The request was tabled as there were several concerns expressed by the board members. Taking the boards concerns into consideration we would like to amend our variance to reflect the following: PROPOSAL: Change the slope of the existing roof to prevent water leaks and add a storage room above the garage. Height of the proposed changes to the garage will not exceed 20 feet. No change is proposed to the existing footprint of the garage. 1. The current height of the garage is 14 feet. No variance for height is requested as the proposed change would be within the height ordinance. 2. Because the existing garage is at the closest point 2 feet from both the west and north lot lines we are requesting an 8 foot variance from both lot lines. This is the same as the original variance request. 3. Because we are no longer widening the existing footprint of the garage the sewer pumping station is located 6 feet from the garage. We are now requesting a 4 foot variance for the sewer pumping station. The original variance request was for 10 feet. 4. The original variance request had added additional width to the garage and included an addition on the north end. The impervious surface ratio was 24.8%. Because we are keeping the existing footprint of the garage the impervious surface ratio decreases to 21.5%. Art & Mary Hultgren October 7, 2010 Page # 6 Cory Klostriech - Tabled Cory Klostriech, Lot 1 Birchwood Shores First Addition and Lot 6 Birchwood Shores Second Addition, Pickeral Lake in Maine Township, requested the following: Split Lot 1 Birchwood Shores First Addition from Lot 6 Birchwood Shores Second Addition and to declare each lot buildable for single family residential use. Lot 5 Birchwood Shores Second Addition had a year round home established four years ago. Note - Garage on Lot. 1 is about 2’oyer property line to Lot 6. Lot 6 is the largest substandard back lot, I believe on Birchwood Shore Second Addition, with nothing on it. August 5, 2010 meeting - Sara Klostriech was also present at the hearing. The audience was polled with Darwin Krause seeking clarification/information regarding the applicant's variance request. Also, an additional individual spoke regarding the need for a survey to determine both the lot line and the location of an existing garage. The audience was polled with Bob Bussman expressing concerns with the impact (drainage) of the proposed development on his property. A letter from Charles and Barbara Keeler in support of the variance as requested was noted for the record. After a brief review and discussion, the applicant's hearing was tabied untii later in the evening to provide an opportunity for the Land and Resource representative to secure the file of an adjacent property for the . purpose of reviewing a previously granted variance. The fiie was reviewed and the information contained within was considered. After additionai discussion and consideration, Randaii Mann made a motion, seconded by Michaei Harris and unanimousiy carried, to deny the variance as requested as no adequate hardship/practical difficulty had been shown that would allow for the granting of the variance as requested and the applicant as the ability to construct a 22’ wide storage building without the granting of the requested variance, which would provide the applicant with a reasonable use of his property. Douglas and Carol Crice - Denied. (7:55 p.m.) Douglas and Carol Crice, Lot 2 Third Addition to Sunnyside, East Battle Lake in Nidaros Township, requested the following: Expand elevated deck by 4’ toward lake. Requesting a variance of 74’ from ordinary high water level. Will not increase impervious surface ratio, built over existing concrete. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Randall Mann made a motion, seconded by Michael Harris and unanimously carried, to deny the variance as requested as no adequate hardship/practical difficulty had been shown that would allow for the granting of the variance as requested, other options which do not advance the structure towards the lake should be considered, the current impervious surface coverage is slightly more than twice the allowable amount and efforts should be made to reduce the overall amount of impervious surfaces before consideration is given to new development. Mark and Barbara Malmberg - Approved the variance application with conditions. (8:08 p.m.) Mark and Barbara Malmberg, Lot 70 Provan Beach, Pelican Lake in Dunn Township, requested a variance of 3T from the required ordinary high water level setback of 75’ for the enclosure of an existing porch and for an addition being 44’ from the ordinary high water level. The audience was polled with Mark Ottis speaking for the variance as requested. After consideration and discussion, Michael Harris made a motion to deny the variance as requested. This motion died for lack of a second. After additional discussion and consideration, Steve Schierer made a motion, seconded by Thomas Lee and carried with Michael Harris voting no, to approve a variance of 31’ from the required ordinary high water level setback of 75’ for the enclosure of an existing porch and for an addition being 44’ from the ordinary high water level as depicted on the drawing submitted with the variance application with the condition that before a permit can be issued for the proposed development the applicants must remove the 18’ by 20’ 2” concrete slab and must place the two existing sheds in a location which is between the dwelling and the road, at least 10’ from the side lot lines, at least 20’ from the road right-of-way and at least 10’ from the holding tank. The garage, we are told, would be placed on the same footprint of the existing structure, which is only 2-3 feet from two different sides of our property (east and north). Though the original garage was built in violation of codes and is too close to our property, we are not protesting this variance. That is due to the fact we want to be good neighbors and that the existing structure has been on the same site for more than 30 years -our garage was originally built well before then, when our grandmother owned the Huitgren property. We are, however, concerned with the height of the structure, and would like the variance to be conditioned on it being a one-story with no loft area. Even as a one-story it will be higher than the existing structure, from the plans we've seen, because of the way the eaves rise to the middle in the back facing our cottage. We would also like to reserve the right to rebuild our garage, which sits only a few feet from this structure in the near future on a similar level. Mr. Art. Huitgren, the applicant's husband, assures us that he is completely in favor of anything we would like to do in this regard. The only other thing we would like to make sure of is that the bathroom planned for this garage is hooked up to a sewage system that is not a part of our back property, which sits immediately behind the proposed new structure.
