled. (8:40 p.m.) Randall and Kathleen Josephson, Parcel B of Government Lot 2 and a triangular tract in Parcel A, Section 20 of Dunn Township by Lake Lizzie, requested a variance of 60’ from the required ordinary high water level setback of 100’, a variance of 4’ from the required side lot line setback of 10’ and a variance from the required road right-of-way setback of 20’ for the replacement of an existing 8’ by 33’ trailer with a 12’ by 33’ calain 40’ from the ordinary high water level, 6’ from the side lot line and less than 20’ from the traveled road surface. Also requesting a variance of 60’ from the required ordinary high water level setback of 100’ for the replacement of 16’ by 10’ porch with a 14’ by 13’ porch 40’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, motion was made by Randall Mann, second by Steve Schierer and unanimously carried, with the verbal permission of the applicant, to table this variance requested until the September 4, 2003 meeting of the Board of Adjustment. The application was tabled to allow the applicants an opportunity to consider alternative plans, which might reduce the number of variance being required for the development as currently proposed. Additional Discussion - John and Jean Hertsgaard - May 1, 2003 Hearing. The variance that was previously granted to John and Jean Hertsgaard on May 1, 2003 was reviewed and discussed by the Board of Adjustment. It was determined that what is stated in the May 1, 2003 minutes was what the Board of Adjustment intended to grant the applicants. If the applicants did not comply with the variance as approved they will either need to bring the development into compliance or file another application for review. However, it should be understood that submitting a new application in no way implies that the application will be approved.
